Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.First of all, I want to say that I cannot believe how much time and energy we have expended to try to get a simple 4 day kitchen project done.  We are worn out trying to work with Lyndan Designs.  Had we any idea that things would or even could turn out this way, we would have done the work ourselves.  I want to affirm to all that we did not mean to upset the [redacted] family, who owns and runs Lyndan Designs.  When we first showed them the issues with the tile job, we felt awful.  We fully expected that they would make right what was a disastrous result.  They didn't - at all.  They made many mistakes on this job  and I am sure lost money, as a result.  For them to offer no customer service and no remedy for our situation while still demanding full payment is ludicrous. As you will see in the attached pictures, which were taken with a novice's [redacted], the work is a mess.  Our issues are:1 - Many of the glass tiles were chipped, scratched, and broken during cutting and the installation.  Lyndan smeared grout in to try to hide this, but the breaks are clearly visible.2 - The wall behind the tile was not properly prepared, according to the other installers that we have had in to inspect the work.  There tiles are at all different depth levels, angles, and the surface is anything but smooth or level.  There were large dips in the underlying wall that caused this, after Lyndan removed the initial tile and installed ours over a uneven surface.3 - Many of the tiles are heavily scratched.  We were advised that this was likely the result of Lyndan breaking uo the work periods, allowing the grout to dry, and then trying to remove it with an abrasive surface.4 - There is grout all over the cabinets, on the marble window frame, and all over the tiles, themselves.  There are sections that are missing grout where Lyn[redacted] tried to use a different color sealant to fill, there are sections that are  missing grout altogether.5 - The finish work was awful - Lyndan left a metal framing piece inseveral areas that makes it look unfinished, unpolished, and incomplete. 6 - The left counter is uneven with the center piece and is about 1/3 inch out from the wall -again, this looks very unfinished and cut unevenly.Because we desperately want to finish the kitchen and this entire ordeal has held us up from putting our house on the market as we planned in March, I can think of only 2 solutions.Option 1 - To receive full payment, Lyndan completes the job properly, in a timely manner, with professionalism.*  This would entail a tear out of the existing install, replacement of the tile at their cost, as I bought the first batch, properly preparing the walls for the new tile, and professional installation and finishing of the tile work.  This work would all be done for the original price, as the work was never completed.*  We would require that this work be completed within 1 week of agreeing to these terms.  I think that we are all ready to have this behind us.*  We want to see a specific work plan, schedule, and the names of the workers who would be onsite for the job.  One of the issues that we had on the many dates that [redacted] showed up to do the work was that his wife came to the house to bring him food or talk to him and stayed to hang out.  We found this incredibly unprofessional and invasive.  We want to know exactly who would be working, on what days and times, and expect for them to show up on schedule.  [redacted] would tell us that he'd be here at 9a and then show up at 1p.  My husband and I missed work to accommodate their schedule, we'd like for that schedule to be respected.*  We would require a 2-yr warranty on all work performed, to ensure remedy, should we experience any issues upon job completion.*  We would like to see evidence of liability insurance.Option 2 - Lyndan pays all costs for another company of our selection to complete this work.  Once we agree upon an invoice amount due, we could use that to credit against the amount that they will owe us.  We have received quotes between $2000-$2800 to remove and repair Lyndan's work.  They will have to pay the balance of the amount due to make us whole.  No matter what Lyndan's decision, I ask that they make it quickly, as we have already waited since May 2014 to get this tiny job done.  It has been a huge inconvenience for all of us.  I have to honestly ask the Lyndan crew, who have all seen this work in person except for [redacted], if you are proud of this work - would you want to show these pictures to prospective clients?  Would you want this in your own kitchen.I am very sorry that we have landed at this point, but I am asking that they now to do the right thing.Thank you,[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Ok - Let's get very basic with this, as I feel as though some things aren't sinking in.  No one is getting anything for free - this is a losing proposition, all around.
Original scope:
Remove existing countertop and backsplash
Install new laminate countertop in Milano Mahogany - Edge: future, no backsplash, includes moulding to raise countertop height to accommodate the dishwasher, 8" deep stainless steel double bowl sink
Customer Cabinet to match existing cabinets, installed with hardware allowance
Tile Installation
26 pairs of hinges
Customer provided tiles - cost was $491.01
Original job: $4006.00
Tile Installation: $465.00
Hinges: $104.00 26 pairs at $4.00 each
Grand total: $4575.00
Deposit: $2000.00
Subtotal: $2575.00
The backsplash installation was unprofessionally and inadequately performed - I have not accepted this work.  The pictures speak LOUDLY for themselves as to the quality of the work, real life is even worse.
The costs to remediate the damage done to my tiles and walls underneath will cost approximately $2000 - $2800, including tile replacement.  This is based upon the nearly $2000 estimate from [redacted] that did not include the tile.  If you add nearly $2000 to nearly $500 in tile costs, it equals $2500.00.
So, if we  deduct the cost of the customer tiles that were damaged from the total amount of the work performed and leave the entire amount UNDISCOUNTED in any other way, it looks like this:
Balance due: $2575.00
Cost of tiles: $491.01 Returned to customer due to damage
Subtotal: $2083.99
What I have proposed with my two options are this - LYNDAN:
1 - Completes the job that they were hired to do, professionally and in a manner that can I can accept.  I will be happy to pay the balance of the job when it is completed to my satisfaction, per our original agreement.  Lyndan Designs has been entirely unwilling to do that, despite the fact that we are coming up on a year now of unfinished, incomplete, and faulty work.  I sent request after request and received no response.
2 - Covers the cost of another contractor to make the damage that they've done to my kitchen right - finish the job that they started completely and correctly so that I may accept the work and be done with this effort.  For this route, I ask that Lyndan cover the contractor costs.  It would look like this.
Balance due to Lyndan Designs: $2083.99
What another contractor charges to tear out and replace the faulty work done: $2000 - $2800  ([redacted] pays this contractor to do what Lyndan Designs refuses to do...)
Lyndan Designs credits [redacted] for what she spends with other contractor: Balance due to [redacted] Designs depends on the cost of the other contractor
With either option, the total cost of the job to [redacted] is:
Deposit to Lyndan Designs: $2000.00
Cost to other contractor to fulfill Lyndan Designs contract: $2000 - $2800.00
Credit/Debit TBD, based on total: $TBD  (At $2083.99, it is a wash, Under $2083.99 and [redacted] pays Lyndab Designs difference, Over $2083.99, Lyndan* pays [redacted] difference)
Total Cost of Project: $ 4083.99 + cost of tile to complete the job - THIS IS THE SAME PRICE AS THE ORIGINAL LYNDAN CONTRACT, there is nothing for free here.
To reiterate, there is no free - I am being forced to pay another contractor for what Lyndan refuses to deliver.
I just want my kitchen project to be completed.  I have repeatedly asked Lyndan to finish their work and they refuse.  I cannot pay them full price and also pay another contractor full price to have ONE finished backsplash product installed.  With this scenario, the 2nd contractor will likely charge me more as it is a smaller, unbundled piece of work vs. the larger project that Lyndan Designs was given.
Additionally, I have not been compensated for the extensive amount of time and energy that I have had to invest in trying to get Lyndan to do the right, honorable thing.  They have not stood by their work and have refused to be collaborative with me on a solution, even with Revdex.com mediation.  They want the full cost/price of the job without delivering what they promised, while I pay someone else to come in and remove their work.  That isn't a compromise - that is them being made whole and me being left in the lurch.
My two offers stand, but I must ask that we reach some final position within the next 10 days, as this situation seems to be going no where.  I see no indication of progress in these exchanges and my kitchen remains incomplete.
Thank you,
[redacted]

January 26, 2015Attn: [redacted]Revdex.com[redacted]Reference: [redacted] complaint:On 5.31.14 we hired [redacted] Designs (LD) to install a new counter top, remove and replace the...

kitchenbacksplash, and install a new custom made cabinet. They were to start the work w/i 2 weeks & and thejob was to take 4 days or less. It remains incomplete 1.1.15, more than 6 months later. On 9.3.14,[redacted] at LD flnaiiy advised us that they were ready to begin working. When they arrived, the counterhad been mis-measured & was 6 inches too long & the space for the cook top was in the wrong place. They had to reorder the countei which took another 2 weeks, leaving our kitchen a mess while wewaited. When the company came back 3 weeks later on 9.26.14, they put the counter top in & tore outthe existing back-splash. Halfway thmugh, they advised us that they hadn’t ordered enough grout & itwould take another week to get more. When they finally returned to finish the back-splash, installingnew tile that we had purchased, they chipped & scratched many of the files, left many area with toolittle grout or too much, installed files unevenly & crookedly, got giout on our cabinets, on our sashes,& all over the tiles the**elves, without cleaning them up. We are completely unsatisfied & advised[redacted] of such on 10.6.14. [redacted] reviewed their work, & saw the issues that we identified for her, agreeing that the work was sub-par & that there were areas that needed to be fixed & replaced, Sheasked us to buy additional tiles, so that their Company could use them to fix the botched job. Webought the tiles. She told us that she would call us that week. We never heard back from her. On10.27.14, 1 sent [redacted] an email reminder that 3 more weeks had passed. On 11.10.14 I again sent[redacted] a reminder note as 3 more weeks as passed. On 11.22.14, [redacted] came out to also inspect thework, He said that he~d call us by the weekend to schedule time to make amends, We never heard backfrom him. Another contractor came out to inspect the job & said hed. never seen anything like this froma pro~ssional installation. We now need to hire and pay another contractor to fix the issues, but[redacted] wants only to credit us for the tile that they ruined & the the cost of their installation, not theirtear out. They are not offering credit for the fall cost of the new contractor to tear out their mess,fix/prep the walls, & reinstall The same tile.Response by [redacted]: Our lead time is generally between 6 to 12 weeks and has been during thepast 6 months. We inform our customers at time of quoting. Our lead time varies due to circu**tancesthat are beyond our control and our quickly changing work load. We never quote start or finish dates inour contracts due to the previous statement. Once we start ajob, we do not leave it until completed. Inthe case of the counter top error, we reordered material and finished the top in the shortest amount oftime possible, To compensate the [redacted], I completed $525.00 worth of appliance installs andelectrical upgrades that were necessary, at our expense. They Were never without thU use of theirkitchen and there was never a mess left by us. We always clean our work area daily. They agreed theywould not complain or mention the counter top error again because we performed the free services ascompensation.I did run out of grout with approximately 4 square feet left to finish the job. I immediately orderedgrout with a 2 day shipping delivery. However [redacted] requested I not come back until the nextFriday, That made it 1 week. The tile the [redacted] provided was the cheapest tile they they couldbuy at [redacted]. The glass tile is $4.98 per sqn&e foot made in China, and [redacted] stated it wasa discontinued item by [redacted]. Quality glass tile cost $15.00 and more per square foot; retail. The glasstile did scratch easily and had very minor chipping on cut edges, This happens when you buy lowergrade products. To perform a test, we purchased a similar glass tile at [redacted], same cost per sq.ft. fromthe same distributor and performed the same procedures as instructed by the distributor and the glassdid scratch. To view the scratches requires much greater light than normally used in a kitchen. Also, the lighting in [redacted] kitchen was less wattage than we consider average(one ceiling light centeredin kitchen). The [redacted] brought out a 300 waft quartz work light, placed it on the counter inches away fromthe tile and complained about scratches and chips now visible under much greater lighting than normal. The tiles were installed straight, adjusted slightly for cabinets and windowsill that were not level. When I left the job after completing the grout and cleaning up, [redacted] said he was pleasedwith our work and would by contacting us to remodel their bathroom.[redacted]’ response: I did view the work performed by [redacted] Designs. I made no comment withrespect to the workmanship as I needed to discuss what I saw and the best remedy with [redacted] and [redacted].When [redacted] mentioned that the tile had been discontinued, I suggested that it wouldn’t hurt tohave additional tile on band in case we needed it to replace some of the chipped tiles [redacted]was complaining about. I informed [redacted] of **. [redacted] calls. On 11/17 [redacted] went and looked atthe job and said he would get the supplies and come back. On 11/22 be called to go out and[redacted] did not return the call. Again on 12/03 [redacted] called [redacted] with no response. Conclusion: Here is where we stand with this job. [redacted] obviously does not want Lyn[redacted]Designs to continue the back splash work. Instead she has requested we credit her the remainingbalance of $2579.00. This is not acceptable ‘with [redacted] Designs as our selling price included $465.00in installation of tile; $125.00 to demo of tile and will credit $158.40 for 30 sq. ft of file the [redacted]supplied @$5.28 per sq.ft.; for a total credit of $74840. After we apply this credit, the [redacted] willowe [redacted] Designs a balance of $1830.60 payable inunediately, This is our final offer and the onlysolution acceptable to Lyndan Designs. The hinges were quoted to [redacted] and she accepted the price quoted. (Emails attached)A copy of our contract is attached which shows[redacted] ** [redacted] accepted work that was performed, completed and accepted for a total Of $4006.00.AdditIonally, $ 465.00 labor to install tile and $108.00 to supply 27 pair of hinges brought the total to$4.579,00 (invoice attached). As noted above we will credit the [redacted] credit for their tile andlabor to domo and install tile provided they pay the balance due immediately. We reserve the right to seek thu payment and collection cost of all contracted ite as well as the addons and th ppliance installation and electrical work ifpayment of$ 1830.60 is not received within 10days of [redacted] receiving notice.Lyndan Designs, Inc.

They are not offering to credit us for the full cost of the new contractor to tear out their mess, fix/prep the walls, & reinstall the same tile.Desired Settlement: We want Lyn[redacted] Designs to pay/refund the full amount that they are claiming we still owe them as it will cost us more than that to have another company tear out the mess that they made from the back-splash, prep/fix the walls, and re-install the tile. We are moving ahead with another contractor as Lyn[redacted] has REFUSED to make this work right themselves. Its been 6 months, they left us no choice.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.

Ok - Let's get very basic with this, as I feel as though some things aren't sinking in. No one is getting anything for free - this is a losing proposition, all around.
