Review: I bought a motor from mst recycling with a six month warranty. the motor has not been put in my vehicle yet so I could put as many parts on as possible before hand. the motor I bougt the cam shaft wont trun its stuck. I took the motor back to them thats on six month warranty, they would not fix or exchange the motor, saying the warranty is void because I had to have bent a rod or something to that effect by installing it in my vehicle. I never put the motor in my car me and my brother put a new timing belt on the motor and it would turn in my shed with the rest of the parts, we tried cranking it by hand with a wrench. before I took the motor back to them I gave them a call with a heads up about my problem. they said as long as I didnt put the motor in my vehicle and turn it over they would honor the warranty, this was not true because obviously the did not honor it and im asking for your help. I bought this motor 4/10/15 I took it back 4/16/2015 well in the time frame of the six month warranty.Desired Settlement: I would like a motor that is in sound working condition, or a refund of the $1,139.25 that we spent on the motor. specifically with a warranty in case something like this happens.

Review: PURCHASED A 2001 MITSUBISHI DIAMANTE TRANSMISSION FROM THIS RECYCLING YARD FOR A CUSTOMER'S CAR. THE TRANSMISSION WAS INSTALLED BY THE CUSTOMERS MECHANIC. ONCE INSTALLED THE CAR WAS SHIFTING AS IF IT WERE A MANUAL TRANSMISSION. THE CUSTOMER TOOK THE CAR TO A TRANSMISSION SHOP WHO ALSO TOLD HER IT WAS THE INCORRECT ONE, IT HAD THE WRONG GEAR RATIO, NOT SHIFTING AND NUMEROUS CODES. TOOK THE TRANSMISSION BACK TO THE RECYCLING SHOP WHO GAVE US A 2ND TRANSMISSION. THIS 2ND TRANSMISSION DID NOT HAVE THE CORRECT COMPONENTS IN IT EITHER, SO WE RETURNED IT TO THE RECYCLING SHOP WHERE IT WAS PURCHASED. THEN THE RECYCLING SHOP WAS SUPPOSED TO HAVE REBUILT THE TRANSMISSION AND GAVE US A 6 MONTH WARRANTY. ONCE AGAIN THE TRANSMISSION WAS INSTALLED AND AGAIN WAS NOT RUNNING OR SHIFTING PROPERLY. THIS TRANSMISSION HAD ANOTHER PROBLEM, THE CUSTOMER TOOK THE CAR TO THE DEALERSHIP WHO DIAGNOSED THE TRANSMISSION AND STATED IT WAS THE INCORRECT TRANSMISSION FOR HER CAR. THIS TIME MY CUSTOMER WENT DIRECTLY TO THE RECYCLING YARD WHERE THE TRANSMISSION WAS PURCHASED, SHE EXPLAINED TO THEM WHAT THE DEALERSHIP SAID AND THE RECYCLING SHOP TOLD MY CUSTOMER TO TALK TO MY SHOP ABOUT IT. MY CUSTOMER CAME TO MY SHOP AND LET ME KNOW WHAT THE RECYCLING SHOP HAD TOLD HER. I CONTACTED THE RECYCLING SHOP WHO WOULD DO NOTHING ABOUT THIS PROBLEM. THEY WILL NOT TAKE THE TRANSMISSION BACK NOR WILL THEY GIVE ME BACK MY MONEY. THEY HAVE DONE NOTHING ABOUT THIS! SINCE THEN, WE DID DO THE RIGHT THING BY OUR CUSTOMER; WE PICKED UP HER CAR, TOWED IT TO OUR SHOP, AND REPLACED THE TRANSMISSION WITH THE CORRECT TRANSMISSION FOR HER CAR. MY CUSTOMER SPENT OVER $3000 BECAUSE OF THIS RECYCLING SHOP. [redacted]Desired Settlement: THE RECYCLING SHOP SHOULD HONOR THEIR WARRANTY. THIS HAS BEEN GOING ON SINCE AUGUST 2015. I WOULD LIKE THE RECYCLING SHOP TO MAKE THIS RIGHT. ISSUE ME A REFUND FOR SELLING ME A TRANSMISSION THAT DID NOT FIT MY CUSTOMERS CAR. MAKE THIS RIGHT!

Response:

our warranty is 6 months on used parts sold. we still stand behind out warranty and will honor our warranty. there was never a mention of a rebuilt transmission to replace the used unit. we had a replacement used unit but [redacted] didnt want another transmission, they wanted a refund. out invoice clearly states 6 month part warranty but NO refunds. We didn't deal with the customer when they called, as we didnt sell the transmission to the end customer. it was sold to the other wrecking yard [redacted].

Review: I bought engine for my truck for this company and the mechanics installed the engine when he installed I noted something wrong I get back to the mechanic and he told me something was wrong with the engine I let know and they told they don't have time to check the engine but I always insisted and be end they told me they going to check the engine and had to bring it to shop to fixed on January 22, 2016 I call them and they told they are busy and I need to wait more, finally they call me and get the truck to fix the engine for two week I brought in to shop. Two week later they call me and told me to pick up engine with truck tow and they going to put my truck out side the shop because they found the mechanic installed wrong a hose they took out the engine. This Monday when I call them they told me they don't going to fixed and I have the option to buy a new engine for 2,000 . I don't agree with this because I don't have transportation for work and I need to still pay insurance they have to fix my truck and put my truck back to work. I need my truck ranDesired Settlement: Just to get it repaired!

Response:

we stand behind out product with a 6 month warranty for used or 12 month/12k mile warranty for rebuilt.

the customer or mechanic didn't fix the original problem of why the customers original engine failed or they mis-installed the replacement engine, causing the engine to be overheated.

we do not warranty overheated engines. we install heat tabs on all our engines and they melt at 260deg F. --engines overheat at 220 deg and above.

this engine has the heat tabs are clearly overheated on this engine thus voiding the warranty.

Consumer

Response:

I am rejecting this response because: as stated by the company "the mechanic... mis-installed the replacement engine, causing the engine to be overheated." As previously stated I, Jorge Mendoza, went back to complain about the mis-installment. Hence, the company needs to be held accountable for not fixing the issue when I first addressed it. It was their mistake upon installation and needed to fix the the problem. As a result from their mistake of mis-installation the engine overheated thus are accountable for the engine overheating and need to uphold the warranty for it was their mistake upon installment.

Response:

we did not install the engine in the customers vehicle. the heat tabs are melted on the engine. heat tabs melt at 260 deg. as stated in our warranty on the receipt(see attached), we can not warranty engines if they have been overheated.

Review: I paid for the engine out of a limited edition car that M&S Recycling advertised on their website. They don't have the car and won't refund my money.

On 7/9/13, an internet search brought me to msrecycling.com, the website of M&S Recycling in Rancho Cordova, CA. They advertised that they had a 1991 Mitsubishi Galant VR4, the limited edition, turbo, awd, aws model of which only 5000 were ever made. I have the same car and wanted the engine out of it so I called them.

I spoke with [redacted], the owner. I confirmed with him that they had the car and then he asked me what parts I needed? I told him I wanted the engine and he said $950. I told him I'd call him right back.

I called back 5 minutes later and a different employee, [redacted], answered. I told him I wanted the motor out of the Galant VR4 and was able to negotiate the price down to $800, plus $100 core charge. He told me I'd need to pay cash and then wait 24 hours to pick it up. I told him I'd be in the next day to pay for it.

On 7/10/13, at approximately 12:30pm, I went to M&S Recycling. [redacted] was working. I paid him the $900 and he gave me a printed receipt for $800 and a hand-written, signed receipt for the $100 core charge. He then told me to come back in 24 hours and they'd have it ready for me.

The next day, 7/11/13 at approximately 2pm, I returned to M&S Recycling. I was told that I'd have to wait because the motor wasn't ready yet.

After waiting for 2 hours, they were still working on it. I requested to go see the car to see if there were any other parts that I might like to purchase while I was there.

[redacted] eventually let me into the shop area and a mechanic showed me to the car. He took me to a 1990 Mitsubishi Eclipse. One mechanic was working on removing the motor. I told him that it was the wrong car, took a few pictures, and returned to the counter to see what happened.

[redacted] explained that they had actually already sold the VR4, motor and all, and that the Eclipse motor would bolt right in and work just fine, I wouldn't even know the difference.

I tried to explain that I was restoring a limited edition car and that I didn't want to mix in parts from other models because the stamped serial numbers would indicate that I did so. I asked if they had a 1991 Galant VR4, as was advertised online, as [redacted] had confirmed on the phone, as was listed on the receipt. The answer was no.

I told [redacted] that it wasn't what we agreed upon and that I wanted my money back. He refused. He stated that there were no cash refunds because it said so on the receipt and on the sign on his wall. After pleading for approximately 20 minutes with him, it became apparent that he wasn't going to refund my money.

I asked one more time, "Are you sure you won't give me my money back?" He refused and I left very upset, without my money or the motor.

I returned the next day, 7/12/13 at around 1:30pm, in hopes that [redacted] would realize that he was wrong and reconsider. He agreed to talk and offered a partial refund minus a restocking fee of 25%, which I refused.

I confirmed with [redacted] that he was the owner of the company and that there was nobody else that I could talk to. I warned him that I would sue him for the $900, plus court fees, plus lost wages, that I'd damage his reputation every chance I got, that what he was doing was wrong, and that it wasn't worth it. He said "Go ahead, it won't be the first time." Maybe not, but hopefully it will be the last.

I didn't know what to do. I felt violated, cheated, and ripped-off. I was shaking mad and had to leave before I lost control.Desired Settlement: I want my $900 back.

[redacted] thinks I should at least pay for labor. This solution doesn't work for me because [redacted] has wasted nearly 5 hours of my time so far, which is worth every bit as much and more than what he pays his mechanic, who spent about 2 hours removing the wrong engine, on [redacted]'s orders.

Business' Initial Response

In response to the complaint filed by the customer, we did not mislead him in any way. No Refund is due in this case. The only circumstance we will provide a refund, is when we are not able to provide a part or parts, in a reasonable time, on a warranty claim, which will work in the particular application.

Consumers call in asking for parts for their vehicle.

We look them up by application according to year, make and model of the vehicle they are searching. We look the parts up in our database and the program we use, can identify the interchangeability of the parts they are in search of for their vehicle.

In this case the customers vehicle, a 1991 Mitsubishi Galant VR4 turbo, has the same identical engine as a 1990-1992 Mitsubishi Eclipse turbo. The ONLY difference in the engine purchased, is the actual VIN # stamped on every engine matching the particular vehicle is was assembled at the manufacturing plant. Every engine and vehicle having a unique Vin # for obvious reasons.

We did not say the engine came out of the exact vehicle from the car listed on our website, as the engine from the vehicle list had already been sold.

The particular engine the customer purchased was removed from a 1991 Mitsubishi Eclipse turbo and was run tested and is sold with a 6 month unlimited mile replacement warranty from defects. The vin # from the engine purchased does not match the customers car, nor will any engine from ANY car, except the original engine the car was sold with when the vehicle was purchased new.

The showroom in the business has a clear sign posted behind the sales counter stating "NO cash refunds". Also stated on the invoice provided to the customer is the warranty and same no refund policy.

The engine the customer purchased, will function/perform/ and look exactly like the engine in the customers vehicle before they started having issues with it.

Our position is the customer should not get a refund due to the engine not being removed from a certain model car or buyers remorse.

Sensing the customer was clearly upset even after explaining the interchangeability of the engine in question, a refund minus a 25% restocking fee was offered to the customer, but he declined.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

This is a scam. I absolutely do not accept this response.

It is very important that the vin number matches the vehicle, this is a collector's item. I'm not interested in the motor that M&S Recycling pulled out of the Mitsubishi Eclipse, those are a dime a dozen. I'm interested in one of the 3,000 motors ever made that matches my car, the motor that they said they had, the one that they advertised, the one that I paid for.

In the meantime, I'm still out $900, which is extremely frustrating.

Business Response

The customer has agreed to take the engine and complaint should be resolved.

please email me if you need any other information regarding this matter.

thanks you!

Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

I was forced to find a new buyer for the engine. My time and money has been wasted. I strongly advise anybody reading this to avoid doing business with M & S Recycling. Their business practices are dishonest and their management is completely unreasonable.
