Please be advised that this office represents Louis Frank Motorcars, LLC in connection with the above referenced complaint filed by [redacted] It shall be emphasized that LFM LLC hereby unequivocally denies the correctness of any and all allegations that were contained in [redacted] complaint and further denies that it is liable under breach of warranty, or that it committed acts of misrepresentation, or breached the motor vehicle purchase contract or the likeThere can be no dispute that [redacted] purchased the approximately elevan year old vehicle on October 16, Pursuant to statute, [redacted] was required to have vehicle inspected by state certified safety and emissions test site center with seven days of the vehicle registrationUpon information and belief, as my client was never notified to the contrary, the vehicle passed this required inspection thereby extinguishing any and all rights he may have had under MGL CH 7NThe vehicle was properly warranted against "covered defects" for sixty days or 2,miles as the vehicles mileage was 88,at the time of the saleAs [redacted] so aptly admits in his complaint, he made no attempt to return the vehicle to LFM LLC for diagnosis or repair of any alleged "covered defect"Instead, and contrary to the provisions of MGL Ch & 7N [redacted] caused several for profit dealerships and or repair facilities that are in no way authorized by LFMLLC, to diagnose alleged defects and effectuate repairsPlease be advised that as a result of these unauthorized repairs, [redacted] voided any rights under the Limited Used Vehicle Warranty Law [redacted] then demanded my client make payment for these alleged repairsDespite any obligation to do so, LFM LLC did make reimbursement to [redacted] for alleged repairs as well as other cost asserted by him, but for which he utterly failed to provide supporting documentation as requestedIt is important to note that the vehicles accumulation of mileage indicates the vehicle is operating as designedFurther , the items [redacted] requests such as tune ups, oil changes and the like which are maintenance in nature are never considered "covered defects" under the statuteAdditionally, several items are noted indicating the vehicle is being operated in a negligent manner and, as such any and all rights to relief under any theory of warranty pursuant to MGL ch & 7N 1/would be extinguished , assuming arguendo, the [redacted] had not voided his rights when he caused repairs to be made prior to my client's authorizationThe staff of LFM LLC has built its fine reputation in the industry and community through many years of business and both hard work and fair dealings with its customersLFM LLC has always taken whatever steps that are reasonably necessary in order to resolve a particular dispute or problem that may arise even though it is through no fault of the dealershipLFM LLC will not repurchase the vehicle or pay for repairs as there is no obligation for us to do soMy Client's position is plausible and reasonedMoreover, my client would be remiss to point out the Revdex.com that [redacted] has been reimbursed funds in the amount requested by him which were in excess of the amounts demonstrated on the limited documentation he provided, and that in exchange for said reimbursement a release was required [redacted] has retained the funds, but has failed to execute and return the release providedThis response to [redacted] complaint is being made without prejudice to any of the rights of LFMLLC and shall not be deemed to be constructed in any way as an admission of liability in this manner

I have provided all documentation necessary to prove the defects affecting both safety and use with this vehicleNeed I remind you, there is no "sold as is" or "50/50" warranties in the state of MassachusettsI have never ONCE signed a warranty for this vehicle other than the little statement on the bill of sale that states "THIS VEHICLE IS SOLD AS-IS", and when I asked for a copy of any such warranty I received nothing A signed warranty for the vehicle stating the day/miles or day/miles by Massachusetts law is necessary for the warranty period to even begin. You have once stated (in a certified letter from your lawyer) that my warranty was for days or milesHowever, now you have stated in your response that my warranty was for days or milesNow which is it? Your disregard for accuracy is representative of *** Frank Motorcars' total disregard and complacency for regulations and laws held in the state of MassachusettsI have provided all supporting documents from the very first tow, (less than miles from the dealership) all the way to the final inspection done by the mechanic that *** instructed me to useLouis Frank Motorcars has tried to negotiate the repairs and even pay for all the parts necessary, which I find completely unacceptablePer *** instructions the vehicle was diagnosed by the so called unauthorized dealerships and has been deemed unsafe to drive until repairs that are NOTmaintenance in nature are madeI have not driven this vehicle negligently nor had repairs done to the vehicle without Louis Frank Motorcars' approvalIt is obvious that byLouis Frank Motorcars' paymentfor the repairs at the time of repair is proof of his authorization for the "for profit dealerships" to make the repairs.
