Since receipt of the second notice of compliant, MHI has taken steps to review the claim and provide our response to the allegations. However, upon preparing to respond to this complaint online, I have noticed that the Revdex.com has closed the complaint as unresolved. MHI requests that the complaint be re-opened and that this response be considered by the Revdex.com and provided to Mr& Mrs***. MHI is aware of Mr***’s claims of plumbing blockages and overflows over the past year and MHI and several plumbing contractors have previously inspected the plumbing system on multiple occasions. Per the attached letter that was sent to Mr*** on *** 28, 2014, which explains the claims, the inspections, the cause of the blockages and MHI’s response, it appears that the blockages that are occurring are due to the owners’ use of sanitary wipes that are being flushed down the toilet. While these sanitary wipes may be biodegradable, they do not instantly break down which results in a blockage of the plumbing lines and overflows of water when flushed. MHI has inspected the plumbing system on at least four occasions and ran cameras thru the plumbing lines, each inspection not finding any blockages or damage due to a construction defect or other damage to the plumbing system; rather the inspections revealed the presence of blockages due to the sanitary wipes. This is not a warrantable construction defect in need of correction at this time and thus there is no action necessary to repair the plumbing system. That being said, MHI is willing to have another plumber run a camera thru the sewage system in order to confirm that the system is properly installed and that there is not a defect present During prior inspections, MHI representatives did remove baseboards in the closet to inspect the area. Thus, MHI is agreeable to coordinating a time in order to have these baseboards re-installed and painted and any affected carpet areas repaired at Mr& Mrs***’s convenience. The ***’s may contact MHI’s customer service directly in order to schedule and coordinate the above outlined work. Assuming that this correspondence will resolve the ***’s complaint, MHI respectfully requests that the Revdex.com remove this complaint as successfully resolved at this time. Review: Purchased a brand new house in March 2010, during the one year warranty, we had numerous repairs, to include a cement foundation that had a ridge running across the living room that was covered with carpet.The current problem is my driveway (negative slope), every time they are more than two people in the car, the driveway will scratch the bottom of my cars.If we have two or more passengers we have to get the car out of the garage and then load the passengers outside, totally defeating the purpose of garage, especially during inclement weather.Desired Settlement: MHI need to level the driveway peak so that it wont scrape the bottom of my cars.

construction of the Property, the driveway approach

was inspected by Bexar County

officials to make sure it met the building code requirements and the tolerances

required by city ordinance. This has been confirmed again during our recent inspections in which MID visually inspected

and took measurements of the driveway.

Based on the photograph submitted with your Revdex.com claim, it appears that your van has ground effects to lower the profile of the vehicle to the ground. This decreased clearance in addition to the added weight of numerous individuals in the van and personal

driving habits in accessing the driveway may be the cause of your problem.

You may also want to check the suspension system on the vehicle to make sure it is not in need of repairs since this issue has only recently occurred.

Let me be clear:

1. The reason you received three complaint this year is because this is when we notice the scrapping of the vehicle when there is two or more passengers in the car.

2. The picture of the van is only to illustrate the peak of the driveway, it is obvious that a full size van can fit into the garage. We have a sedan car that we park in the garage.

3. Even though the driveway meets the building code requirements by city ordinance, it does not excuse the fact that it's scrapping the bottom of my car. It's your duty to correct this problem. Your engineers should have figured that out, this is a $300K home and I cant park my car in the garage? I intent to use all available sources, such as the media and the courts until you resolve this problem.

Review: Before you buy a [redacted] Home, buyer beware.Two issues (that I'm aware of) in Sedona Lakes that have not been resolved by [redacted] Homes:1) Electrical Shortcut[redacted] is building high-end $400K+ custom homes in [redacted] (just south of Pearland). One of the shortcuts we've discovered by the builder was to install the refrigerator outlet on a small appliance circuit (vs. wiring the refrigerator on a separate dedicated circuit like most professional electricians do).The refrigerator circuit has tripped several times now due to too many appliances being on one circuit - [redacted]'s answer was that we should plug our other tabletop appliances into an outlet on another circuit, and they have skillfully avoided the problem by blatantly ignoring it. In addition to this leading to a potential loss of all our groceries, it is also a potential FIRE hazard (circuits are not meant to be tripped continuously). Issue still not resolved with builder.2) Nails in Subdivision:After I had 3 tires punctured by [redacted] construction crews (and had to replace them) and picking up over 30 nails/screws form the road on two occasions, I approached [redacted] to request reimbursement for 2 (of my 3 replaced tires). [redacted] claimed that they had no control over their construction crews, and they would not reimburse me for the tires.Kind of makes you wonder - if they can't control their construction crews from taking irresponsible electrical shortcuts or dropping nails in the road, how are they controlling the quality of your luxury $400-$600K home being built by their uncontrolled construction crews? And what other problems are lurking for their homeowners?Desired Settlement: 1) Pay for 3 damaged tires that I had to replace at my own cost, I can provide receipts ($458.96)2) Have crews install dedicated refrigerator circuit in this home, and also repair drywall and paint (after circuit installed) at no expense to homeowner

It is clear that MHI's subcontractors (for which MHI is legally responsible for) were the negligent party that left nails in the [redacted] neighborhood streets and that punctured my vehicle tires.

I have additional documentation to prove this, and I will be pursuing MHI in court to reclaim compensation in this matter. It is regrettable they could not simply compensate me for the financial losses I incurred due to their failure to manage their construction subcontractors's housekeeping.

This is a simple matter of a business not taking responsibility for their personnel, and then attempting to avoid the consequences.

Despite the allegations from Mr. [redacted], that MHI is liable for nails that punctured his vehicles tires, MHI has no means to determine whether the nails came from an MHI worksite, some other property, or from another location while driving. Mr. [redacted] admits that it is just as likely that the nails in his tires came from another builders worksite, and were from someone other than MHI. Based on Mr. [redacted]'s claim that he will be pursing this matter in court rather than through the Revdex.com reconcilliation process, MHI must necessarily refrain from further responses through the Revdex.com regarding this matter and requests that the Revdex.com dismiss this matter, finding that MHI has made reasonable attempts to resolve this complaint.

Review: I bought a home in [redacted] on [redacted]. At the time of closing, the molding on the kitchen cabinets had been damaged and not replaced, a medicine cabinet for the master bedroom had not been delivered(a hole remains where the medicine cabinet should be), above-the-refrigerator cabinets had not been delivered or installed, the toe boards on the cabinets were mismatched (brown instead of cherry) in the kitchen, master bathroom, and secondary bathroom. I can supply photos of these, including the hole in my master bedroom. What I was told was that the construction manager "forgot to order" the missing cabinets and that he had "quit." Another construction manager had to take one week leave of absence and had not ordered the cabinets. I was told that the cabinet company "went out of business" about 2 months before I closed. I asked for an action plan many times, and shoulders were shrugged and no answers came. I thought I had secured the answer at closing, however.... At the time of closing, the company's [redacted], [redacted], signed a written agreement that the cabinets and installation would be completed one month from the closing date--by [redacted]. I can supply a copy of executed agreement. Now I am told by the warranty person that they "hope" to have the cabinets by [redacted]. Mr. [redacted] did not notify me as to why the agreement was not honored, nor when the work would be complete. So I wait for communication as to the resolution. I sent a certified letter to the Division [redacted], [redacted]. I hope Revdex.com can help in this on-going process. I heard through the grapevine that homeowners will be "allowed" to close without cabinets! Buyers beware! Based on my experience, I would not! I do notice cabinets are being installed in on-going construction. Finally, I am extremely frustrated that the Construction Manager, the Sales Consultant, the warranty person cannot or will not resolve this issue (and Thanksgiving is around the corner)![redacted]Desired Settlement: I respectfully request that matching cabinets and cabinet work be provided and installation done immediately, if not sooner!

Although the construction/warranty workers worked on the cabinets for 2 days it has not been determined that the toe boards have been installed and match in the kitchen and both bathrooms. The medicine cabinet and the over-the-refrigerator cabinets are fine and are considered by me to be complete.

However, the toe boards remain an issue. I have asked the construction/warranty worker to contact me in this regard and sent two messages to him; one by phone, one by e-mail. No response. I have asked the sales consultant to contact him and ask him to contact me. No response. No surprise here.

By the way, no contact was made by the MHI Division President as I requested and no consideration or interest was given to speak with me directly. I would have welcomed the opportunity to discuss why absolutely no brick was left over to save from my house (although my next door neighbor indicated she saw said extra brick). Yeah, not exactly customer friendly!

Sorry, cannot close until complete regarding toe boards and contact about the brick.

Review: We bought a home on [redacted] 21st 2013. On [redacted] 28th 2013, the master bedroom flooded due to a plumbing defect. This was a result of upstairs bathroom and toilet being used for the first time. The plumber contracted by MHI, aggressive plumbing stated it was due to waste from construction.

On */8/2014, upstairs bathroom and toilet were used the second time which resulted in flooding of the master bathroom.

On */11/2014, upstairs bathroom and toilet were used again and the master bathroom flooded.

On */21/2014, upstairs bathroom and toilet were used and master bedroom flooded again.

Based on the events above, the master bathroom flooded every time the upstairs bathroom and toilets were used. The final flooding resulted in damage to the baseboard in the master bathroom, toilet door, master closet and carpet. [redacted] who is a project [redacted] was informed, he visited the home after 3 weeks of multiple calls to him and the MHI office. [redacted] stated it was a plumbing issue and should be covered because it was a repetitive issue.

During his visit, [redacted] ripped off the baseboards because they had mould on them. To date, our master bathroom and closed has no base boards and the home's foundation is visible.

I have attempted to contact other representatives from MHI to assist with this issue but have not received a satisfactory response.

This is a defect in the plumbing and MHI should support with correcting it.

Additional comments: [redacted] has been contacted multiple times to support with maintenance issues but has not responded. He has closed open tickets stating the order has been resolved, this is an integrity issue.Desired Settlement: We need our master bathroom and closet baseboards returned and the door replaced or changed as it has water damage stains.

Review: We purchased a new home with MHI/[redacted]. We have had many issues from contract signing to what is covered in the 2 year warranty. However this past couple weeks we had problems and no response from MHi/[redacted]. We followed protocol and placed a case issue on the website. No Response. We HAVE MICE in a new house, it ran over my children legs and a business client who showed up. My wife called an external pest control company , ABC Pest Control, and they found mice droppings and 12 openings where the mice came in . This is UNACCEPTABLE and no response from MHI/[redacted] is also UNACCEPTABLE.Desired Settlement: IMMEDIATELY FIX THIS ISSSUE

Review: Bought a home in [redacted]. The home is riddle with all kind of repairs, for example leaks into the closet that develop into mold growth, leaks from top bathroom, squeaking of the upper room floors you have to walk gingerly upstairs, doors out of alignments, UNCOMPLETED WALKWAY, Cracks in the external walls. I have requested this stuff fixed and always have been meeting with a lot of brick wall. I think it is unjust, unfair and discriminatory to have to abandon and unresponsive to a customer complaint.Desired Settlement: Have all my warranty request acted upon and have this problem fixed.

MHI representatives were able to meet with him earlier today and review the items that are the subject of this complaint. Review: I signed a contract for a home, but cancelled the process within 3 days. The initial downpayment of $4100 dollars included $2400 dollars in options money, and $1500 dollars towards the downpayment for the home. Six weeks later after the cancellation I only recieved the $2400 dollars back and was told the $1500 down payment was not refundable, even though the house process had never started.Desired Settlement: I would like the refund of my full amount due to the fact that the process had not begun.

Review: My fiance and I start** building a home with Coventry (MHI) and during the framing stage we observ** that the materials us** (No 2 studs and other boards) were heavy contaminat** with mold and were of very low quality (knots and heavily crack**). [redacted] of coventry and his supervisor both agre** and communicat** verbally that these materials should not have been us** in the framing of the home. These two coventry representatives also both agre** that the workmanship of framing was not adequate and ne[redacted] significant repairs even though the builder was continuing to conduct other construction activities such as installing plumbing, gas lines, cornise, etc. [redacted] indicat** he was investigating how the poor quality studs and wood were allow** to be shipp** to the home and why the framing company us** the material. At on-site visit with [redacted] and his supervisor, these two Coventry representatives indicat** they would not remove all bad quality studs and only fix parts of the framing even though they agre** that the material should never have been us** in the first place. My fiance and I request** we be remov** from our contract and be reimburs** all money given to Coventry (MHI). Coventry committ** to returning only the option and earnest money deposits and would not commit to returning the r**raw fee of $5,000. We feel that this home is not being fix** properly and thus we should be reimburs** fully due to the lack of workmanship and materials. Our health issue is that Coventry indicat** it would bleach treat the mold containing wood; however, I disagree with them since removing the contaminat** wood is the most effective rem**iation process and it could be done since the home is only in the frame stage with no drywall. Mold can be a serious health issue and we feel that this situation could turn into a serious health issue for us and their solution is not the appropriate rem**y given the alternative of simply removing the contaminat** wood.Desired Settlement: Refunded all money given to MHI (Coventry) and removal from contract. Total refund amount of $26,060.

Review: I recently built a house in Firethorne. The builder is [redacted] (MHI) and they told me the granite countertops were provided by [redacted]. I found some cracks, which go through the whole depth of the countertop from surface to bottom. I can even put my finger nail into a couple of places. For me, these cracks are not natural fissures but cracks formed during shipping and installation. Other stone experts I asked also said they are cracks. but [redacted] give us a letter from [redacted] said that's natural hair lines and fissure from stone. I worry about these cracks and want builder to replace it before we do the closing. The builder said "No" and told us if we don't closing the house in 5 days, they will put our house on the market.Desired Settlement: We want all countertops with cracks to be replaced.

Review: MHI (Coventry homes) made a repair to my driveway ~6 months ago under warranty because it was shifted and warped. They came out and repaired the driveway but used a different color mortar than my original concrete. The concrete used was Gray and all the driveways poured in my neighborhood use a white mortar. The problem became really apparent when my neighbors driveway was recently repaired with the correct mortar and her driveway is a completely different color to mine and more closely matches her concrete. When the repair was made I did not have unrealistic expectations expecting fresh concrete to match my existing concrete but at a minimum I thought some effort to try to match the existing concrete would be made and at least use the same color mortar. I tried to discuss issue with MHI and they said they will not repair and that there warranty does not guarantee color match but a mistake was clearly made in the selection of the concrete mortar and they are exploiting this clause not to fix this mistake. I believe the warranty clause was meant to protect them from customers having unrealistic expectation of fresh concrete matching their existing concreate but not to protect them against mistakenly using the wrong mortar or incorrectly mixing the concrete. I do realize cement will have some color variation but this cement does not look like any other house in the neighborhood making it apparent that something was not done wright.Desired Settlement: I wish for MHI (Coventry) to redo the repair using the correct cement/mortar mixture. I do not have unrealistic expectations and don't expect the fresh cement to match exactly but I do expect for the mortar to be the correct color and over time will eventually blend with my concrete.

MHI Partnership, Ltd. d/b/a Coventry Homes agreed to repair the warrantable condition of your driveway by re-pouring two sections of concrete in January 2014. While it is always our goal to make repairs in such a manner that they will blend and/or closely match the original construction, this is not always possible due to a variety of factors and variables (such as time, materials, color variations, shade variations, exposure, etc.) This is in large part the reason that MHI does not warranty or guaranty that repairs, such as your concrete driveway, will match pre-existing conditions and finishes. Concrete in particular is subject to many variations in color, texture, etc. due to the materials used in preparation of the concrete and conditions on site and during the finishing process. If a new section of the driveway was re-poured a second time, there is likewise no guarantee that the color would match, and it could in fact have more variation than is present today. The Home Builder's Limited Warranty sets forth the standards by which we and homeowners are bound and able to determine in an objective fashion as to whether there is a warrantable defect in need of correction and repair, and the standards by which repairs are to be made. The repairs conducted with regards to your driveway are in compliance with these warranty standards. For the reasons set forth herein, MHI must respectfully decline your request that sections of the driveway be demolished and re-poured a second time in order to attempt to achieve a cosmetic match of existing concrete. Furthermore, MHI requests that this matter be reviewed by the Revdex.com and based upon the repairs conducted, the inspection and evaluation of the matter at hand, and this response that the Revdex.com find that this matter has been successfully resolved in accordance with Limited Warranty standards applicable to this matter.

MHI also had their preferred cement vendor contact me I requested that they send me the quality assurance quality control documents to confirm that the cement was mixed correctly and there vendor could not provide this information. He also could not provide any proof that they even poured the cement. MHI has failed to provide any documentation proving that this cement was mixed correctly. The only evidence that we have that the cement was mixed properly is due to visual inspection and if this is the only indicator then visual evidence clearly shows that the cement was not mixed properly because the color is completely off. MHI also claims that the same vendor pored all the homes in my neighborhood and if this is the case I should see similar variation throughout the neighborhood but this is not the case.

I am sorry I was on vacation and not able to respond in a timely manner to the response from MHI. The response from MHI is unacceptable. MHI is using a clause in there warranty manual to not correct poor repair work. The clause was meant to protect them from variations in cement color especially between new and previously poured cement, not if the wrong color mortar was used. By their explanation they could come in and pour orange cement and as long as it is structurally sound the consumer has to accept it. If there argument of cement variation was sound and applied in this case then I should be able to see similar variation throughout my neighborhood because there are several MHI homes around here poured with different batches of cement and at different times and none of the variation are like my house. It is clear that MHI cannot be objective in this matter and a third party will need to be brought in to settle this dispute. I would like to have a third party arbitrator come to my house and witness this cement in person, once seen in person it will be clear to the arbitrator that something clearly was done incorrectly.

The color of the concrete is a cosmetic issue and there is not any defect in the driveway and it appears that the cement was mixed correctly. As we previously notified you, variations in the color of finished concrete is common and each batch of concrete will vary in color depending on many factors. There is no guarantee of a color match when pouring concrete and it is likely that if this section was re-poured again that the color may in fact have more variation in the color than what is currently present. For these reasons, MHI must respectfully decline your request for MHI to re-pour the driveway sections in order to attempt to achieve a cosmetic match of the concrete.

Review: Backyard grading was done incorrectly resulting in standing water.

We have had drainage issues in the backyard for some time now. Initially [redacted] came out and did some work that seemed to allieve the drainage problem, but once the lot next door was built the draining problem came back. I have been working with that builder ([redacted]) to fix the problem because I thought they were at fault. They hired a surveyor to measure the grade of the yard and found that my yard was actually draining onto the empty lot prior. Once they built their home my yard started backing up b/c it could drain to their lot anymore. The surveyor shows that my lot is not graded from the back of the yard to the front of the yard correctly resulting in the standing water. I have submitted several warranty requests and have not been able to get this issue fixed.Desired Settlement: I would like [redacted] to either send out a landscaper to correctly grade the area (add dirt, dig out what is necessary) or install a french drain to correct the drainage issue.

Review: I purchased a home from [redacted] in the [redacted] subdivision on October 6, 2014. I was told that the build out time for our home was 5 months. This was one the main reason why we chose this builder out of the others in the sub division. Since then the whole process has been downhill. Once ground was broken on the home in December it has been issue after issue. Thing that we were told that would be completed were not completed when they said it would be. Here we are in April and I am just now finding out the the cabinets are on back order. I should have been notified that theyre was a backorder on my cabinets and I should have been given the option to pick out a new cabinet. They have not been honest and upfront with us on the the building process of our home. It is frustrating because since Day 1 we told them we were under a lease that expired in February 2015. We extended our lease until end of March to be on the safe side. Since then we have extended our lease till the end of April since we were told that our house will be for sure done in April. Now we are being told in May. This company has poor customer service. I have spoken to the manager [redacted] and his attitude sucked. He has no sympathy and is not empathetic towards our situation. They are not having an honest relationship with the buyers. They are making false promises.Desired Settlement: They need to finish the job as promised. Review: [redacted], a brand under the MHI umbrella, is not honoring the written warranty provided with the purchase of our house on [redacted].

We closed on our new construction house on [redacted]. The home comes with a 12-month warranty and guarantee. We have submitted four warranty claims since moving in. The last two were submitted on [redacted] (warranty claim # [redacted]) and [redacted] (warranty claim # [redacted]). Services were guaranteed to be provided in a timely manner. Since submitting the two most recent claims listed above, eight of the submitted 11 items have not been addressed, now two months since originally submitting.

We've exchanged numerous correspondence with the onsite project manager representing [redacted] (an McGuyer Homebuilders Inc (MHI) company), [redacted]. We were asked to work directly with one of the contractors to schedule repairs. We have communicated with the contractor, [redacted], and have been told by them numerous times that all requests must come through the builder and we cannot work directly with them.

[redacted] continues to ignore emails and phone calls, and is not honoring the warranty that was provided with the home. The below list are the services requested that have not been addressed and continue to be ignored:

*Guest bathroom door has bubbles/warps in it

*Media room door has bubbles/dents in it

*Kitchen counter grout missing on island

*Paint overspray all over the medicine cabinet in master bathroom on mirror side

*Wall damage/scuffs above entryway at top of ceiling (looks like ladder marks about 16 feet up)

*Missing paint on ceiling in kitchen

*Large overspray in entry way on the trim by the front door

*Large paint overspray on bottom of guest bath cabinet

Regarding the two door requests above, we have the doors sitting in our garage waiting for the paint to be corrected on them before being installed. They have now been sitting in the garage for nearly three weeks with no further communication regarding next steps.Desired Settlement: We are requesting that [redacted] and McGuyer Homebuilders Inc (MHI) honor the provided 12-month warranty that they provide with new construction homes.
