I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, please see my response detailed belowPer my partner [redacted] , Lupka Roofing removed most if not all the gutters from the house in the process of replacing our roofWhile removed and on the ground, some sections were spray painted to cover exposed areas of previous paint colors and to cover markings incurred from the removalLupka Roofing then remounted the gutters after the roof shingles were replacedA section of the gutter on one side of the house tore away from the roof because Lupka Roofing did not remount that run of gutter properlyThe gutter run was not sufficiently sloped from what should have been the high side on one end, towards the downspout on the otherThis caused water to stand and not empty from the gutterWith colder weather, the standing water froze, then accumulated and eventually overflowed the gutter creating large, heavy and dangerous iciclesShortly thereafter, the weight of the accumulated ice triggered the collapse of the gutter, as represented in the photos included with my complaintNone of our gutters had ever formed large, heavy icicles before Lupka Roofing’s workFurthermore, none of the other gutters experienced the problems that occurred in the specific area where the gutter collapsedAgain, the other gutters are sloped sufficiently for water to flow and empty towards the downspouts [redacted] does not share MrLupka’s recollection of a conversation regarding the replacement of gutters or straps, or the recommendation of a vendorAs there was no problem with the condition or function of our gutters before Lupka Roofing’s work, it is difficult to see how or why it was necessary to discuss the gutters beyond making sure to reinstall them as they were found [redacted] does recall MrLupka having to return several times in response to minor issues [redacted] noticed in the days following the installationUnfortunately, the issue of the gutter not being slope correctly was indiscernible to us, until it was too lateI would like to note that MrLupka's responsiveness ended abruptly, once he was paid in fullPlease advise MrLupka of this response, and that we intend to pursue the matter fully if there is no action taken on his part to remedy the situationWe hope that he will recognize the validity of our position and arrange to rectify the issue as soon as possibleThank youBest regards, [redacted]

In December, 2014, my father-in-law (then aged 89), the owner of the home at that time, contracted with Lupka to replace the existing roofIn that contract, he was to do all necessary repairs to wood and to replace the existing soffit with new VENTED soffit panels, and also to repair the chimney, from which the mortar was beginning to [redacted] out, along with new flashing panelsWhen the crew said that the job was complete, and that they were preparing to leave, I noticed that they had not installed the new vented soffit panels, per the contractAfter some lengthy discussion, I prevailed, (having shown them the contract) and they proceeded to install the new VENTED soffitsIt was not until this summer, when I had new picture windows installed, that it was pointed out to me that while the sheet metal of which the soffits were made was vented, Lupka had not bothered to make vents in the underlying plywood, thus rendering the vented soffits useless! Mr Lupka is, above all things, an agile talker, but I would not recommend his services to anyone, even for a doghouse!

I would like to respond to the customer complaint regarding customer *** ***, ID ***. I would like to start by asking that you look at the copy of our Lupka Construction contract with Miss ***As you can see in the contract, there is no mention of a broken rafter
tail, nor was there mention of any fascia or soffit repairIf these things were discussed they would be put into the contractAny and all work done would be added into the contractI have also corrected her timeline of events in the customer's statement of the problemAfter receiving the complaint, *** Lupka called Miss ***, and after that went to see her on 7/*** made arrangements to fix the two mistakes that were made on the jobThe two mistakes were: a piece of ridge vent was not cut out properly and there was a 3"x16" piece of roof board that should have been replacedOn 7/21, Lupka Construction went to Adams Ave to make the two repairsAfter about 30-minutes, *** *** came out of her home and started yelling that she wanted everyone off of her roofA Lupka Construction employee then called MrLupka to let him know what was going on and he immediately went to the job siteWhen MrLupka arrived, Miss *** started yelling that she did not want any of the employees on her roof* tried to talk to her but she would not stop yelling at himAt this point *** called 911, to have someone come to the propertyWhen the police arrived, they also tried to speak with Miss ***, she told the police that she did not want Lupka Construction on her propertyWhile the police were there, *** Lupka explained to *** *** that Lupka Construction could not fix the two problems if she would not let the employees onto her roof* *** told *** that she was not comfortable with Lupka Construction being on her roof* *** agreed that she understood that the two repairs would not be fixedAfter that date Lupka Construction did not receive any further contact from Miss ***If you have any further questions you can contact me, *** Lupka at *** ***Thank you, *** Lupka

*** called and he responded: We cannot do the repair as originally requested since she was very upset due to a piece falling down from the roof when we returned to fix the thingsWe contacted the police due to her being so upset and she stated she did not want us there to perform the workShe still owes me $850, I am writing this off at this pointShe can hire someone else to do the repairsThe ridge vent was properly cut to begin with, the inspector does not know what he is talking about, and not up to dateThe shingles are Lifetime Timberline HD shingles

[redacted] called and responded: He never met [redacted], he dealt with  Mr [redacted].  When we spoke about his roof I tried to get him to do the gutters, he really needed gutters and I referred him to someone as I do not do gutters. He refused, since he was losing his job. He needed more gutter straps...

and new gutters and we had a heavy hard winter and the gutter was not part of the job. Therefore, no gutter replacement is due, they should contact there insurance company as our contract did not include any gutters.

then remounted the gutters after the roof shingles were replaced. A
section of the gutter on one side of the house tore away from the roof because
Lupka Roofing did not remount that run of gutter properly. The gutter run was

from the gutter. With colder weather, the standing water froze, then
accumulated and eventually overflowed the gutter creating large, heavy and
dangerous icicles. Shortly thereafter, the weight of the accumulated ice triggered
the collapse of the gutter, as represented in the photos included with my complaint. None
of our gutters had ever formed large, heavy icicles before Lupka Roofing’s
work. Furthermore, none of the other gutters experienced the problems that
occurred in the specific area where the gutter collapsed. Again, the other gutters
are sloped sufficiently for water to flow and empty towards the downspouts. [redacted] does not share Mr. Lupka’s recollection of a conversation regarding the
replacement of gutters or straps, or the recommendation of a vendor. As there
was no problem with the condition or function of our gutters before Lupka
Roofing’s work, it is difficult to see how or why it was necessary to discuss

advise Mr. Lupka of this response, and that we intend to pursue the matter
fully if there is no action taken on his part to remedy the situation. We hope
that he will recognize the validity of our position and arrange to rectify the

Upon getting services from Lupka Construction I noticed that both their job and their attitude were outstanding. I believe that both owner and crew carried out their tasks in a good and timely manner.
