This letter is in response to the complaint from Mr***, received October 19th, 2015, from the Revdex.com regarding his membership and requesting a refund with the Louisville Athletic ClubThe cancellation policy in question is also the same cancellation policy to which Mr.*** agreed when he
initially joined our clubOn September 8th, we received his letter to cancel and on September 9th, he was contacted by the Assistant General Manager to inform him we were processing the cancellationAt that time he was reminded of the standard cancellation policy and he refused to pay the remaining balanceThe balance owed is for his last two months of membership and associated late feesWe did explain this to Mr*** and will gladly offer him a second copy of the agreement he originally signedI, the GM, and the company apologize for the inconvenience and confusion on the part of the memberIt is always our intention for members to be able to retire their memberships convenientlyTherefore, we do not charge any cancellation fees and always give a receipt of cancellation to membersWe would like to make it known that our membership agreements and policies are always in full compliance with the Commonwealth of Kentucky Attorney General’s OfficeWe are committed to providing excellence in both service and product and wish him and all of our former and current members a life of good health Kind Regards, *** ** *** General Manager Corporate Wellness Consultant Louisville Athletic Club II Taylorsville RdLouisville, KY ###-###-####

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Their response doesn't even sound like we are talking about the same matter. 
1. I was never contacted by the "Assistant" General Manager. Ms [redacted] forwarded to me to what I was told was the General Manager's voice mail and I left a detailed message about the situation but my call was never returned. 2. Why is the name of the Assistant General Manager or General Manager not in the complaint? I don't know their name. 3. They cashed a check noted "Final club fees paid in full". See attachment. 4. When I made this payment, I wrote on the bill that the GM never contacted me and call me if questions. 4. I'm not asking for a refund. Where did that even come from?5.  If I still owe them money, I want an ITEMIZED BILL for what they are charging me for. They just can't send out bills for amounts due. They are charging me some mystery amount of money! The amount I owe keeps getting higher and they agreed when cashing my check it was paid in full. Regards,

In response to the complaint that Ms. [redacted] has no agreement with us, we would like to provide the following information. On 11/19/2014 she signed an agreement with the Louisville Athletic Club. Once processed she was emailed a copy to [redacted].com (the same email address she...

provided to the Revdex.com) on 11/25/2014 @9:16am. Upon receiving this complaint, I resent the email on 7/24/2017 @3:04pm. Our records indicate that once the credit card she provided was declined, we attempted to collect the debt by sending collection letters on 2/12/2015, 3/10/2015, and 4/20/2015. On April 7th 2015 she spoke with our company about settling her debt but failed to follow-through. We attempted to contact her again on 8/6/2015 by leaving her a voicemail and sending her an email (of which we retained a copy) about how to settle her debt. She did not respond.  A year later on 8/18/2016 she spoke to one of our employees in person, at another location. Again, she was informed she needed to settle her debt. That same day she spoke with someone at this location and informed us that she was going to provide us with medical proof she was unable to use the club. We have never received any information she stated she would provide and we have not heard anything further about her desire to reconcile her debt until she filed a false complaint with the Revdex.com stating she has no relationship with our company. Again, we would like to state we have provided Ms. [redacted] with copies of her agreement with our company on 11/25/2014 and again 7/24/2017. She may also obtain a copy by stopping by the club and providing a valid ID. We made every effort to collect the debt owed through, letters, emails, calls, and have spoken with her in person regarding this matter. The Louisville Athletic Club is a small business operating in this state for over thirty years. We care that our members not only enjoy their experiences with our company, but that those relationships lead to healthier lives for them. We have always been in compliance with the Attorney General’s Office and always try to avoid sending a delinquent member to collections, if possible.
