To whom it may concern,
Following is our response to the complaint of 8/3/At
the end of what appeared to be a long sales
process on 7/20/the customer’s
son (not the customer/complainant) requested the customer’s (his mother)
deposit be returned. Their LTS
representative contacted the customer to rectify the situation which
precipitated the request. She agreed to
work towards a solution; unfortunately the solution, to finance the home as she
had contracted to do, was not acceptable for some reasonOn 7/24/the
customer sent an email requesting the return of her deposit. The manager responsible for processing the
refund was on vacation until 8/4/15.
Upon her return the manager processed the refund and the check in the
amount of $10,It was released from escrow 8/6/and we await the customer’s
instructions for .
The problem that arose over the course of the long relationship
with the customer was twofoldFirst the buyer tried to finance an
inappropriate amountSecond, the customer’s son and the lender changed the
structure of the agreement by changing the loan from an FHA to a Conventional loan
This choice did two thingsFirst: They changed the agreement without advising LTS
and second: they made a choice that cost them more out of pocket expenses thus
ruining the deal
In conclusion, the above is a simplified and accurate
account of the eventsThe simple story is a deal did not go well and the
customer got their money backHowever, below we took the time to explain the situation
because this company invested great amounts of time and effort over the past
two and a half years working in a forthright and diligent manner to make this
customer’s dream into realityThe result: the customer writing a letter to the
Revdex.com misrepresenting the facts is unfathomable
At LTS we work under the premise that the customer is always
right, except, when allegations are madePlease see the timeline below
for a true representation of the customer’s allegation that LTS was responsible
for holding her money for an inappropriate period of time or for trying to sell
her something she did not want
The customer and her son contacted LTS for the 1st
time on 3/13/Over the next months multiple emails and calls were
exchanged between the parties
The customer visited LTS Homes on 11/21/and selected a
land/home package that suited her needsAt that time she was warned by her sales
representative that too many items were being added, and that there could be a
potential financing issue
On 11/23/standard agreements were emailed to her son for
execution
Her son requested lengthy revisions to the Agreement which
were finalized on 1/2/
During the process the customer made incremental deposits, four
deposits for $and one for $thus the total required deposit of
$10,000. The final deposit was made on
4/30/Less than months ago
Per the Agreement, the Buyer has days to provide LTS with
a Mortgage Commitment & appraisal in order to schedule the Pre-Construction
Conference which is the prerequisite to commence the construction process
The son started working with *** Lending to secure a
Mortgage Commitment shortly after going under agreementOn one occasion LTS
sent an email urging him to cooperate, in addition to a friendly reminder that
“time was of the essence.” The Mortgage
Commitment was eventually fully executed on 5/15/Two and a half months
late
LTS policy is that as soon as the commitment is secured the
customer is scheduled for the Pre-Construction Conference mentioned above. After the customer missed several
appointments, the Pre-Construction Conference was done on 6/25/
At this point we are months into a process that normally
takes 45-days. Please note that this
delay was not caused by LTSWe can be flexible with timing but she is the one
complaining about how long this has gone on
She complains that we offered her other homesAs we went
through the above process we observed that it was being drawn out excessively
and it seemed that she might appreciate a quicker solution; a ready delivery
homeWe offered that solution and she appears to have taken offense.
