According to [redacted]'s last response, she admits the
system we installed gave her no issues for at least five years. As far as we have been notified, there has
been no mechanical issues with the air conditioning system, or installation MJS
installed seven years ago. Her issue is
with the drain line, not installed by MJS.
Drains do clog. We still stand
firm on our response that the Spring Check done in April was adequate, and
thorough. We were not called
specifically out for a drain problem. We
were called for a Spring Check, and asked specifically to ensure the drains
were draining, which they were at that time, and remained draining for three
months following our visit. We are
sympathetic for the [redacted] predicament, but do not accept fault for their recent
drain clog, or damage incurred by their recent drain clog.

I guess that we need to reiterate that the filthy TRAY (i.e. drip pan) was clogging up the entry to the drain and that the drain was clear.  The tray that they were specifically asked to clean, by their own admission.   This pan supposedly accumulated no dirt or mold between October 2013 and April 2015, yet became so filthy in the three months between April 2015 and July 2015 that it covered up the drain hole and produced the noxious sludge shown in the photos.  Yeah right.

MJS was called for a Spring Maintenance check up at the
above mentioned condo in April, We
were made aware the condo had previously
flooded due to a drain issue, and were asked to check the drains
specifically. We found the system
draining properly at that
time. [redacted] called our office end of business day, Tuesday, July 14th, three
months after the spring check, demanding same day, evening service as she had found
the system "leaking badly." She became irate
with the service dispatch girl when told she could not provide same day service
after 4pm, and viciously threatened her and the company with a lawsuit. At that time, [redacted] was transferred to
the supervisor. The supervisor advised
[redacted] to immediately turn off the system in order to prevent leak damage,
and [redacted] clearly stated she refused to shut the system off and MJS
would be responsible for any water damage that might occur. When told we had already maxed out the amount
of service calls we could ethically enforce on all our employed technicians for
that same day, she then unrelentingly threatened lawsuit again. At that time, as she continued to yell at the
supervisor and make unsubstantiated threats, he made the decision to refuse
service, and end the phone call.
As far as the accusation of MJS not accurately performing
the maintenance check up, from the pictures [redacted] attached in the
complaint, the coil is obviously clean and not in need of any maintenance. As far as the mentioned drain pan, this unit
does sit on a condo roof top and is exposed to debris and atmospheric dirt as
well as other miscellaneous components on a constant basis. We have had excessive rain the past few
months in Houston, and with the unit being on the roof top, it is completely
likely that build up will occur.
We received a more relaxed phone call from [redacted] today, Friday, July 17th, apologizing for [redacted]'s
behavior. He explained the strain of their
present financial situation and the pressure they are under with the constant
and reoccurring drain issues. The
supervisor gave [redacted] a recommendation to change out the older drain
system out with a newer, more efficient, wider draining system. He also recommended a float switch device be
installed. [redacted] let us know the
company out on Thursday, July 16th had the same recommendation and
installed a float switch device to prevent another flood situation. At the end of the phone call between the supervisor
and [redacted], he was accepting of his unfortunate situation and the
understanding that MJS is not liable.
Considering they had made us aware of their previous flooding
and unresolved stoppages with the drain lines, and since the system had been
draining properly for three months following our inspection, our official
stance is a complete refusal of accommodation to [redacted]'s desired settlement. We do not feel MJS is liable in any way, and
we hope Mrand Mrs[redacted], and tenants are able to remedy their present personal
situation as painlessly as possible
