2-8-2016She has sued me!  I offered to trade truck back for something newer to help there is like no talking to her, she put over 7000 miles on and drove it for 9 1/2 months.Thank you,Owner:I also offered to fix it for her.

response and please allow this letter to serve as that response.The vehicle which is the subject of this complaint is a 1994 [redacted] pickup truck. Please note this vehicle is approximately 22 years old. The truck was a two owner truck in very nice condition. I can personally verify the condition of the vehicle as I had used this vehicle while it sat on my lot for approximately 2 months. The vehicle was never smoked in and was very well taken care of.The buyer had come to my lot three times to see this vehicle. The third time that she had appeared she brought her boyfriend with her. He physically inspected the vehicle and actually spent about 10 minutes underneath this vehicle inspecting the undercarriage. Based upon his recommendation he advised her to purchase the vehicle. At the time this vehicle was purchased, April 17, 2015, the buyer was very happy with the vehicle.At the time of the sale I had issued a limited warranty with this vehicle. The systems that were covered on by limited warranty were internal lubricated parts only. The duration of the warranty was for 30 days or 700 miles. The terms of the warranty were that I would pay for 50% of the labor and 50% of the parts covered during the warranty period.The buyer took delivery of this vehicle in April 2015 when the vehicle had 105,133 miles. She operated this vehicle continually throughout the time she owns the vehicle and continues to operate the vehicle. She has placed close to 8000 miles on the vehicle.Around December 30 or 31st, 2015, the buyer's ex-husband appeared at my business. He told me that the frame on the vehicle was rusty. He told me that he was working on the vehicle. While working on the vehicle he took a hammer and hammered through a piece of the frame. At the time this vehicle was sold to the buyer, I was not aware of any defects in this frame. If she can't take my word for that fact, she should take the word of her boyfriend who completely examined the frame of the vehicle for more than 10 minutes in April 2015 prior to purchasing this vehicle, and failed to recognize any issue with the frame on this vehicle. I would point out that almost any vehicle that has been in service for 22 years may not be able to withstand a hammer striking the frame. I would also point out as the world turns that it is the ex-husband telling the buyer that the vehicle her boyfriend inspected and advised her to buy is a defective vehicle, and now I’m caught up in the middle.After becoming aware that there may possibly be an issue with this vehicle and in an effort to satisfy this customer I agreed to have my mechanic verify her concerns. While I feel her issue with the frame of the 22-year-old vehicle that she drove for approximately 10 months and 8000 miles cannot possibly be attributable to my dealership, I agreed to work with this customer to resolve your issues.My mechanic placed this vehicle on a lift where he could clearly see the damage to the frame caused by the ex-husband hammering on the frame with a hammer. I’ve offered to this customer to repair the damage caused by the ex-husband in terms similar to the 30 day limited warranty which I provided to her, that being that I would pay for 50% of the parts and provide the labor to repair this vehicle. The buyer appeared in my office on February 17, 2016 and we discussed either trading the vehicle in on a different vehicle or having the vehicle repaired. She agreed that I should repair the frame. I scheduled an inspection meeting with a certified welder to inspect the truck and scheduled the vehicle to be fixed on the weekend of February 27, 2016. I felt the cost of the repair should not exceed $400.00 and that her share of those costs would maybe be $100.00. She then changed her mind and at this point I don't know what to do to make this woman a satisfied customer.I can tell you that on December 30 or 31st 2015 when I was initially approached regarding this issue, I was told that this truck was parked by the owner. At that time I wrote down the mileage. I find out in February 2016, when the I inspected the vehicle, that it had an additional 1101 miles on the vehicle proving that the vehicle is in fact not parked, but that she had been using the vehicle on a daily basis. I note from her complaint filed with your office that she states I purchased the vehicle from [redacted] and was told at the time of the purchase that the frame was damaged and it was used as a plow vehicle. I have no clue where she gets this statement from [redacted] advising me at the frame was bad. That is simply an outright lie.Despite the fact that she is crusading against me and my business, having an attorney threatening to sue me, and that she has contacted the Pennsylvania State Police, the Pennsylvania Department of Transportation, the Revdex.com, and the Pennsylvania’s Attorney General's Bureau of Consumer Protection, I am still willing to work with this person. It's unfortunate that her ex-husband took a hammer to the frame of a 22-year old vehicle which she drove for almost 10 months after the day she purchased it, and now seeks to impugn the integrity of my business.My offer of repairing this vehicle and sharing the cost as I had set forth, or trading this vehicle in on a different vehicle which she would be happy with still stands. I am not willing to provide this person with a free vehicle to drive for what will be more than 10 months at my expense by refunding her all of her money.Raymond S.
