In response to this complaint, M&M Property management recently took over HOA management for the Northgate village HOAThe complaint filed is in regards to a transaction which took place on Dec 26, 2013, during the tenure of the prior management companyM&M Property management did not
start managing this association until Jan This complaint should be filed against the prior management company *** Management On May 13th we were contacted of the issueWe requested copies of the cancelled check as the ledgers provided by *** did not reflect the paymentOn May 16th we closed the ticket as the homeowner had not responded further to our inquiry (ticket ***)On May 16th a new ticket *** was opened by the homeowner with the same requestOur office responded on May 17th for copies of the canceled check, so we could research the matterThe homeowner submitted a copy of the cancelled check on May 17th and the check was made out to *** Management and not the association and showed that it was deposited to an account number not belonging to the associationSince M&M did not manage the HOA at the time this deposit took place and since we do not have access to ***'s accounts, we were unable to research this furtherFurthermore, since the check was made out to another company we were unable to validate if the check was in fact for the associationAs the funds were not received by the association, we were unable to reflect the deposit to their accountWe directed the homeowner that this was something out of our controlAs a courtesy, we sent the information we had to *** on May 17thOn May 17th *** responded stating that they no longer manage the association and could not provide assistanceOur office escalated this matter again to *** on May 18thOn May 25th we received a response from *** stated that due to an error on their end it was deposited to another owners account.However, the information to which *** provided does not match the ledger data so we have followed up for them to provide additional information (ticket ***)

M&M Property Management is the management company for the *** HOAWe took over management on 6/1/The respondent does in fact have their home for saleTheir title company ordered a status letter through a third party vendor called *** on 6/16/at 8:12am The
completed status letter was delivered the same day 6/16/at 1:59pmThe order was not due until 6/23/The lender ordered a custom questionnaire on 6/16/at 8:41pmThe order was completed on 6/20/at 10:00pmThis was also ordered through the third party vendor ***It is our understanding that due to the financial position of the HOA as they have a revenue loss in 2016, the lender was unable to fund the loanTherefore, the buyer had to secure another lenderIt is our understanding that the buyer of the unit is the same and in our last conversation with the lender and title company, the due diligence process with the bank is still in processM&M Property Management is not responsible for the decisions of the HOA board and how they spend their fundsFurthermore, our company was not employed during this period of time when any financial decisions were madeThe requests to deliver the status letter and questionnaire were handled through a third party vendorThey were delivered timely and prior to the agreed upon deadlines when the order was processed

M&M Property Management is the managing agent for Town Center Terrace ("the Association")M&M Property Management works at the direction of the board for the association and has no authority in its decision making processTherefore this complaint should be against the Association and not
M&M Property ManagementThe owner(s) moved into the association accepting the covenants and restrictions of the associationIn these documents they agreed to an obligation to pay their monthly assessments per the collection policy regardless if a statement is received or notThe association did transition management companies in Sept Physical mail as well as emails were sent to all residents of the associationThe address of *** *** ** *** ** *** is the address the association has on file and where all correspondence were sentAdditionally an email address of *** was on on fileThe association sends statements via email monthly to all residentsIf an owner requests coupon books those are available and the information was made available in the transition letterA website for all owners is also available to pay online, print statements and/or couponsThe association in light of the transition did not start to enforce late fees until January to give owners ample time to adjust payments from prior managementPlease note that all mail was forwarded from prior management so any payments sent to prior management were received at the M&M officesOn 2/1, 2/15, 3/and 4/delinquency notices were sent to the address on file notifying the owner of the delinquent balanceOn 2/a call from AFC realty & management stated that they represented the owners and were responsible for payments, as the owner received a delinquency noticeOur office stated to the caller that we required permission from the owner and we would be happy to add them to the account once this occuredThey stated that they were aware and familiar with this and that the owner would send a request in writing to our officeOn 2/Crystal schmitt contacted our office (ticket ***) and authorized AFC Realty to be added to the accountNo contact by AFC or the owner occurred thereafter and no payments were sent to the officeDelinquency notices continued per the collection policyOn 4/the account was turned over to the association collection attorney, *** ***Once an account is referred to the collection attorney our office is no longer able to speak to that account regarding their balance dueOn 4/Crystal Schmitt contacted our office in regards to her balance owed and our staff directed her to contact the collection attorney *** ***As of today, 4/no payments have been receivedThe association has made efforts above and beyond the collection policy to notify the owner of there account balanceThe owner has an obligation to pay monthly assessments, which they have notAt this time the owner must contact *** *** to resolve their account balance*** *** may be reached at *** ***

This is a duplicate complaint from the same person. We do not find it necessary to respond
