Mac Stanley & Co

Review: On 4/5/13 my company entered into a contract with Mac Stanley & Co., LLC, for graphic design work. We paid $1500 to them for their services. In a meeting on 6/20/13, [redacted] (proprietor of [redacted] guaranteed that final logo designs would be delivered to us by 6/28/13.We received no such designs by the deadline and, beginning on 7/2, we began to request the work in earnest from Ms. [redacted]. On July 2nd, 6th, 10th, 11th, 15th, 16th, 24th and 25th, we notified Ms. [redacted], in writing, of her failure to deliver the work and requested that she do so. Each time we were either ignored or offered excuses (literally every dog-ate-my-homework-excuse you can imagine), never acknowledging that she was past deadline, always insisting that the work was done long ago and there was some technical problem sending it, and she'd send it again "tomorrow" (always tomorrow). For some reason all of the emails with her excuses came through just fine, but never the emails she claimed to send that contained the work she had supposedly done for us. Nearly a month after the deadline, on July 25th, we demanded that Ms. [redacted] send all work she had completed thus far. She refused and, saying we were "yelling at her" (all of this correspondence was by email), she said she no longer wished to work with us and that we could not use any of the work she had done so far. We asked her to return our money at that point and she said she must discuss it with her lawyer. We told her to contact us when she had determined what she was going to do. She did not contact us and so we again contacted her and notified her of our intention to pursue the matter in court if she did not refund our money. As incentive to avoid litigation we offered to accept a settlement of $1000 (2/3rds of what we had paid her) if she returned our money by August 26th. On August 27th Ms. [redacted] wrote requesting our address so she could send us a check that week. It never came and we've subsequently heard nothing from her.Desired Settlement: Given that Ms. [redacted] failed to provide the services we contracted her for, and then summarily terminated our contract, we expect a full refund of the money we paid her, $1500.
