company, M J Fence Contractors. This is my response to that letter:Mr [redacted] came to me in August wanting a deck for his above ground pool. I gave him an estimate and he agreed on the price. Mr [redacted] asked me If I could be done by labor day weekend and I told him maybe. This is a common request I get from most of my customers around holidays and I try to explained to them I will try my best, but there are no guarantees because of things like the weather (rain) could change my whole schedule. I took a deposit down from them for $4400. He also had a gas line running to his pool, which I did not know about. Every job I call O.U.P.S (ohio utilities protection service) and I didn't see it, so I ended up drilling through it. I offered to pay to fix the gas line or take the repair cost off the cost of the deck, which they agreed to. Also Mr [redacted] wanted to do the job without a permit to save money on the cost, which ended up getting him in trouble with the city after the neighbor called on him. The City said he had to get a permit and at this point he still wanted the cheaper route and got a home owners permit, which I can't use for insurance purposes and told him I need to pull the permit through my company. He then demanded that I sign a contract that would say I would be at his house in the early morning (7 am) to the end of the day (5 or 6pm) and I couldn't leave his house during that time frame. I found these terms unacceptable, because I work on other jobs as well throughout the day. For example I might set his posts in the morning and then go nail boards for a fence for another customer in the afternoon. I then basically told them I would not be doing their job anymore and will be giving them their deposit back. At the time of their complaint they have already been refunded most of their money and by now they have received a full refund, plus got to keep the posts in exchange for fixing the gas line. Sincerely,Michael J[redacted]
