Review: The Company stopped services without our request. We requested an invoice for services rendered and were told one would be sent. We were supposed to receive our membership fee refunded to us and a 20% discount for our inconvenience. After three months of no communication from the company our credit card was charged the full original fee, as well as three months of late fees without ever receiving an invoice until after we threatened to sue. We still have not received the membership refund, the 20% discount, and obviously we should not have been charged three months in late fees when we were never sent an invoice when we asked for one. We would have very much liked to sue this company but the cost would have been more than the money she owes us and we feel she has done this on purpose and is a scam artist.Desired Settlement: The Loving Image Nanny worked for three weeks at $11/hour 5,17,13 hoursThis is 35 hours which is 385 dollars minus the $65 membership fee That was supposed to be refunded to me back in August. Divided by the 20% off the first month services promised me (10% new customer discount and 10% because the Nanny did not show up for the first interview) and we have $256 which I owed Loving Image. They Charged my Credit Card $505.So I would like a $249 refund.

Response:

I initially interviewed the mother of the family and I explained to her in details of the program. I explained to her our rates and fees of the program she in turned explained to me that rate wasn't something that she could afford so in return I significantly cut the rate to accommodate her needs to 11.00 per hour. Our company pays a rate of 15.00 to 18.00 per hour to our caregivers depending on experience. My company provided a Licensed Practical Nurse for her family. The caregivers education and qualifications over exceeded 11.00 per hour. However I also explained there would be a fee of 65.00 for membership that we charge annually. She at that point agreed. I also was informed that they would need 25 hours a week which was fine due to the fact I explained that there was a 20 hour minimum. I sent over the contract that needed to be signed and the estimate and the online payment link for the 65.00 membership fee to the email that she provided. She signed the contract, paid the 65.00 membership fee and booked the interview with the caregiver. However there was a communication error with the caregiver that she missed the appointment with the family so I agreed to give her a 10% discount on her first bill. We do not charge for appointments or placement fees to the family. When the family met withe the caregiver the family had liked her and wanted to proceed with services. She explained that she would be paying bi weekly and electronically. Services where being rendered starting august 28 2013. We sent electronic billing to the same email that we sent the membership link to that she provided. We also took notice that the care giver was only doing 5,13,17 hours a week, I then in turn informed the mom that we have a requirement of 20 hours and she needed 25 is there something wrong. She informed me that she was having issues with her employment situation. I informed her that none of my caregivers would work under 20 hours a week that the caregiver will continue to work 2 more weeks and that I will refund her membership fee. Furthermore I never charged her for the missing time for the weeks that where to required. I only charged the hours used. I issued a refund of 65.00 to her via mail. I sent out a collection letter no response to the letter. I send numerous payment reminders to the email that she provided when she paid the membership fee she nor her husband responded. During the initial services being rendered she never called in to make a payment nor say she didn't get any invoices. Not until I emailed her about charging the card on file for unpaid balances is when she complained and wanted to seek legal action. However at that point she went on to state she never received any invoices for services and she never got her refund. She went on to say that she wasn't going to pay for undisclosed amounts which was not undisclosed amounts because she knew all the hours and the rates. I stated to her how did the same email you provided an set up your card and paid the membership with, how didn't you receive invoices? I went on to say to her you had to know that services are not free and you neglected to pay your bills. In the contract states a 2.00 per day late fee which I applied to her account. Furthermore My company had given her a tremendous discount at a unheard of rate, didn't charge her the required minimum and issued a refund to her card on file. Not to mention on top of it all she nor her husband paid there bills. If we didn't charge her card on file we wouldn't have received payment. They never paid there bills nor did they email, call or sent anything via mail. She complained about why didn't we send her correspondences when we did. she either ignored them or thought services where free. I charged her for the services in completion with the exception of the 65.00. That was money owed. I charged her 5,13,17 hours times 11.00 which made it out to be 385.00 monies owed then 120 in late fees. However if I would have charged her card for the required 20 hours per week times 3 weeks plus the late fee that would have made it 11.00 per hour times 20 required hours times 3 weeks = 660.00 + 120 late fees =780. If I enforced her contract and legally I could she would have had to pay 25 hours per week times 3 weeks plus late fees which would had been 11.00 times 25 hours time 3 weeks =825 plus late fee 120=945. She calls me a scam artist when technically I didn't enforce my contract and undercharged her family.

Review: [redacted]

I am rejecting this response because:

Thank you for admitting that we have not yet received our $65 refund. We have also not received our 20% discount from the 1st week of services rendered for the inconvenience for the nanny not showing for her interview as stated in previous corresponce through the Revdex.com. Once these two refunds are received we will consider the matter closed.

Sincerely,
