[redacted] noted in his report that Luebbe provided photographs of the construction of the foundation including footing drainage, weephole system, exterior backfill gravel and waterproofing application [redacted] noted in the [redacted] Report at Comment Nothat the interior moisture "starts at the grade line usually indicates water entering the foundation above the top of the waterproofing applicationOnce the water enters the block cavity it cascades down the interior cores of the block As the moisture moves downward it transfers across the web and mortar joint of the block to the interior of the basement." [redacted] noted in the [redacted] Report at Comments Nothat, "the exterior grading along the front, right side, and back of the home do not meet or at least is at a minimum slope for proper drainageThe use of the ridged foam protection board may gap at the top creating a damming affect which may force moisture through the waterproofing membrane." [redacted] applied the foam as part of the waterproofing related to the foundation installation The [redacted] Report states that the photos provided by Luebbe prove that the construction of the foundation was performed with standard construction practices and no footing drainage issues were noted Finally, the [redacted] Report recommended excavating the walls in question to a depth of foot below the top of the rigid protection board, to secure the top of the board to the foundation and seal the same, raise the waterproofing elevation to allow for proper grade, establish a new grade, and prepare and seal the interior basement walls with a commercial grade epoxy It is my understanding that the Owner disagreed with [redacted] and ***'s conclusions and then hired [redacted] , a professional engineer [redacted] inspected the basement and agreed with Luebbe to drill holes in the lowest blocks near the floor of the basement to determine if water is being retained in the block wall (and therefore not "weeping" correctly)(See February 24th email), On March 4, 2014, [redacted] , the company that installed the waterproofing on the block foundation, drilled holes in the blocks and there was no evidence of water in the block(See March 4th email) The Owner continued to disagree with the determinations of [redacted] and the proposed repairs and did not permit Luebbe to make the repairs suggested by *** In May (months after Luebbe performed the above), the Owner contacted Luebbe stating that the basement continues to leak and states that the leak is caused by the failure of the perimeter drainage systemLuebbe then instructed [redacted] to make the repair recommended by [redacted] and the Owner refused to schedule the repair with [redacted] Now, approximately months from May 2014, after Luebbe agreed to perform the [redacted] repairs, the Owner is falsely claiming that Luebbe will not "fix the problem", which is not accurate Luebbe offered to perform the repairs suggested by ***, however, the Owner disagrees with the [redacted] repairs Luebbe was ready, willing and able to perform the repairs suggested by ***, provided that the Owner will permit Luebbe (via [redacted] ) to make such repairsAs you can read from the aforementioned, Luebbe has adequately responded to the notices from the Owner, hired an independent expert to examine the basement moisture, and agreed to perform the repairs suggested by ***The Owner, twice, denied Luebbe the right to fix the alleged moisture problem in the basementIf the Owner desires to have the work performed as suggested by ***, the Owner needs to permit Luebbe to perform the sameHowever, the Owner needs to re-grade the land so it slopes away from the home properly, as the fine and landscape grading is an obligation of the OwnerFinally, for performing the above, Luebbe requests a release related to water infiltration in the basement Luebbe will fully cooperate with your office relative to this matterUpon your review of the attached, if you have any questions, please contact my office Very truly yours, [redacted] ***

In regards to my complaint against my home builder Luebbe Fine HomesMrLuebbe has made attempts to repair our issue but water is still coming thru our basement walls in multiple areasHis attempted repairs and re-grading to resolve this issue have not been successfulThe waterproofing he used was *** *** *** and the warranty he provided me with states “Basement or foundation block walls coated with *** shall be free of water leakage or seepage into the residence through the coated areas for a period of thirty (30) years

advised that Luebbe denies any liability related to the Owner's complaint relative to the alleged
leaks in the Owner's basement. Set forth below is a summary of the facts relative to this matter.
The Owner and Luebbe entered into a contract dated May 30, 2012 ("Contract"), whereby
Luebbe agreed to perform certain work related to the construction of the Owner's home on the
property commonly known as [redacted] ("Property"). Prior to
entering into the Contract, the Owner requested that the foundation of the home be constructed
with block walls. Luebbe informed the Owner that he recommended poured walls instead of block
walls. However, the Owner refused Luebbe's recommendation and insisted that Luebbe construct
the home with block walls. The plans and specifications required construction of the foundation
with block walls in accordance with the Owner's direction. The Owner provided the plans to
Luebbe.
During construction of the block walls, Luebbe followed the plans and specifications related
to the same by installing the perimeter drain and "weep system" of the foundation. As you will
note, two (2) courses of the block foundation are above the grade of the foundation (this is
customary).
Per the Contract, the Owner was responsible for completing the fine (tractor) grade of the
land at the Property. Here, the grade does not "slope away" from the home. As a result, water can
pool or run towards the house permitting moisture to retain in the foundation.
During completion of construction, the Owner noticed moisture seeping through the block
wall foundation in the basement and notified Luebbe. Luebbe timely responded to the Owner's
complaint. The Owner hired two (2) basement inspectors, one of which recommended hiring a
third-party basement company. The Owner and Luebbe agreed that [redacted] ("[redacted]")
would inspect the basement and make recommendations relative to repairing the same.
On January 21, 2014, [redacted] inspected the basement. Attached hereto is the report
generated by [redacted] ("[redacted] Report"). As you will read, [redacted] noted that "much of the grading along
the front, right side and back of the home seemed inadequate. Soil was found above the bottom
basement window on the right side of the foundation window. Top waterproofing was not
observable." [redacted] noted in his report that Luebbe provided photographs of the construction of the
foundation including footing drainage, weephole system, exterior backfill gravel and waterproofing

It is my understanding that the Owner disagreed with [redacted] and [redacted]'s conclusions and

Now, approximately 3 months from May 2014, after Luebbe agreed to perform the [redacted]
repairs, the Owner is falsely claiming that Luebbe will not "fix the problem", which is not accurate.
Luebbe offered to perform the repairs suggested by [redacted], however, the Owner disagrees with the
[redacted] repairs.
Luebbe was ready, willing and able to perform the repairs suggested by [redacted], provided that
the Owner will permit Luebbe (via [redacted]) to make such repairs. As you can read from the
aforementioned, Luebbe has adequately responded to the notices from the Owner, hired an
independent expert to examine the basement moisture, and agreed to perform the repairs
suggested by [redacted]. The Owner, twice, denied Luebbe the right to fix the alleged moisture problem
in the basement. If the Owner desires to have the work performed as suggested by [redacted], the
Owner needs to permit Luebbe to perform the same. However, the Owner needs to re-grade the

We moved in our new home at [redacted] on March 8, 2013 we first notified the builder Mr. Luebbe of our leaking basement walls via email on June 30, 2013 and again in writing per our BIA contract on December 2, 2013. Per our contract and warranty from Luebbe Fine Homes and the Building Industry Association of Central Ohio “Leaks in foundation walls resulting in the actual trickling and or pooling of water WILL be repaired by the Builder”. Mr. Luebbe of Luebbe Fine Homes never offered or agreed to perform the repairs suggested by Ruble Waterproofing Services as so stated in response to complaint No. ########### The recommended repairs called out in [redacted] inspection report dated 01-24-2014 state to;
1. FIRST excavate the exterior walls to a depth of approximately 1 foot below the top of the rigid protection board. Secure the top for the board to the foundation and seal. Raise the waterproofing elevation to allow for proper grade. Establish new grading. Install window well with drainage as needed.
2. SECOND prep and seal the interior walls with a commercial grade epoxy water proofer.
Mr. Luebbe decided to completely ignore the first paragraph in [redacted] suggested repairs and skip to the second only offering to seal the interiors walls. This is where I the home owner disagreed and requested Mr. Luebbe to follow [redacted] inspection report “in order” on 2 different letters and emails. As listed in [redacted] report the exterior repairs need to be completed first. Mr. Luebbe refused to provide said repairs.
Per our contract addendum dated July 11, 2012 “Final grading is included in contract” and was completed by the builder Luebbe Fine Homes. As stated in our BIA home owner’s manual page 28 “The builder is responsible for initially establishing the proper grades and drainage swales to insure proper drainage away from the house, and in providing a positive grade/slope away from the foundation.” Mr. Luebbe NEVER established a proper positive grade/slope from our foundation, minimum being 6 inches of drop in the first 10 feet from the foundation. Per our contract as the home owner I was responsible for providing “Tractor, Seed and Straw” this being simply removing rocks and smoothing the final grade already provided by the builder. Nowhere in our contract was it stated that I was to perform any grading. Secondly Mr. Luebbe held the exterior foundation waterproofing membrane down two courses of block, approximately 16 inches from the top of the foundation allowing areas for water to enter into the foundation. Both of these issues were called out in [redacted] inspection report and were recommended to be repaired in Ruble first paragraph that Mr. Luebbe refused to provide.
