Luant Tree Service removed 4 mature trees and 2 mature azaleas that were not marked or authorized for removal from our yard.We hired Luant Tree Service to remove approximately 15 trees from our yard. 9 mature trees and 2 mature azaleas were not to be touched and were not authorized to be removed. The estimator initially came to our house in January 2015 to look at the work and give an estimate. She returned on Friday, March 6, 2015 to verify the trees to be removed and mark them appropriately. She marked all trees to be taken out by spray painting with orange paint in the center of the tree trunk about 2 feet up from the ground. She also marked these trees at the base with the paint. I had a maple tree that was to be pruned. She marked this tree only at the base. I asked her about this marking and was told that marking only at the base indicates pruning only, center markings are for removing the entire tree. I asked several times to verify that the crew understood this marking system and was assured that they did. 8 trees and 2 azaleas were not marked at all because I did not want any work to be done on them. We also discussed extensively how the tree removal equipment may damage our yard as it was quite muddy at the time and heavy machinery would easily damage it. Several options for protecting our yard were discussed and agreed upon. The crew, including the owner of the company,[redacted], arrived at 8:45am Monday, March 9, 2015 to do the work. I briefly met with them to review the work to be done, but did not extensively go over each tree to be removed as I had done that already with the estimator. I left to take my son to school and returned 1/2 hour later. I checked on the work and to see if the crew had any questions. I had another appointment and had to leave briefly but returned again within an hour. Upon returning, I was very upset to see that the crew had almost completely clear cut my backyard. 4 of the mature trees (2 maples, a holly, and an elm) that were not marked for removal were removed as well as 2 mature azaleas that were not marked for removal. These trees were over 20 feet tall, the maples were 18 inches in diameter 2 feet up from the ground. 2 of these trees also provided some of the only shade for our deck. Several of the trees also provided a much needed privacy barrier. Mature trees such as these cannot be replaced and the home is devalued by several thousand dollars by the loss of these trees. The cost to replace them would cost a minimum of $800 per tree, and these replacement trees would not be as large as those that were not authorized to be removed. Though not as high, there is also a cost to replace the azaleas, especially as they are difficult to grow in our soil conditions. Finally, the precautions we had discussed to protect our yard from the heavy machinery were not taken. There are very deep ruts throughout the yard from the use of their tracked equipment. The ruts are such that it is necessary to hire a landscaping company to grade the yard to repair it. Upon seeing this damage to my yard, I spoke with a girl in Luant's office, the owner ([redacted] who was on the job), and the estimator. I spoke with each several times for a solution to this problem. I was only offer $200 off the cost of the job and any additional trimming that I wanted. As they did not do the job properly or to my specifications, I did not wish to have them continue to do more work and possibly damage my yard more. The $200 discount would not even cover the cost of replacing 1 tree. This was not satisfactory and I asked the company to leave and did not offer them payment. Luant did call me later in the day to offer to come back and finish the job at no cost, but again, I did not want to have them on my property any more as they had already damaged it enough and I was afraid they would do even more damage. It was necessary to hire another company, [redacted], to come the next day (March 10) to clean up and finish the job properly.Desired SettlementI am seeking payment from Luant Tree Service to replace the trees and azaleas lost and to cover the cost of hiring[redacted] to repair the damage caused by Luant. The cost to replace the trees is $800 per tree and $80 per azalea. The total cost to replace the lost trees and shrubs is $3360 (4 trees + 2 azaleas). The cost to have[redacted] come and repair/cleanup the damage caused by Luant was $2400. The total cost is $5760. This amount does not include the cost to have a landscaping company grade the ground to repair the damage from the heavy machinery, which will cost an additional $700. I am seeking $6000 from Luant to pay for the trees and shrubs that they were not authorized to remove and to cover the cost to repair their damage to my yard.
