Contracted for a 1 year Service Agreement for my home heating and air conditioning system. The agreement included seasonal service and inspection. Upon the company’s first service they informed me that my Heating/Air Conditioning unit was leaking Caron Monoxide and posed a safety risk. The technician damaged the unit by cutting wiring to the thermostat leaving my apartment with no heat during the cold season. The company also pressured me to replace the unit as soon as possible, which I had to do because the cold temperatures left my apartment uninhabitable considering the temperature. I contacted two other HVAC companies in the area and had the unit repaired as the unit was NOT leaking posed NO safety risk. The unit was aging and in need of repair, but the claim that the unit was unsafe and needed immediate replacement was a blatant exaggeration and lie in an attempt to pressure me into a higher priced repair. I was able to have a component of my heating and cooling unit repaired for 1/5 of the price I was originally quoted.

M & Mhvac Response • Dec 17, 2019

We are responding to an email we received concerning the customer complaint above. There are several items listed by the consumer that are either unclear or inaccurate asfollows:

-We have serviced this customers system several times and this is not our ?rst visit to thesite. Including their MA service for the Spring of 2019 & Fall‘of 2019.

-At the time of the Fall 2019 routine service visit on 11/07/09 (not 11/01/19 as stated inthe complaint) our technician noticed erratic operation of the furnace which led toadditional diagnosis above and beyond the service agreement. Upon removal ofadditional panels to inspect a suspected bad heat exchanger, our tech took photos/video ofseveral holes in the heat exchanger that allow the products of combustion to leak into thehome including CO2 Carbon Monoxide which we all know can cause serious heath risksor even death. Therefore, our technician called me, the owner of the company, to informof the issue and the dismantling of the system from operation until the system wasrepaired or replaced. (RE: referenced in his response of “removing wires from thethermostat leaving the apartment with no heat").

-He states the company pressured him to replace the unit ASAP- Of course we wanted torestore heat to the property ASAP and it was a Friday and I reached out to the owner toinform him of our ?ndings and that due to the leak in the heat exchanger, it had to be shutdown and not used, and the options were to replace the heat exchanger or replace thesystem. Our recommendation due to our experience with these type of combinationunits, was that it has the heating and air conditioning all in one unit and due to its age wewould recommend replacement of the whole system including the furnace & AC systemand a new factory warranty which should provide several years of trouble free operation. He asked us to email a proposal for that option---NOT for a heat exchangerreplacement option.

-Within one hour I was in touch with the owner advising him his options and reached out to our supplier to have a proposal, availability and our scheduling availability to theowner for the following week. He asked us to wait -- called back shortly thereafter with the authorization to move forward with the replacement and get the unit ordered. The unit was ordered from our vendor following our conversation awaiting Monday or Tuesday delivery. Our of?ce then received a phone message from him later the afternoon of 11/08/19 to put the install on hold and that he found someone to install the new unit sooner.-I also asked if he had some temporary heaters and he replied with no, and I said we have some if needed.-Again, he states in his complaint he contacted (2) other heating companies in the area and they stated it was “not leaking and posed NO safety risk." Since he did not share what they repaired I don't know if the heat exchanger was replaced or not? OUR BIGGEST CONCERN AT THIS POINT IS THE SAFETY OF THE TENANTS AND THEIR FAMILIES, IF THE HEAT EXCHANGER WAS NOT REPLACED AND THE FURNACE WAS RESTARTED AND THE PRODUCTS OF COMBUSTION INCLUDING CO2 ARE STILL LEAKING INTO THE HOME!!-We don’t see how anyone was pressured into anything and it appears this homeowner/landlord may have a heat exchanger leaking that we shut down (disconnected wires to make the system inoperable) for safety and tenants living in an unsafe place.-As far as the $53.50 he is asking for. Not sure where that is coming from as his MA agreement was a lot more than that and we provided the (2) services under the MA agreement. They did however have us clean the dryer vent separately at the time of spring 2019 service and paid an additional $53.50 for that.-We also have an outstanding amount still due for the additional charge from this customer for the additional costs in diagnosis of the leaking heat exchanger that is currently unpaid & not covered under the terms of the MA agreement.-Based on all the above information being accurate and correct to the best of our ability, there also should be no reason for an apology to the homeowner as well, but an apology from the homeowner for our accuracy in ?nding the leaky heat exchanger and doing the job that all of our other customers would expect and appreciate. He obviously NEVER reached out to us for con?rmation of our diagnosis, proof of diagnosis, or asked for a refund or we could have provided him with the same information that we are providing to the Revdex.com.

Respectfully submitted
