[The M & J establishment has been paid to fix my carIf the shop incurred unnecessary expenses due to noncha*** on their part, why do I have to pay for that?My warranty paid the agreed priceMrs*** *** and her fiance, Mr*** *** are trying to take advantage of my virtue of being understandingI never informed Mrs*** that my loan was going to pay for my car to be fixedI informed her that my car is still under warrantyIt was after much delay on fixing my car that I informed Mrs*** and Mr*** that my car is financed, and that I still have to make payments, and keep the car insured even when it is just sitting in their lotI never disputed the amount they said I will have to pay for the fluid and filter, $I pay $1,on insurance for six months on that carThe car has been with the M&J establishment for three months and still counting.The gentleman that came with me to M&J shop is my cousin, ***He only came because I asked him to come and help me drive the car we came to pick up since I was driving oneMy cousin only got involved when the mechanic that was at the shop decided to explain to him why my car was not yet fixed because I was fade up with listening to new excuses every time I contacted the shopMy cousin tried to explain to the mechanic, *** that it was not my fault that they got a bad engine, and that it was between M&J establishment and the company they bought the engine fromHe informed the mechanic that they gave the cost of replacing a new engine, then after receiving payment from the warranty company, they decided to buy a used engineThe mechanic then informed us that he does not own the shop, that he only works for payMrs*** came out and asked us to vacate her propertyFive minutes after we left M&J business premises, Mr*** *** trailed my cousin and I to a parking lot in the shopping plaza, blocked my car in with a navy blue vanMr*** came out of the car and verbally assaulted my cousin and IMr*** threatened that he was going to shoot us if he sees us anywhere close to his propertyI contacted the police immediately, an officer arrived at the scene and got an eyewitness statement from one of the bystanders that witnessed the incidentMr*** threatened to crush my car if I don't get it out of his garageI fear that my car is probably being tampered with already]

To Whom It May Concern,I [redacted] OWNER OF M & J TOWING & SERVICE CENTER LOCATED AT 509R 29TH STREET PARKERSBURG WV 26101 GIVE THE FOLLOWING INFORMATION CONCERNING CUSTOMER [redacted] OWNER OF 2008 [redacted] CX7 TURBO. I FIRST CAME IN CONTACT WITH MR. [redacted] AS OWNER OF ** *...

[redacted] AUTO SALES AT [redacted]. HE CAME INTO SHOP AT BEGINNING OF APRIL ASKING IF WE COULD LOOK AT HIS VEHICLE DUE TO THE VERY LOUD KNOCKING NOISE COMING FROM THE ENGINE. WE TOLD HIM WE COULD BUT IT WOULD TAKE A COUPLE DAYS TO GET TO IT HE LEFT VEHICLE AND NAME AND NUMBER TO CONTACT HIM. UPON DIAGNOSIS OF VEHICLE WE FOUND THE TURBO HAD WENT BAD WHICH CAUSED ENGINE TO THROW A ROD. AFTER MULTIPLE ATTEMPTS TO REACH MR [redacted] DUE TO HIS VOICEMAIL NOT BEING SET UP WE SET VEHICLE ASIDE TO WAIT ON HIS CONTACT AND DECISION OF WHAT HE WANTED US TO DO. AFTER A FEW DAYS HE CAME BACK INTO SHOP AND AFTER MY FIANCE AND MYSELF EXPLAINED THE PROBLEM TO HIM HE TOLD US THAT THE VEHICLE WAS UNDER A LOAN. HE ASKED IF THERE WAS A WAY I COULD CONTACT THE LADY FROM THE BANK IN CHARGE OF HIS LOAN ON VEHICLE TO GIVE HER AN ESTIMATE TO HAVE AMOUNT ADDED TO LOAN THAT IT WOULD COST FOR REPAIRS OF VEHICLE. HE THEN TOLD ME THAT HE ALSO HAD AN EXTENDED WARRANTY. I EXPLAINED TO HIM I COULD CONTACT WARRANTY COMPANY AND SEE IF REPAIRS WERE COVERED. HE BROUGHT ME INFORMATION A FEW DAYS LATER AND I TOLD HIM I WOULD CONTACT HIM AS SOON AS I KNEW ANYTHING. ( AT THIS POINT WE HAD NOT CHARGED HIM ANYTHING FOR SERVICES) BEFORE I COULD CONTACT WARRANTY COMPANY THE NEXT MORNING THEY HAD CONTACTED ME DIRECTLY. I SPOKE TO AN AGENT OF [redacted] EXTENDED WARRANTY NAMED [redacted]. HE WAS ONE I SPOKE TO EACH TIME AND ONLY HIM CONCERNING THIS VEHICLE. UPON OUR DISCUSSION AND RESEARCH FOR PRICE OF ENGINE AND TURBO AS WELL AS LABOR FOR BOTH HE SENT OUT AN INSPECTOR TO LOOK AT THE VEHICLE TO MAKE SURE THAT WAS FOR SURE THE ISSUE. THE NEXT DAY THE INSURANCE INSPECTOR CAME OUT AND MET WITH US AND LOOKED OVER VEHICLE. HE SENT HIS REPORT IN AND 3 DAYS LATER I WAS AGAIN CONTACTED BY THE WARRANTY COMPANY. [redacted] ADVISED ME ON CONTACTING MR [redacted] AND HAVING HIS SIGNATURE ON THE ESTIMATE THAT NEEDED TO BE FAXED INTO HIM DIRECTLY FOR PAYMENT OF JOB TO BE DONE. THIS CONVERSATION TOOK PLACE ON APRIL 23RD WHEN FINAL ESTIMATE WAS WROTE AND AGREED UPON UNDER THE UNDERSTANDING THAT BOTH THE ENGINE AND TURBO WERE TO COME WITH WARRANTY AND THAT MR [redacted] WOULD BE RESPONSIBLE FOR ALL FILTERS, FLUIDS, ECT FOR REPLACEMENT OF ENGINE AND TURBO AS THOSE WERE NOT COVERED BY WARRANTY. ON THE 27TH OF APRIL MR. [redacted] CAME INTO SHOP WE EXPLAINED ENTIRE PROCESS TO HIM AND HE SIGNED OFF ON ESTIMATE TO BE FAXED TO [redacted] AT WARRANTY COMPANY. ON THE 8TH OF MAY I FAXED FINALIZED PAPERWORK TO [redacted] FOR PAYMENT FOR THE JOB. ON THE 12TH OF MAY AFTER RECIEVING EMAIL WITH PAYMENT INFORMATION I TYPED INTO OUR CARD READER TO RECIEVE PAYMENT INTO BUSINESS ACCOUNT SO THAT ENGINE AND TURBO COULD BE ORDERED. THE WARRANTY COMPANY'S AMOUNT WAS $5132.00 AND ONCE CREDIT CARD FEE WAS REMOVED THE AMOUNT RECIEVED WAS $4952.23 THE DIFFERENCE WAS OUT OF OUR POCKET. UPON RECIEVING THE PAYMENT AND IT CLEARING THE ACCOUNT 24HOURS LATER I WENT TO COMPANY OFTEN USED [redacted] AND ORDERED A USED ENGINE WITH A WARRANTY AND ORDERED THE TURBO BRAND NEW WITH WARRANTY OFFLINE. IT TOOK TIL THE 29TH OF MAY TO RECIEVE THE MOTOR AND TURBO STILL HAD NOT BEEN RECIEVED THE WAY THE ENGINE AND TURBO WERE THEY HAD TO BE PUT TOGETHER BEFORE ENGINE COULD BE PUT BACK INTO VEHICLE. MR [redacted] STOPPED IN SHOP AND WAS ADVISED OF THIS AS WELL AS FACT I WAS CLOSING CAR LOT AND MOVING TO OTHER LOCATION PERMANENTLY AND HE AGREED FOR HIS VEHICLE TO BE MOVED THERE AS WELL AS US TO CONTINUE THE WORK. THE END OF THE FOLLOWING WEEK WE FINALLY RECIEVED THE TURBO BUT WAS ALREADY IN MIDDLE OF ANOTHER ENGINE REPLACEMENT JOB WE HAD AND IT WAS ON THE ONE AND ONLY LIFT I HAVE. MR. [redacted] CAME IN THE 12TH OF JUNE AS WE WERE FINISHING UP THE OTHER JOB AND WE TOLD HIM THAT WE HAD FINALLY RECIEVED ALL THE PARTS AND IF ALL WENT WELL WE SHOULD HAVE VEHICLE FINISHED BY THE 18TH OF JUNE WHEN HE REQUESTED IT BE DONE BY DUE TO PAYING INSURANCE ON VEHICLE DUE TO LOAN AND HIM NOT BEING ABLE TO DRIVE IT. ON THE 19TH OF JUNE WHEN ENGINE REPLACEMENT WAS COMPLETE THE VEHICLE WAS STARTED IT RAN FOR 10MINS EXACTLY AND SHUT DOWN. THE MOTOR WAS NO GOOD THAT WAS SENT TO US BY [redacted]. IMMEDIATELY I TRIED CONTACTING MR. [redacted] AND [redacted] TO FIGURE OUT THE SITUATION. I COULD NOT REACH MR [redacted] YET AGAIN AND [redacted] TOLD ME THEY WOULD REPLACE MOTOR DUE TO IT BEING UNDER WARRANTY. AFTER AN ADDITIONAL WEEK [redacted] BROUGHT ANOTHER MOTOR TO REPLACE THE BAD ONE WE HAD RECIEVED, THE COST OF THE MOTOR WAS AN ADDITIONAL $1000+ FROM THE FIRST ONE AND WE REFUSED TO PAY FOR DIFFERENCE THEY MADE IT RIGHT AND ADJUSTED PRICE DUE TO FACT THAT THE MOTOR WAS UNDER WARRANTY. A FEW DAYS LATER MR [redacted] FINALLY CAME INTO SHOP AND MADE CONTACT. WE SHOWED HIM THE MOTOR JUST DELIVERED AND EXPLAINED TO HIM THE ENTIRE SITUATION APOLOGIZED FOR INCONVENIENCE AND TOLD HIM THAT [redacted] DID NOT WANT TO PAY THE LABOR FOR ENGINE TO BE REPLACED AGAIN EVEN THOUGH THEY HAD SENT US A BAD MOTOR. HE LEFT SAYING THAT HE WANTED SOMEONE ELSE TO PAY THE COST OF IT. WE EXPLAINED TO HIM HE ALSO STILL HAD BILL FOR ALL THE FLUIDS AND FILTERS WERE THE ENGINE AND TURBO WERE ALREADY REPLACED HE SAID TO MAKE [redacted] PAY LABOR. [redacted] SAID THEY WERE NOT RESPONSIBLE FOR LABOR COSTS AND CUSTOMER REFUSED TO PAY SO VEHICLE SAT THERE WITH MULTIPLE UNSUCCESSFUL ATTEMPTS OF CONTACTING HIM. ON THE 10TH OF JULY MR [redacted] CAME TO SHOP WITH ANOTHER GENTLEMAN WHOM I HAD NEVER SEEN BEFORE, HE WAS AGRESSIVELY YELLING AT MY MECHANIC ABOUT MR [redacted]'S VEHICLE WHILE MR [redacted] STOOD OFF TO SIDE TELLING HIM THAT HE WAS JUST GOING TO HAVE BANK AND WARRANTY COMPANY CONTACT ME DIRECTLY. I TOLD HIM THAT WAS FINE EXPLAINED THAT I WAS NOT GOING TO EAT AN ALMOST 1800$ LABOR BILL AS WELL AS FLUIDS ECT A SECOND TIME DUE TO SOMEONE ELSES MISTAKE THAT I UNDERSTOOD HE WAS UPSET AND IF HE WANTED THEM TO CONTACT ME DIRECTLY THAT WAS FINE. THE GENTLEMAN WITH HIM THEN PROCEEDED TO RAISE HIS VOICE AND STEP TOWARDS ME TELLING ME IT WAS NOT RIGHT THAT I WAS NOT IN LEGAL STANDING BY HIS VEHICLE NOT BEING FINISHED WHEN HE SAID IT SHOULD BE DONE. I POLITELY TOLD HIM THAT I DID NOT KNOW WHO HE WAS BUT HE WAS NOT MY CUSTOMER AND HE NEEDED TO LEAVE THE LOT IMMEDIATELY THAT I KNEW MY LEGAL STANDING AND HE HAD NO RIGHT TO BE THERE AS HE DID NOT HAVE PROPERTY THERE AND WAS NOT A CUSTOMER AND WAS BEING AGRESSIVE AND FLAT OUT RUDE! HE THEN POINTED HIS FINGER IN MY FACE AND TOLD ME I WAS RUDE AND HE WOULD MAKE SURE I PAID WHAT I HAD TO AS MR. [redacted] WAS HOLLERING AT HIM TO GET HIM TO LEAVE AND TO FORGET IT HE WOULD TAKE CARE OF IT HIMSELF AS THE GENTLEMAN STOOD FINGER IN MY FACE HOLLERING AT ME! MR [redacted] THEN TOOK HIS ARM AND PULLED HIM AWAY. I AGAIN APOLOGIZED AND TOLD HIM HE COULD HAVE THEM CONTACT ME DIRECTLY ( REFERRING TO BANK AND WARRANTY COMPANY )THEY LEFT AND I WENT BACK TO MY DESK. MY FIANCE WAS NOT EVEN THERE HE WAS OUT RUNNING ERRANDS AND I DID NOT EVEN SPEAK TO HIM ABOUT THE SITUATION TIL ALMOST 45 MINS AFTER THEY HAD LEFT AND HE HAD RETURNED. HE ADVISED ME THAT IF THEY WANTED TO TAKE VEHICLE THAT WAS FINE AFTER HE PAID BILL OWED AND TOLD ME WE WOULD TAKE CARE OF IT WHEN THE WARRANTY COMPANY AND BANK CONTACTED ME.I THEN RECIEVED LETTER FROM YOU IN MAIL.I NEVER RECIEVED A CALL FROM EITHER OR MR [redacted] AND THE VEHICLE IS STILL SITTING IN MY LOT.THEN TODAY JULY 21, 2015 AN AGENT NAMED [redacted] FROM [redacted] WARRANTY CALLED AND WOULD ONLY SPEAK TO MY FIANCE TELLING HIM THAT WE WERE GOING TO FIX VEHICLE AND EAT THE COST OF THE BILL AFTER MY FIANCE EXPLAINED SITUATION TO HIM HE THEN TOLD HIM THAT HE WOULD CONTACT [redacted] AND HANDLE THE SITUATION AS IT WAS THEIR FAULT WE RECIEVED A BAD MOTOR EVEN THOUGH THEY HAD REPLACED IT THEY SHOULD STILL BE RESPONSIBLE FOR THE LABOR BILL FOR HAVING TO TAKE IT OUT AND REPLACE IT AGAIN. HE CALLED THE 2ND TIME TO GET INVOICE NUMBER OFF OF THE 2ND MOTOR [redacted] HAD PROVIDED.I HAVE ATTATCHED THE ESTIMATE THAT WARRANTY COMPANY PAID AS WELL AS FAX COMFORMATION OF WHEN IT WAS SENT TO [redacted] AT [redacted]. I'M NOT SURE WHERE MR. [redacted] GOT HIS AMOUNT FROM ESPECIALLY SINCE HE NEVER PAID FOR ANYTHING SINCE DAY ONE AND STILL HAS A BILL FOR FLUIDS AND FILTER FROM THE JOB AND WE NEVER CHARGED HIM FOR DIAGNOSIS IN BEGINNING. HIS DATES ARE ALSO INCORRECT. IT IS AN UNFORTUNATE SITUATION BUT AS A BUSINESS OWNER AND INDIVIDUAL I HAVE DONE MY JOB FULLY AND COMPLETELY! THE VEHICLE IS STILL SITTING IN LOT AS WELL AS THE OLD ENGINE AND TURBO WHICH HAS TO BE RETURNED FOR CORES ARE SITTING IN GARAGE STILL AND THE REPLACEMENT ENGINE IS ALSO THERE. IN ORDER FOR ME NOT TO HAVE FURTHER EXPENSES I NEED TO BE ABLE TO SEND THE CORE MOTOR IN. IF HE CHOOSES TO PAY HIS BILL AND TAKE VEHICLE ELSE WHERE TO BE WORKED ON THE MOTOR IN IT HAS TO BE TAKEN OUT AND RETURNED TO [redacted] AS CORE FOR THE REPLACEMENT ENGINE OR AGAIN I WILL BE CHARGED. THERE IS ALOT OF OUT OF POCKET EXPENSES ON MY END DUE TO HIS BILL NOT BEING PAID AND THE BILL FOR CORES WHICH CAN'T BE RETURNED UNTIL THIS ISSUE HAS BEEN RESOLVED.ALOT OF TIME WAS WASTED DUE TO FACT THAT HE COULD NOT BE REACHED ON THE NUMBER HE PROVIDED ME WITH [redacted] AND IT WAS A WAITING GAME UNTIL CONTACT COULD BE MADE. I ALSO BELIEVE IT WAS DIRECTLY WRONG FOR HIM TO BRING SOMEONE ELSE WITH HIM TO NOT ONLY HARRASS MY EMPLOYEE BUT MYSELF AS WELL ESPECIALLY AFTER THE ENTIRE SITUATION BEING EXPLAINED MULTIPLE TIMES.
