I am rejecting this response because:First of all, I am receiving responses from a unknown person I have no idea who is sending me these responses from the Weedman Lawn Care Company Very strange that I see no name at the bottom of the letterThis is so unprofessional! I do not know the name and position of the person that has wrongfully accused me of ruining my own lawnThat is completely false! Who ever this person is, does not even know that weed killers can kill grass within hours!! I see I am not communicating with someone that knows much I wish to deal only with the manager or owner of the business He or she needs to know what the employee did to my lawn I have plenty more pictures to show you how well I take care of my lawn, the front yard and backyard This crap about me not having time to water my lawn is not true You do not have any of the facts correct I never said my sprinklers do not work Why do you say these things? You people have not listened to me I have many, many people who will testify how many, many hours I spend working on my yard every single week! I have always taken much pride in my yard You are so very wrong and have been so very insulting I have experience growing plants Would you like me to get my old horticulturist friend to come and talk to you? Would you like me to get the employees at OSH to verify all the business I do in regards to my yard? I used to work for a chemical company that researched and developed plant growth regulators, herbicides, fertilizers, insecticides I was a pest control exterminator for years I grew up in the agriculture worldYes, you might very well be using some of the chemicals I helped researched and developedSo, please, do not tell me things that are not true I know your guy applied something way too strong which killed most of my lawn So stop telling me I did it! I did not put anything on my lawn for months prior to your guy and I told him it had been some time I told him you have to be careful as the heat and direct sunlight can burn the lawn Your guy, (technician) told me I was watering too much, not too little as your last response stated You people can't even get your stories straight! Your statements keep changing with the Wind! I have all this written down Your guy was kind enough to write down just what I am telling you when he was here He also gave me the watering requirements and recommendationsI have all the evidence! It is in his hand written documents for me So quit with the made up stories please! You are messing with the wrong person hereI see whoever this is does not know many things about plants and is only guessing I know how to take care of my yard and lawn! I have people right now ready to testify what I do and have seen me day in and day out over the years taking care of my yard and lawn They have seen how diligent and picky I am about my landscapeThis I can prove very easily My neighbors have complimented me for years on how nice my yard is I have many witnesses who see what I do all the time Obviously, whoever is reading my complaint, has no concept of what the fees are that a licensed landscaper charges to apply new sod I am sure it will be well over a thousand dollars, not $475, probably several thousand dollars to fix it Well, perhaps I will investigate your company much more Do you have a license to do this kind of business? You people certainly do not know how to do the business you claim to be in Your company also lacks the necessary skills to maintain a working relationship with a customer You cannot possible be doing much of a business when you do damage to your customer's yard and then treat your customer so badly How do you do business without a signed contract? There was no written permission for you to come onto my property after the first visit Your manager or supervisor was supposed to contact me and like any good business person, would have anyway Any good businessman would have met with me and together assess the damages to find out what went wrong That did not happen if I were a manager of a business, I would question and monitor my employee to see what they were doing and how this happened Obviously, your technician is not telling you the truth about what he did Also, I do not appreciate you stating I said things I never say I do not appreciate you making up things to cover up your technician's almost complete disaster to my backyard I will be contacting several landscapers, an expert lawn person, the California Dept of Consumer Affairs, any Landscaping Associations or agencies, and lastly, if you do not take complete responsibility, I will take legal action to the fullest extent possible You picked the wrong woman to treat like this! You will be getting some estimates and I will get expert advice and continue to pursue this A helpful suggestion to help your business in the future; don't treat your customers so badly!

When the customer’s lawn was treated this past July 25th,
there were no chemicals used on it that would have resulted in killing the entire
lawn or even large spots or areas. Further, the technician only sprayed weeds along
the edges of the lawn because there weren’t any weeds in the central lawn...

area.
Consequently, he did not even spray the entire lawn or spray in areas that she
claims were damaged. This fact alone makes it evident that we could not have
damaged the lawn.  Spray damage has a
very distinctive look and is often evident in distinct, visible spray patterns.
This was not seen upon inspection of her lawn when we visited again on August
15th and again on August 18th. During the application, we also
applied a poly coated slow release fertilizer which breaks down very slowly over many weeks. Because of its poly
coating, it does not burn lawns so we are confident that neither the
spray nor the fertilizer caused the alleged damage. Even so, after the
accusation, we even took it a step further and checked other lawns treated by
the same technician on the same day using the same chemicals and fertilizer and
none of them showed any damage whatsoever. Further, the before and after pictures
the customer sent us show that even plants in the flowerbeds were looking heat
stressed as though these also were also not being watered enough. Please note,
we did not treat her flowerbeds. This leads us to believe that one of
the contributing factors was not enough consistent watering happening on her
property during the hottest time of year. As a matter of fact, the technician
said the lawn was already looking a little stressed and off in color before he even treated it. Still further,
the customer had told him she had been putting other products on the lawn
prior to our treatment. The customer also stated “My lawn dies every year and I don’t know what to do.” This was
stated to the technician more than once and again proves that heat, lack of
water, and possible misuse of the customer’s own products contributed to the
damage. During a conversation with the technician, the customer also stated
that she was hand watering only when she
could because her irrigation system was not working well. A faulty
irrigation system, even if the customer is hand watering, is enough to severely
stress a lawn in summer heat and cause dry /burned spots to form rapidly. Lawns
need deep, even, consistent watering that cannot be achieved by intermittently
hand watering.  In this regard, she also
had stated that she was very busy and was not able to water the lawn as often
as necessary.  Even during the initial
sales call with our sales representative prior to starting service, she stated
she had been applying her own fertilizer and chemicals and also stated that
yellow spots and burned areas were starting to show. So, we are convinced that the
lawn may very well have started to digress from lack of water and the unknown fertilizers
and chemicals she applied before we
even started service and progressively got worse shortly afterward. When she was not accepting of the technician’s
diagnosis of the lawn, he offered to have a supervisor check the lawn. Contrary
to her statement that a supervisor never came out to inspect the lawn, a
supervisor did in fact assess the lawn on August 18th. She was not
home but the supervisor’s assessment of the lawn matched the technician’s
assessment and we were even further convinced it was not an issue related to
our treatment but more likely damaged due to lack of water and/or the
customer’s poor application of her own fertilizer and chemicals. Even so, in
order to satisfy the customer and maintain our good reputation, we offered to
reseed the lawn at our expense in the fall because neither
seeding nor sodding in summer is recommended due to the high probability of failure
due to disease and heat damage, especially if the irrigation system is not
working properly as she previously stated. Consequently, a free lawn seeding was offered and scheduled for Friday October 13,
2017. She was called by our staff on Friday October 6th and advised
the seeding would be scheduled for the following Friday. Our office received a
call on October 10, 2017 from the customer stating she wanted to hold off on our
offer of reseeding so that she could check other possibilities with other companies.
She also stated was not happy about us offering to reseed the lawn rather than
replace the lawn because she stated it would take “years to recover”. We
disagreed knowing from experience that newly planted seed in fall would sprout
in a few weeks with proper watering and the lawn would be fully restored. However,
she still declined and stated she did not have the time to hand water the
recommended minutes for the Lawn seeding to be successful and once again admitted that some of her sprinklers did
not work. Again, we concluded this was what helped contribute to her
lawn digressing during the heat of the summer and not our one-time weed spray.
Yes, as she stated, it is true we did say her lawn may look worse before it
looks better. It is something we routinely say to our customers because sometimes
when the weeds start to die after our initial spray, it may cause some
unsightliness and we don’t want new customers to be surprised by this. But
again, we only sprayed the visible weeds along the edges, not her entire lawn. Only
the weeds would have died, not the good grass. Her argument that the entire lawn
immediately looked immediately worse after our initial treatment is not
accurate as our products are not capable of killing a lawn overnight. If it
appeared to happen “over night” as the customer is suggesting, it was much more
likely a combination of extreme heat, poor watering practices, and whatever she
applied to the lawn prior to our first visit which caused a rapid decline. In addition to accusing us of damaging her lawn, she called
and complained about having received our bill along with late payment charges due to late payment for the service. She
stated she had no intention of paying it. Consequently, as a gesture of
goodwill, but not an admission of guilt,
we then credited her for the entire service charge, including the late charge, even
though we were absolutely convinced none of the damage was as a result of our
treatment.As one of the largest and most successful lawn care
companies in the Valley, we can easily afford to replace a small lawn and would
gladly have done so provided we thought there was even a chance we damaged it. However,
even after concluding we did nothing to cause the damage, and even after her admissions
of poor watering practices and use of products, we still graciously offered to
reseed her lawn in the fall. In conclusion, a review of the facts, as we see them, are
as follows:  1) In our initial sales contact
with the customer, she shared with our sales person that she had been applying her
own products prior to our service and there were already some existing yellow
spots and burned areas, 2) We only sprayed weeds along the edges of the lawn –
not the entire lawn that she claims was damaged, 3) Fertilizer was also applied
to the lawn, however, it was slow release and poly coated and therefore not
capable of burning. 4) No other lawns were damaged that day by the same
technician using the same products and the same technique, 5) She admitted her
sprinkler system was faulty and that she was hand watering only when she had
time (evident by pictures that included stressed flowerbeds). 5) She stated
that this happens every year, but we
have only treated her lawn once. 6) All
this took place during the hottest time of year when proper watering is
critical and improper applications of unknown products by the owner could accelerate
damage, and 7) We have one technician, one supervisor, two secretaries, and a
sales person that can corroborate the above facts. In conclusion, we are convinced we did absolutely
nothing that would have damaged her lawn and therefore our company has chosen not
to be held responsible for replacing her lawn by either reseeding or sodding
now or in the future.  Our decision is not
only based on principle but also the fact that since her sprinkler system is only
partially working and she is relying on intermittent hand watering, a reseeding
or sodding of her lawn, even at this point in time, would no doubt end in
failure and further complicate the issue.We regret that this unfortunate incident has become
such a contested issue. It is never our intent to make a customer unhappy. We
feel we went above and beyond to help her with her lawn even though we are
convinced we were not responsible for the damage. Not only did we credit her
account for the service and cancel her late payment charge, but we offered to
reseed the lawn even though we are convinced it was damaged from a combination
of a faulty sprinkler system, intermittent hand watering, and the customer’s
applying her own products prior to our first visit. As stated earlier, she
declined our offer to at least reseed her lawn and consequently we have since
closed her account and consider the matter concluded.

Since the
customer continues to insist on accusing us of killing her lawn, we feel it is
pointless to continue this debate. We obviously see the facts very differently.
As stated previously, we also have written documentation and our own staff that
tell a very different story. Again, if we believed for a minute we killed her
lawn, we would have replaced it. It is not about the money. We can certainly afford
to replace the lawn. In hind sight, that would have been the easier thing to do,
however, we have chosen not to because we did nothing that would harm the lawn.
We always have and always will go above and beyond to make things right with a
customer if we are ever at fault, but neither do we wish to be taken advantage
of for something that we did not do. Be that as it may, in order to finally put
this issue to rest and avoid all the back and forth debate, we will once again offer
to repair the lawn. However, we want to make it clear this is not as an
admission of guilt. We have nothing to feel guilty about as we firmly believe
we did nothing to harm her lawn that would kill it overnight as she has stated.
Even Roundup will not kill a lawn overnight! In order to
conclude this issue once and for all, here is our final offer: It would cost us
$475 for us to replace the lawn. Once she has chosen a contractor and sends us a
copy of the invoice, we will send the customer a check up to the amount of $475
and no more. She can choose whomever she likes to do the work as she previously
requested. And, from this point on, we will no longer be held responsible for
said damage and will no longer have any business dealings with this customer
now or in the future.
