I have received your letter regarding as recent complaint from a client of oursI apologize for the late reply; however, with the Christmas and New Years Holidays upon us, I was unable to respond soonerI just received your letters on December upon my return to the officeRegarding services we
performed for Ms***, I would like to address the issues per her, letter in order: We did not fail to complete any workMs*** became upset because the condition of her home is in very poor disrepair due to the fact it is over years oldWe were initially contracted to make some minor repairs to existing knob and tube wiring dating to the early 40's that by code should NOT have been in service prior to her taking up residence in the homeAdditionally, we were also contracted to enclose and sheath walls with drywall in a stairwell she contracted us to build and replace last year about this same timeThis is not the first time we have worked for Ms***We affected repairs after making MULTIPLE other repairs to wiring performed by contractors prior to our service workThere was no CONTRACT due to the fact that much of the work was "buried" and could not be adequately or accurate ly quoted without some demolition work to properly assess the scope of workThis work was done under a time and materials agreementHer claim of an "Original Contract" in the paltry amount of $is ludicrous and fi ctitiousI would NEVER have agreed to do the work for such a low amountThis statement is outright and was never agreed to by meShe DID however ask for a receipt for monies paid for which I provided her TWO: One hand-written receipt, on the spot, noting materials and labor charges incurred to that point with a VERBAL acknowledgement that it was not accurate until I could return to myoffice and generate a typed and itemized invoice after reviewing and tallying receipts for purchases, which completed that ve1y evening and mailed the following dayThe invoice was sent certified, signature-confirmation for which attempts were made by the USPS and she REFUSED service and delivery of the letterI have the unadulterated and unopened letter along with a duplicate receipt for a duplicate letter which was also mailed to her attorney which she invoked during SMS messaging conversationI also have a response letter in return from Mr*** stating his declination of service to her. Ms*** DID agree to purchase materials required, and did in fact provide somematerialsShe also paid some monies for labor and the additional purchase of materials by me on several trips I made to procure materials neededI had no problem with thatI did not in any form, fashion or statement ask her to purchase any materials which wouldn't be needed or used in her homeThis is again, patently and inaccurate on her partAdditionally, NO MATERIALS whatsoever were removed from her property or premisesAny accusation of such is again fictitious and and would be considered a dishonest and potentially libelous statement on her partWe did not "destroy" any areas of her homeYes, there were access panels cut into ceilings and walls NECESSARY to access wiring to effect repairs and replacementNO structural alteration was performed or incurred from any action we took in performing said work and any cosmetic damage would have been repaired during the completion of any work, had she retained us in doing soThere were in fact no perm its pulled due in pato a recent change by the town board and code enforcement officer for which we were unawareI have since spoken with the Code Officerand been informed of such changes on the town website but I STILL have not been able to locate themA call to the Code Officer has not yet been returnedIncluded with this letter will be our statement of charges and invoiceI don't know he she comes to the conclusion of "Bi ll of Charges"No extension cord or other property was removed from her premises or residence and she and her paramour collected our tools and placed them by the door for us to collectTo my knowledge, the extension cord was left in her mechanical room, N EA TL Y coiled on top of her paramour's dog kennelWe have NOT received "numerous" requests to return said extension cordI havehowever received numerous SMS messages to "contact her only through her lawyer"She has failed to take any calls, return messages, etc and has cut off all communication since In summary, her request in her complaint to you for a refund of $ to complete work by another contractor is summarily deniedWe are not in the business of paying another clients repair bills performed by another contractor not contracted by usAdditionally, we will not payfor a permit for work not performed by us or one of our contractors for which we are not the General ContractorAdditionally, we ARE considering litigation against Ms*** for theft of services and for libel and slanderMs*** owes our company an additional $for work performed up to November, Sincerely, Michael DK*** Owner-Contractorattachments included
