Luke's Automotive [redacted] Reference: Complaint ID # [redacted] ***Better Busines Bureau- [redacted] ,In response to the complaint, I have copied documents explained to and signed bye, Mr [redacted] Whenever we sell a vehicle "as-is", we take every opportunity to encourage the customer to take the vehicle to a third party for evaluation.In this particular case I suggested that Mr [redacted] take vehicle to a Monroe store located less than a mile awayHe crawled underneath the vehicle and stated it was "cleaner" than another vehicle he just looked at and ”his uncle was a mechanic", dismissing my suggestion.It is difficult to find a thousand dollar car.I could not have been more clear as to the definition of buying "as-is", and joked, "that if the vehicle left the lot and broke in half, he owned both halves"When you see the enclosed documents, It should be clear that we dotted out I's and crossed our T’s, so that there could be no misunderstanding or misrepresentation of how the vehicle was being soldIn years of business we pride ourselves in the treatment of our customersThis young man being a veteran means a great deal to us.We could only hope this would be a good carWe added a half court of oil and ‘"topped" off brake and power steering fluidThe coolant overflow jug was slightly low so the customer and I, together, added waterIt is important for me to mention, the oil appeared clean.While it is unfortunate the customer did not make it home before having to pull over due to a temperature light coming onThe customer called and was instructed not to drive the car if it was overheating or losing anti-freeze-waterAnd to check fluidsThe fluids where fine; however, customer could not tell if it was over heating, but confirmed there was no fluid loss, hissing noise,etcHe was going to arrange the vehicle to be towed the remaining distance home.As I always extend my personnal cell phone, the customer called to tell me he was at an Autozone auto store and upon checking the oil, it was now "milky" and the oil was mixing with antifreezeIt can only be assumed the vehicle was driven as it was overheating.I was told his uncle was going to look over the vehicle and advise what would fix the problemWe discussed if the vehicle needed a new engine that I would help get the best possible price and told him we where happy to help remedy theissue at hand.I heard nothing from the customer until I got the notice from Revdex.com.We sold the vehicle for $dollars to accomodate the total of $the customer had to spend, Which included tax, title, license plate and document feesI had hoped this would be a dependable car for this young manAnd when told of his not making it home I explained we couldnt just take the car back in its broken state, but we could credit him towards another vehicle or assist him with discounted pricing on necessary partsThe discussion never went any farther, Mr [redacted] just contacted you the Revdex.com.After looking at the documents, I am confident you will find we did nothing wrongIt is unfortunate and just a risk when buying a $vehicleWe are happy to work with him and are disappointed he chose this course, instead of communicating with us?We look forward to your input and thank you for your time.Sincerely,Scott MB***Luke's Automotive

LUKES AUTOMOTIVE [redacted] July 10, ID#: [redacted] ,In reference to the complaint made with your office we are responding with details regarding situation.The customer purchased a Chevy Silverado with 227,miles on 7/2/At the time of purchase we suggested as we do with all of our potential customers to take it to their mechanic and have it looked over before purchaseThis customer chose not to because he said he was mechanically inclined and services all of his own vehicles.While it is unfortunate that the transmission “went out” on this customer we did everything in our power to resolve the situationThe customer even stated to us that nobody could predict this problem in advanceThe vehicle was purchased with a limited day/mile warranty which covered engine and transmission internally lubricated parts with a $deductible.The vehicle transmission went on a Friday and was not diagnosed by the transmission shop until Monday and the vehicle was returned to the customer by Thursday July 9th.The customer was given optionsOrder a used transmission which would take 7-days until we could get it and then have it put inAlso the Sales Manager offered the customer the use of his own personal vehicle until his was finishedOrder a rebuilt transmission that would take a total of days to complete and it came with a month warranty.The customer chose option as he could not be without a vehicle for 7-daysThe customer knew this would be at his own expense.The customer was completely satisfied at time of pick up we shook hands and he thanked us for handling this for him.As we strive for the satisfaction of all our customers it is difficult to please them all.Lukes Automotive

I bought a Chevy Silverado from Lukes Auto SalesAfter having the truck for hours the transmission went outThey would not honor the warranty of the contract of the repairs of the motor and transmission.They are making me pay for the tow and the rebuilt tansmission and the transmission fluidI have the original contract that warranties this and they wanted me to surrender it but I still have itThey also made me sign a new contract in order for me to get my truck back, I was tricked into signing this new cotractI need help with this problem as soon as posssible, because they are trying to repo my truckI am not behind in any of my payments.I already filed a complaint with you in *** *** ** *** *** *** and hoping to hear a reply soon before they try to take my truck from me.I would like to go back to my original contract of $7,that I was supposed to payInstead of being tricked into paying $8,900, because of the repairs that were supposed to be covered by my original contract for days

Reference ID: *** *** ** ***Dear *** ***,I am writing in response to your request of additional concerns and questions in this matter.As stated in the complaint *** *** purchased a Chevrolet Kon 7/3/Unfortunately *** ***'s vehicle transmission failed the day after purchaseAt 4:in the afternoon of 7/4/(Holiday weekend) Scott (manager of Lukes) received a call on his cell phone stating that the truck would not move forwardImmediately we acknowledged that the engine and transmission were under warranty as stated in the Buyers Guide signed by the customer at purchase*** *** was provided the towing company's contact information and made arrangements to have the truck towed to a transmission repair shop for diagnosis and to learn what options might exist for repairOn Monday 7/6/the transmission shop indicated that the transmission needed either rebuilt ($2300) or replaced with a used unit ($700)It was explained we found several transmissions at various salvage yards with miles ranging from 196k miles to 250k miles and that it would take 7-days to get transmision to our facility and another days to install transmissionIt was explained that the tow and fluids would be *** ***'s responsiblityThe customer was agreeable and indicated that he understood the situation*** *** expressed he could not be without his truck for that length of time it would take to have a used transmission installed.He asked for a loaner truck to move furniture; however, our insurance has no provision for such a requestAgain, the warranty covered the used part and the installation to make the vehicle run and perform as it did at the time of purchase, the warranty does not have any provision for loaner vehicles*** *** was very upset that Lukes did not offer to give him a loaner truck because he makes "couple hundred a week cash moving and hauling scrap".In an effort to satisfy *** ***'s desire to have his truck repaired and back in his possession quickly Lukes Automotive offered the option of a rebuilt transmission where the customer would pay the difference in price between the rebuilt $used $700.00....which is $To solve his timely problem we offered, not "tricked" or "forced" a solution that would get a "rebuilt" transmission installed with a year warranty in a matter of just two daysHe was pleased with this suggestion and instructed us to move forward in this directionWithin hours his vehicle was completedWe even released vehicle to customer without tow bill and fluids necessary to be paid.I explained the new contract and had him sign that this new contract "superceeds" the previous contract and he would get the one year warranty on rebuilt transmission once he paid for tow.We shook hands and he even thanked me for offering my personal vehicle while his was being repairedHe promised that he would have the money for the tow within the week.*Explain actions we can take to resolve concernsRemind *** that together we followed this course by his direction.We were completely transparent, sharing and offering all sources and phone numbers of places where I found "used transmissions and even what they had suggestedBy warranty standards we would have simply put a "like kind and quality" transmission in his vehicle and the contract would have remained the sameHe could not wait and clearly chose to pay more money for a transmission with no milesLuke's automotive honored a warranty solution to best resolve the customers situation and requests*** *** expressed he could not be without his truck for that length of time waiting for a used transmission to be shipped to ErieLukes reiterated to the customer that the warranty covered the used part and the install, but not a rebuilt transmission at times the cost.We never asked *** *** to surrender vehicle?*** *** was understandably displeased with the transmission failuredays after the repair was completed exactly as he requested he mentioned that he was disabled and would be seeking legal help from the disability court and may in fact "end up with a free truck".We asked him to pay what he agreed he owed in reference to contracted finance paymentsAfter he suggested he was going to get a "free" truck out of this, I reiterated that he needs to make his agreed payments or his vehicle could be subject to repossession.*** *** stated he would like the contract at the original $? But he fully understood that he now has a truck with a new transmission with no miles as opposed to almost 200k mile used transmissionAgain, he was offered a vehicle.Lukes Automotive has made no effort to reposess *** ***'s truckANOTHER STATEMENTHis first payment is not due until 8/3/2015.*Acknowleddge customer concerns***,one last thing I wanted to share: Being in business over yearsWe pride ourselves on taking care of our customersI even reviewed this enclosed N.A.D.A document that I reviewed with *** *** before having him sign anythingAnd its important to me that I show you..., we just dont take advantage of people with less than perfect creditNADA value for the truck he purchased was $9950.The truck was fully serviced and very cleanDelivered by a tractor trailor from down south, Vato avoid rust concerns that we frequently see in our areaThe price we charged *** *** was $Now the vehicle has a transmission with "no"miles and will have a one year warranty, once he pays the service billI cannot stress enough, this was the decision he chose.*** *** wanted a rebuilt transmission and truck back a.s.a.p., He agreed to the terms to get what he wantedAfter he received his truck with "chosen” rebuilt transmission, he wants to change the terms, not reasonableMr Cole asked and received the path of the rebuilt transmission, fully understanding what he was signing, now must follow through on his obligation.Thank you for all your time in this matterSincerely,Luke's Automotive Scott MB***

time of purchase we suggested as we do with all of our potential customers to take it to their mechanic and have it looked over before purchase. This customer chose not to because he said he was mechanically inclined and services all of his own vehicles.While it is unfortunate that the transmission “went out” on this customer we did everything in our power to resolve the situation. The customer even stated to us that nobody could predict this problem in advance. The vehicle was purchased with a limited 30 day/1000 mile warranty which covered engine and transmission internally lubricated parts with a $100 deductible.The vehicle transmission went on a Friday and was not diagnosed by the transmission shop until Monday and the vehicle was returned to the customer by Thursday July 9th.The customer was given 2 options.1. Order a used transmission which would take 7-10 days until we could get it and then have it put in. Also the Sales Manager offered the customer the use of his own personal vehicle until his was finished.2. Order a rebuilt transmission that would take a total of 2 days to complete and it came with a 12 month warranty.The customer chose option 2 as he could not be without a vehicle for 7-10 days. The customer knew this would be at his own expense.The customer was completely satisfied at time of pick up we shook hands and he thanked us for handling this for him.As we strive for the satisfaction of all our customers it is difficult to please them all.Lukes Automotive

Review: While shopping for cars on 5/13/16 I passed a used car dealership by the name of Luke's Automotive located on [redacted]. I saw a 2002 Chevy Impala with $995 written on the window. A salesman by the name of Scott B[redacted] allowed me to take the vehicle for a test drive. While driving the vehicle a few blocks and back everything seemed to be fine with the vehicle. There was no “Buyer's Guide” located on the vehicle only the price of 995 written in blue window marker.

Mr. B[redacted] told me that it had recently been traded in by a 70 year old woman and that she it claimed worked decently and had no major issues and parts replaced. He also claimed that the dealership had not looked at the car what-so-ever because it was an "As Is" sale vehicle. There was no information he could directly give about the vehicle and no one at the shop had looked at any part of the vehicle. The vehicle inspection sticker on the windshield had expired as of 4/16. He did say the previous owners had said it would need ball joints replaced to pass inspection. Mr. Bone sold it to me including tax,tags, and title for $1,200.

He had me sign a few different forms agreeing that the vehicle was "as is" and acknowledging they were unaware of any needed repairs. I do not recall signing a "Buyer's Guide" nor did I receive copies of the papers I did sign.The only papers I received from Mr. B[redacted] were the "Used Car or Truck Sales Order (Limited Warranty)" from Luke's Automotive and my temporary registration form.He also placed the temporary registration form in the rear window.and attached the license plate [redacted] to the rear bumper.

Within 3 miles it was overheating. Mr. B[redacted] told me it was a sensor. The engine quit running 37 miles from the dealership. I had it towed and was informed that the frame was rusted beyond repair.Desired Settlement: As a veteran, I am sickened to believe that it is legal for a car dealership to operate this way. Every conversation I have had with Scott B[redacted], he insists that he was at no fault and was unaware of any issues and that he thought it would be a good car for me. He has tried getting me to buy a motor and another car but says he can not refund my money. I pray that somehow I can put a stop to their operation as I am sure many people have been cheated out of their money in similar ways. I would be extremely grateful if there is a way to recover my $1200, the $25 I put in the gas tank, the $50 I payed for towing, and any other fees I may incur for storage or moving the vehicle again.

Review: I bought a 2004 Chevrolet Silverado for 8000 purchase price, $1800 down and I financed it through Luke's. It also had a 30 day warranty on the motor and transmission. I had the car for 23 hours and the transmission quit. No forward movement. Scott at Luke's looked for a used transmission and none could be found. To rebuild the one in the truck I bought was $1500.00 and Luke's wants me to pay 1500 for the transmission. I asked for my money back and they wouldn't give it back. What is the warranty worth. I think likes should pay for the truck to work as it was supposed to at no cost to me. I bought a truck that didn't work for even 24 hours.Desired Settlement: I want the truck but I want it to function as it is supposed to at no additional cost to me or my money back.
