As you can see, Mr*** *** has indicated he will decide when he arbitrarily returns our money as he sees fitWe are not accepting his plan of reimbursementWe can not allow him to decide each month whether he will return our money or not He has admitted he rented the units out to other people for June and July.By sending the first refund check for the month of June for two units he has shown that he is obligated to return our money His terms are that he will return our money only if he can rent the units out to other tenants in future monthsNo where in his contract does it state that he can keep our advanced money so we want the entire sum of the money we advanced to MACSMACS is in breach of our month-to-month contract. Our next step is to file a small claims case against Mr*** ***, Mr*** *** father and the owner of the company. I appreciate the Revdex.com's assistance in getting Mr*** *** to respond in writing to certain statements he has made and I now have those documentedI don't know if any further back and forth will help us resolve this matterI will rely on the Revdex.com as to the next steps we need to follow.

Regardless of whether or not you agree with the terminology
of our contract, the fact of the matter is a refund has and will be issued monthly for
each unit that is re-rented, thru November 2015 . We will be unable to refund
the entire amount in a lump sum unless a new tenant agrees to pay for a lump
sum as well
In response to your statement of us leasing out “Your” units
to new tenants; why wouldn’t we be able to do so? If the units are still considered “Yours” in
the sense that you’re still occupying them; then why would you receive a
refund? If you’re not occupying the
units any longer, which you stated you are not (hence the demand for the
refund) then why is it unacceptable to rerent the vacant units? As stated in our
previous response we will and are refunding your rent refunds monthly as long as we have
renters for those units.
As you stated, we have sent a refund for two of the units to
your attorney; then how are we keeping your money? Please provide some
clarificationYour July refunds for all units have been received by your attorney via certified mail as wellThank
you

MACS Mini Storage has stated that a clause in the contract allows him to keep our advanced paymentThe contract states that the prorated amount to the end of the month will not be returnedWe are not asking for the prorated amount we are asking for the months the units were vacant and prepaidTwo units from June to November and two units from July to November. MACS is trying to receive undue enrichment by keeping our moneyThe representative of MACS, *** *** has decided to send us a refund each month we prepaid for ONLY if he can rerent the unitsHe sent a check to our attorney for a refund of the two units we vacated at the end of May which means he rented our our units!! He has allowed others to move into our unitsWe do not accept these terms and want our FULL refundHe has indicated in his response that he has allowed others to move into all four of our units for JuneWe are outraged that he is keeping our money and renting our units to others
