generally how are office handles terminating attorney-client relationships1) First we would consult with the Rules of Professional Conduct to determine whether we had the right to withdraw from the attorney-client relationshipFor example, Rule 3-700(b) of the Rules of Professional Conduct allow a permissive withdrawal of representation of a client when: [the client] (a) insists upon presenting a claim or defense that is not warranted under existing law and cannot be supported by good faith argument for an extension, modification, or reversal of existing law, or(b) seeks to pursue an illegal course of conduct, or(c) insists that the member pursue a course of conduct that is illegal or that is prohibited under these rules or the State Bar Act, or(d) by other conduct renders it unreasonably difficult for the member to carry out the employment effectively, or(e) insists, in a matter not pending before a tribunal, that the member engage in conduct that is contrary to the judgment and advice of the member but not prohibited under these rules or the State Bar Act, or(f) breaches an agreement or obligation to the member as to expenses or fees.After determining based on the Rules of Professional Conduct that our withdrawal is permissible, we would next send a bill accounting for the services that we provided to our client, return any unused portion of their retainer, explain why we were terminating the attorney-client relationship, return the client's entire file to them, and refer them to the State Bar of California for any issues or the Sacramento County Bar for fee arbitration.If our office did not have a written contract with a client it would be because the circumstances fell into an exception of Business and Professions Code 6148(d ) such as:(1) Services rendered in an emergency to avoid foreseeable prejudice to the rights or interests of the rights of the client or where a writing is otherwise impractical.(2) An arrangement to the fee implied by the fact attorney's services are of the same general kind as previously rendered to and paid for by the client.
