This statement is in response to complaint # [redacted] filed by Mrs [redacted] regarding work performed by my shop on her 2OODodge Caravan with, CA Lic:# [redacted] As the attached work order and payment receipts indicate, the vehicle was towed early in May with a frozen transmission with the front wheels stuck (ie wont roll), license tags had expired, no battery, and bad brakes among other things Mrs [redacted] stated that someone had attempted to fix the transmission issueShe indicated that they had purchased a used transmission at the wrecking yard but that they pulled the wrong transmission as a result the vendor would only give her credit for future purchase instead of a refundShe stated that she had limited financial resources and requested my help in purchasing the proper transmission with low mileage, and install it She indicated that her husband was ill and undergoing dialysis treatment and as such she could ill afford to spend a lot of money on the vehicleIn light of her predicament, I decided to help her search for a good used transmission and install it if we can agree on a fee for the serviceShe indicated that $was all she could afford for the serviceI accepted her payment offerI was able to locate a used transmission at the cost of $In addition, the total cost of parts for the installation of the transmission was $ Mrs [redacted] made a total of four payments over a three- week period in MayIn addition, it took about ten days for her to provide a battery and a DMV moving permit to enable us to test drive the vehicle following the installation of the transmissionBasically ,we spent the entire month of May waiting for her to complete payment for parts an1abor and necessary documentation that would allow us to test drive the vehicle When we finally test drove the vehicle together with her and her husband, we were not satisfied with the performance of the transmission suppliedI immediately requested the supplier to send a replacement transmissionThe supplier responded promptly and the replacement transmission was installed within daysMrs [redacted] test drove the vehicle and was satisfied with the performance of the transmissionThe transmission has miles and performed satisfactorilyThe vehicle was released to her on 6/5/with a 90- day warranty on the transmission Since the release of the vehicle to Mrs [redacted] , she has called and reported a no-start and a stuck ignition switch, issues unconnected with the transmission work performedWe have made appointments with her to bring the car to the shop so we could look into her complaint and each time it has been a no- call no-show Mrs [redacted] is demanding that the original contract should be re-written and the shop to fix all of the vehicles numerous pre-existing problemsSince the vehicle was towed to the shop, it never left until the transmission was installed and drive- tested by the mechanic and the ownerWe have discounted $and provided free labor and parts towards the repair of this vehicle Finally, we have gone over and above what we contracted to do in order to help a client in financial dire straitsIt is our view that we are not liable to perform any repairs to Mrs [redacted] ’ car for issues that are unrelated to the initial work performed on the installation of the transmission without initiating a new work order

She indicated that they had purchased a used transmission at the wrecking yard but that they pulled the wrong transmission as a result the vendor would only give her credit for future purchase instead of a refund. She stated that she had limited financial resources and requested my help in purchasing the proper transmission with low mileage, and install it.
She indicated that her husband was ill and undergoing dialysis treatment and as such she could ill afford to spend a lot of money on the vehicle. In light of her predicament, I decided to help her search for a good used transmission and install it if we can agree on a fee for the service. She indicated that $1000.00 was all she could afford for the service. I accepted her payment offer. I was able to locate a used transmission at the cost of $800. In addition, the total cost of parts for the installation of the transmission was $109.36.
Mrs. [redacted] made a total of four payments over a three- week period in May. In addition, it took about ten days for her to provide a battery and a DMV moving permit to enable us to test drive the vehicle following the installation of the transmission. Basically ,we spent the entire month of May waiting for her to complete payment for parts an1abor and necessary documentation that would allow us to test drive the vehicle.
When we finally test drove the vehicle together with her and her husband, we were not satisfied with the performance of the transmission supplied. I immediately requested the supplier to send a replacement transmission. The supplier responded promptly and the replacement transmission was installed within 2 days. Mrs. [redacted] test drove the vehicle and was satisfied with the performance of the transmission. The transmission has 74000 miles and performed satisfactorily. The vehicle was released to her on 6/5/14 with a 90- day warranty on the transmission.
 Since the release of the vehicle to Mrs. [redacted], she has called and reported a no-start and a stuck ignition switch, issues unconnected with the transmission work performed. We have made 3 appointments with her to bring the car to the shop so we could look into her complaint and each time it has been a no- call no-show.
Mrs. [redacted] is demanding that the original contract should be re-written and the shop to fix all of the vehicles numerous pre-existing problems. Since the vehicle was towed to the shop, it never left until the transmission was installed and drive- tested by the mechanic and the owner. We have discounted $545 and provided free labor and parts towards the repair of this vehicle.
Finally, we have gone over and above what we contracted to do in order to help a client in financial dire straits. It is our view that we are not liable to perform any repairs to Mrs. [redacted]’ car for issues that are unrelated to the initial work performed on the installation of the transmission without initiating a new work order.

Review: in the very beginning before taking my car to mr. [redacted] on may 5th he wrote up a work order I was leaving my car there for transmission work to get a rebuilt transmission low mileage so I was told, that day I signed the paperwork and he kept my car after telling me my car would be done in a week it was there for about a month, when I finally called him about my car he said it was ready for pickup mr. [redacted] went on a test run with my husband and I we all agreed the car wasn't running right so we left the car there for further fixtures the transmission was not good and wanted a new one from the person he originally got it from, by this day we pay the car off in full and still wasn't able to take it home, so I finally spoke to him and he said the transmission was no good and that we needed another one and that he was working on getting it and getting it fixed& for the inconvenience of me waiting he said he did a few free fixtures on my vehicle complimentary due to a longer delay for the fourth of July weekend. after finally picking up the car about a month later the car Sat my driveway and we could not start it and I called and told him that he said it had nothing to do with the work he had done and I told him I did not feel like the car was complete, in the beginning he said if there is anything wrong with it to bring it there leave it and he would check it when I reached out to him he started saying I have to make an appointment has been called him trying to make an appointment but he never had anything available and when it was convenient I didn't have a way to take my vehicle there because of a family emergency. so after the new transmission I wanted the new work that was done not the old work that was donea current up-to-datewarranty from the day I picked my car up, disagrees that's why I'm submitting my complaint he disagreed he would not pick up or return phone calls and hanging up the phone on us so my car never got fixed and I paid for something I never got to use.Desired Settlement: I want my car fixed for the free repairs he claimed he was going to do also the leakage from transmission wasn't done and I want a new warranty from this new work that was done.
