I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint

Regards,by first off I can not note anything the contract states other than what the salesman told me in person as I was never given a copy of the contact orhadone mailed to me second the salesman never made any comments on there being any foreseen delays even when he accepted the insurance check for payment I say if you are such a credible company he should not have accepted the check in the first place as he should have known it would cause delays I remember he called has at work and told him I would try and meet him the next day not the same day if he waited at the bank how come he left no message he never told me about mailing in the check so my question is if it was going to cause such delays why not get me the check back and make me cash it I mean no disrespect because you state that you assume I would know that you could not start a project with no funds I can also say it is a reasonable assumption that your salesman would have called more than one day instead I did not hear from him tell almost and one half weeks later and that is only because I called Sergio different times before he returned my or Sergio call when he did return my call he stated that you all could start the project that following week some ordays later I told him I no longer trusted your company and wanted nothing to do with your company he then stated that I was breaking the contact and would need to pay dollars for the cancellation I told him I would not pay any fee and I felt you had broken the contract by not completing the work on the almost and a half weeks earlier a note now you say you know who Sergio is when I mentioned him to your salesman he stated that he knew of no-one by that name as for the conversation with some lady when I talked to her I was at the hospital with my daughter she was having a baby not that that is important but I remember getting angry because she told me I would have to have the driveway cleared so they could start the project that following day I told her that I had already made it clear to her salesman that I wanted nothing to do with them she then told me was was breaking the contact and it would cost me a penalty I remember getting angry because the way she stated her position I would have to paywork or no work being done I informed her angrily and as she states abruptly that I would pay nothing and I would take it to litigation if I had to and hung up so I read in their response it is pay for work or pay for a cancellation but I chose to seek legal counsel and and see if a jury of my peers thinks I am wrong or they are wrong in trying to make me accept their terms so no I do not accept what they say a fact I see a company that wants something formin of work which is what the salesman took to misrepresent their company by not even offering a copy of their contract

Re: Contract datesYes, you are truly rightYour contract was signed on May 27,and the approximate start date was June 5,and the approximate completion date was June 6,As you can noted the contract clearly states the word “approximate” relying on no delaysAlso you can note that right above the dates it reads as follow: CCommencement and Completion of Work: Substantial commencement of work shall mean either the physical delivery of materials onto the premises or the performance of any labor and shall be subjected to any permissible delays as per provision (5) Provision reads5.DelayContractor should not be held responsible for any damage occasioned by delays resulting from: work done by Owner’s subcontractors, extra work, acts of owner or owner’s agent including failure of owner to make timely progress payments or payments for extra work, shortages of material and/or labor, bad weather, fire, strike, war, governmental regulations, or any other contingencies unforeseen by Contractor or beyond Contractor’s reasonable control2. Re: Down paymentYes the contract states that you gave a down payment, which was your insurance check who the payees were, Jesus *** and *** *** (your mortgage), NOT our company/ the contractor Lutza Consulting and Contracting FirmAt the time of signing the contract you were advised by the Project Manager that we will take the check and submitted for endorsement and that if by any chance it would have been declined we would have to give you the check back so you can personally go with your mortgage or we would have to send it in by mail which it would take a lot longer3. Re: Endorsement of Check… as per our phone records our Project Manager called you on June 6, at 9:36am letting you know that our bank did not accept your insurance check without the mortgage endorsement; ( I assumed that by then you would have understood that there was no way we could have started your roof with no down payment) on that same call you agreed to meet him that same day between 3:30-4:30pm at the *** *** location closest to your work place, our Project Manager called you minutes after you missed the appointment he continued waiting for you until your bank closed as per our phone records he called you a total of calls (3:59pm, 4:05pm, 4:13pm and 5:34pm) he did not get a response from you that afternoon nor the following days so as you were advised your insurance check was sent via mail to your mortgage for endorsement causing more delaysYour funds were released on the last days of June, and because we take every job seriously we ordered the material for your job following our agenda we also squeezed your job start date in to the earliest available date on our already booked agenda Re: Phone calls, some lady who represents the company and cancellation… this job was brought to my attention by our Project Manager Angel PeñaDue to the substantial delays and arrangements that had to be done to get this job scheduled as earliest possible I, Lynda *** owner of Lutza C &C Firm decided to take over, as per our phone records I called consecutive days leaving a message on every phone call, to inform you that your roof restoration was already scheduled and because of the delays (even though the delay was unforeseen and beyond our reasonable control) I wanted to compensate you as our client by giving you an incentive for your roof, the day you called me back you told me you wanted to cancel because of breach of contract on our end, I was only able to start my sentence about breaking a contract and from there you offensively interrupted me and did not let me speak a word then you hung up the phone call on me, I totally understand your frustration and how stressful this can be, your roof is a very important factor on your home and is extremely important to do the repairsWhat I don’t understand is why cancel the contract due to a delay that was not on our end? Why cancel a contract when there is confirmation that your roof is scheduled right the next business day wasn’t it your interest to get your roof replaced by a creditable roofing company? Have you read any complains or bad reviews on our company? I do apologize for the lack of communication that our company might of caused even though that Sergio the marketing agent was informed about all status on your job, and our contract states our direct phone numbers to our corporate office were you could have called and get status on your job you also had our Project Managers direct phone number who you could have called directly for him to clear all your questionsIt will be a pleasure if you let us continue with our job as per the contract signed on May 27, to re-roof your residenceWe warranty our job, we are insured and certified installers, doing the job right is our priorityIf you have decided to cancel our contract please submit a written cancellation letter to our corporate mailing address P.OBox Mission, TX I do advice you as per the contract you signed on May 27,with LuTza Consulting and Contracting Firm there will be a recoverable cancellation feeIf you feel you need to speak with me please feel free to contact me at 855-775-ext:Thank you
