I'm writing in response to a claim brought forth by *** *** (known form here out as **).First let mesay how sorry I am that your office has been brought into this matter, and as far as the claim I'll start in the beginning.On 8/19/met with ** at her recently purchased property located
at *** *** *** in Danville, PA** explained to me that she was in the process of gutting said residence and remodeling, she explained that she wanted to remove the existing natural gas fired hot water heating system and all the hot water radiators, and then install a heat pump systemAt this point wrote an estimate to ** for the removal of the existing heating system, all radiators, and all heat pipes from basement (which were coated with pipe insulation not asbestos as she is describing in her complaint), and install (1) 3-1/ton SEER heat pump with an electric resistance back up auxiliary package, and a complete duct SystemAt this time ** and discussed how to get duct work to the second floor to be able to Condition said floor, said quote was priced at $7,also explained to ** that at the time, PPL electric was offering a rebate to customers who installed new heat pump systems with a SEER or greater and advised her that the Cost difference was to have SEER installed and that with the rebate she would only actually pay an extra On 9/3/** signed this contract and the system was scheduled to be installedAt this point Lytle's HVAC did remove the radiators from the house so ** and her contractor could start with their remodel work.On 10/2/** advised me that she wanted to change the system quoted to a SEER system and instead of electric resistance back up, she wanted to go with a natural gas fired furnacethen requoted the job showing the installation of a 96,btu 90% efficiency furnace with a 3-1/ton SEER heat pump, this quoted changed the total dollar amount to $9,(note that did not charge **any extra to add a furnace instead of a standard air handler with would have the electric resistance package)** signed this updated contract of 10/6/and the work to install the new system started on this dateNote: this contract, as did the first one, required a 50% deposit be paid at signing and balance to be paid upon completion of job, on 10/6/** provided me with a check for S4,and asked me to hold it until she had the money in her account to cover it, I agreedHowever, I was not able to deposit said check for several weeks at **'s requestThis system was completed in approximately days and each day of the work either **, or her husband was home, there were a few questions during the installation which either ** or her husband had answered for me, one of which was the central return grill, had originally planned to install a 6'x30" grill but the customer wasn't happy with the amount of floor space it was going to t**e up so it was changed to a 6"x24" grillThe placement of the outdoor condensing unit was originally agreed upon by myself and ** and was NOT the easiest and or convenient for me, as it required approx45' of copper lineset** did arrive home for lunch during the time of the installation of condensing unit and approved of the location.After the completion of the job, ** advised me that she was using a bank to finance all the work being completed and that she would not be able to pay me the Sbalance until she completed Some of the remodel work, at which point the bank would release her funds. At some point around November of 2015, ** contacted me and stated that she was having trouble getting approval of the $rebate from PPL because the system installed was coming in at SEER and not the required SEER ratingcontacted a representative of the PPL rebate program and asked him to look into this matterHe later advised me that **'s information was correct and it was his belief that the reason for the rating was probably because of the use of a gas furnace for back up instead of the traditional electric resistanceAt this point advised ** of my findings and also advised her that the paperwork had showed that purchased a SEER system for her(I did not attempt to place blame as she describes in her complaint) although this matter was not for me and leasily Could've advised ** that she would have to t**e the matter up with the manufacturer and not me, I decided that felt bad enough for her and agreed to allow ** to t**e $off the $amount which she still owed me, bringing her total balance due to $3300.00.On JANUARY 15, ** finally provided me with a check for for her balance due (note that it was $short of her balance)I decided not to pursue any more money from ** and considered the debt paidAt this point, months after installation, ** was pleased with the installation and it was working fine for her and her family.On April 11, received a TEXT message from ** advising me that she had started a new job working with HVAC installers and the she had contractors come in and look at her system, she stated that her duct work return system was under sized and that the average cost between the two contractors was $and that she wanted me to settle this amount with herFirst of all, any realistic person would understand my being upset by this TEXT message, A: because of all that had already done for **, and B: because as far as knew the system was working fine since October of and was advised of none of these new developments brought on by ** until now and through a TEXT messageI called ** and asked what was going on and she explained as stated above, asked her if she was having problems with her system and she stated that she wasn't and it was working fine, but "she didn't feel like changing a blower motor because of inadequate airflow'advised her that would Come to her house and re-evaluate the duct system but that didn't need her new contractors to advise me how to do my job, she stated, "just forget it” and hung up the phoneA few minutes later received another text from ** stating, "I'll see you in small claims court" and then another stating, "And we will bring up the fact that you removed asbestos the way you didI'm sure the judge will love hearing about that too"responded and said, "do what you have to do, don't text me again"In **'s complaint she stated that from our phone conversation she feared retaliation from me, but as her final text messages show, she was the hostile party.in closing I can only say that I feel that I've gone well above and beyond to help ** and to be sure she was satisfied with the job Lytle's HVAC had done for herEven though I was a small business fairly new established, I financed (interest free) her entire project and in the end was still taken advantage of in that she underpaid her final payment by GAVE her the rebate out of my pocket, which I certainly was not responsible to do, and again, was not made aware of any issues at all with her systemuntil she TEXT me saying that she wanted money from meI have done more than necessary to help ** and will not pay anything more, in fact I am still owed and frankly, now feel that she can repay me the rebate which very generously gave her.Thank you for your time in this matter,Wade ALytle
