Complaint: I am rejecting this response because: I'm dissatified with his service he falsifed documents that was originally signed in July Saying that I agreed to the changes which I knew nothing aboutHe also wasn't on site when the workers broke the pipe inside the house before they start lifting the foundationThe next day when they start lifting the house they broke the front window paneThen when we notified them they stop and told me that they woukd fix the windowWhen they continued to lift the house the workers shifted the concrete and unleveled my garage door Sincerely, [redacted] ***

We have not falsified any documentation and we do have the original contract and attachments that she signed. We did provide the owner with a document showing two pilings that were put on the exterior of the home instead of the interior of the home and I initialed and put the date beside where the changes were made. These changes were necessary for our company to be able to correctly level the home. As far as the garage door being unlevel and unable to close, the owner needs to reread the contract. We are asking that the Revdex.com let us know what other information we can provide as to proof and our defense of this entire situation. When we left the owners home after finishing the job we agreed to do, the owner seemed happy and has paid us 1/of what she owes us and we are still waiting for the rest of the payment from her. We are willing to mediate to resolve this. Please advise

Before we started working on her home, we explained to her that there might be some pipes leaking underneath the home due to the interior slab being so off level. We also noted that there was a large crack in the garage concrete floor. We explained that we don't repair plumbing at our
cost unless it was due to our direct fault and also that we do not repair cracks in the concrete slab. We only relevel concrete slab foundations and can only do this where the slab is either thick enough to withhold the lifting or where there is a chainwall on the homes foundation. She signed our contract and one of the paragraphs that is also highlighted states

Repairs on electrical lines, gas lines, water lines, sewer lines, roof, sheetrock, and interior and/or exterior of home may be required due to stress caused from leveling the foundation. Any required repairs shall be at the expense of the owner
It also goes on the say that any damages directly caused by the contractor shall be repaired at the expense of the Contractor. This means that if we accidentally cut a pipe then we would pay for the repair, but if the pipe was broken due to the stress of lifting the foundation, or we intentionally cut it because it was needed for releveling the foundation, then we do not repair it at our expense. That being said, we were under the impression that she was having her pvc pipe in her restroom fixed at her expense due to the fact that on Thursday, September 11th, she had a man there that said he was a plumber and said he could fix it no problem. We were waiting for the repairs to the pvc pipe to be repaired so that we could finish our work which was to fill in the two holes inside her home where the pipe was located. The man that was at her home that said he was a plumber asked us not to fill the holes in until he could repair it.
On Monday, September 15th, 2014, we received a call from the city inspector of Beaumont that said that she wasn't happy that we didn't repair the pvc pipe and that there was a big crack in her garage. we explained to the inspector that her plumber was there on Thursday, September 11th and we were waiting for the repairs to be completed so that we could complete our work. We told him we would go out and take a look to see what was going on.
On Monday, September 15, 2014, we stopped by her home and talked to her. We explained that the pvc pipe was accidentally broke prematurely, but that we would have to have cut it in order to relevel her foundation correctly. We apologized and said that we would pay to have the pvc pipe repaired at our expense. We also explained to her again that the crack in her garage slab was already there and that yes, it did get about inch wider than it was before, but that we do not repair cracks in concrete slabs. We recommended that she contact someone who does lay concrete slabs and see what they recommended. We also explained that we releveled as level as possible the chainwall around the garage slab, but if we were to try to level the actual garage slab without using the chainwall that it would crack and bust much worse and still not be level. We also offered to drop the level a little so that the crack would be as it originally was. On our proposal/exhibit A that we provided to her and she signed, it clearly shows where the pilings will be installed and there were none to be installed in the center of the garage. This home was off of the level approximately inches with the worst area being in the restroom area of the home
On Tuesday, September 16th, 2014, with her permission, we scheduled for a plumber to go out at our expense. When he arrived at her home, he noticed that he would have to break some concrete to be able to repair the pvc pipe correctly. He told her that he would have to get additional tools/materials and that he would return the next day
On Wednesday, September 17th, 2014, the plumber returned to her home and started breaking away some of the concrete that was necessary to repair the pvc pipe. She brought it to the plumber attention about some pipes that were dark underneath the slab. The plumber said when he touched one of the cast iron pipes, it was rotten. He was going to repair as much as he could at no cost to her of the cast iron and he was going to repair the pvc pipe at no cost to her. She refused and said she didn't want him to repair anything because she wanted a couple of other opinions
We are and were wanting and ready to pay for the pvc pipe that was broken prematurely and that is why we sent a plumber out to do the repairs that he wasn't allowed to finish and yet we still had to pay him for the hours of labor for breaking up the concrete to get to the pipes. We will not pay for rotten pipes. Rotten cast iron is not due to having the home releveled. As soon as the pipes are repaired, we can go finish our work. All of our work that we agreed upon is completed except for the two holes in the restroom area that we cannot fill in until the pipes are allowed to be repaired

He also wasn't on site when the workers broke the pipe inside the house before they start lifting the foundation. The next day when they start lifting the house they broke the front window pane. Then when we notified them they stop and told me that they woukd fix the window. When they continued to lift the house the workers shifted the concrete and unleveled my garage door.
