In regards to the attempted delivery of a 10xvinyl shed to *** ***, ordered on May ***, , the customer was advised of what conditions and site preparations were necessary in order to deliver and assemble the shedOn the contract signed by this customer, it clearly states that the
ground “must be level within inches and firm”Due to the recent planting of grass seed and excessive watering of top soil surrounding the area to be prepared for delivery, Gera Gardens employees were not able to complete the deliveryThe ground was so wet that the employee’s shoes were in fact submerged in mud when entering the premises, along with the equipment needed to complete the assemblyOur representative explained to *** *** at the time that because of the ground being wet we would not be able to complete the job on that day, and that we would be forced to return at a later time once the ground was dry and firm, as mentioned in the signed contract*** *** requested a full refund at that time and an office representative explained over the phone that there are options present at this time, the first being a 75% refund for not receiving the shed, or a rescheduling of delivery date pending on the ground meeting the delivery criteriaA verbal disagreement took placeHe demanded a full refund and was uncooperative when notified that if a special order is cancelled a 25% fee is charged, this policy is also on the sales contract that is signed and dated by the purchaserGera Gardens would be more than happy to continue with either option, whichever is more favorable for the customerWe arrived at the scheduled time to deliver the unit and were unable due to negligence by the homeowner and we are not liable for that cancellation which would result in the 25% deposit chargeWe have attempted to contact both parties and they are unresponsiveAt this time we will wait for further instructions on whether to issue the 75% refund or reschedule the delivery of the unitPhotographs of the area showing the inclement conditions are available if needed, as well as copies of the signed contracts stating the site preparation

 I do not have the shed and Gera Gardens still has my money.  Contrary to their statement, the property has 1-2" of topsoil on top of hard clay.  It was level and firm, I discussed this with them at time of purchase and was advised it would be no problem. .  They refer to clauses in the contract they breached.  They cannot have it both ways. I did not at anytime cancel this deal.  Mr. Andre G[redacted] did.  He stated to both myself and the homeowner that they were taking back the shed and refunding my money.  Please see attached signed statement by the homeowner that confirms my story.  They cannot cancel the contract and try to keep any portion of my money under a contract they breached.   Please note, they have refunded nothing, not even the part they do not dispute.  A google search reveals a history of this behavior on their part.

Thank you for your recent communication in regards to to the [redacted] complaint. A refund was given to the [redacted] account on the credit card that was used to pay the balance. A certified letter was mail to both [redacted], postal #[redacted] and [redacted] postal #[redacted], on July **, 2016, informing them of the refund. How ever both of these certified letters we not accepted at the time of delivery so they were scheduled for re-delivery on July **,2016. The re-delivery confirmation for [redacted] is #[redacted] ,  and for [redacted] is #[redacted]. The second delivery attempt was also not accepted by either party. At this time both parties have ceased communication with Gera Gardens but have received the appropriate refund so there is no longer a dispute in question. Thank you for your time and consideration. -Gera Gardens

Hello thank you for emailing Gera Gardens in regards to case #[redacted] , a dispute with Carolyn Jackowski. Unfortunately due to company procedure we do not give refunds on seasonal items. We did however provide her with a full store credit in the amount she paid , which her husband picked up and...

proceeded to purchase other items with. They purchased several different things and appeared to be fully satisfied with everything, leaving pleasantly and saying thank you.
