I purchased a brand new machine. Salesman named Justin. I have been home for two weeks sick with the flu. I called and spoke with a gentleman. He told me all about the machine it had 4.5 hours on it. The hours are from the factory testing it. Insured me he inspected it himself perfect condition. We made a deal. He did all the paperwork. I don't even have a copy yet. I sent a truck to go pick the machine up. I also have a house in Naples Florida.He knew I was sending the machine to New Hampshire. The truck was to drop the machine off. The salesman Justin Follow the truck driver back to my 2st house Naples FL.When I seen the condition of the machine my stomach dropped .I was already sick with the flu. The machine has scratches all over it. The door does not open from the inside. You cannot get out. There was a big scratch across the door right to the rubber molding which was ripped open. The truck was also ripped open. There was no antifreeze and the hydraulic oil Was extremely low. The machine had 14.8 hours on it. Completely filthy inside. I have all the pictures and documentation to prove it. At this point He started to explain have no worries we will take care of every issue totally apologized never inspected the machine for me. The next day sent me text messages which I have stayed in the owner approved to replace all damaged parts drop them at my house in Naples. Which I could load in my truck and take up north. He shook my hand promised me I was all set! Text me he would be back to me Thursday to let me know when parts will arrive the machine arrive Friday the earlier week.The finance company called me on Tuesday I explained everything to them damage on the machine. But they stated they would replace everything which I have any text messages. When I called him on Thursday no one would answer the phone. I realize the machine had already been funded. I text him a couple times he told me to stop harassing him and call the service department. I did I spoke with the manager he started to argue With me and hung up.Not enough room for me to explain the whole story. Nevertheless I was ripped off $64,000. For a used machine.

Desired Outcome

Other (requires explanation) All I want is the track I was promised.The rubber around the door. A new door latch. Some spray paint the same color as the machine to try to Repair it. And one of the decals has a big scratch in it they said they would replace that. Now they don't answer the phone anymore. I text him a few times told me to stop harassing him and call the service department which the manager had already hung up the phone and told me he won't deal with me. Said he listen to me complain Long enough. The deal is Funded and they won't even speak to me. I would not let them touch the machine if they paid me. All I want all my parts that I was promised and I have text messages stating that. Need help!

My name is Sandro Muniz I am the Service Manager for MacKinnon Equipment in Lehigh Acres, FL. I did speak with Mr. regarding the condition of his machine at the time of delivery. Regarding his discussion with Justin the salesman I am unaware of any conversations or agreements made.

Mr. and I discussed his concerns with the machine and the condition it was in when it was delivered to him. We did discuss the issues he had, and I explained I would need to get authorization to get this corrected. I spoke with Chris *** head of JCB sales for our company. He instructed me to get a track ordered to replace the damaged track, door trim and decals. I was also instructed to open a work order for warranty to get the door repaired or replaced.

I again spoke with Mr. I believe for over 20 minutes most of which was Mr. giving me a background on his companies he owns, other dealings with equipment companies and degrading our staff and company. I explained we would take care of the repairs, but the repairs must be completed but a JCB tech. He stated that was not an option as the machine was leaving for NH the next day. Which is not true the machine is still sitting at his home in Naples Fl as we have JCB Livelink (GPS) on the machine. He began to get combative and use profane language when told I could not just ship parts to him, we had to perform the work.
He began to call our company crooks and called me a liar when I explained the door opened for the tech, delivery driver and I here at the shop. I also explained how we possibly missed the tear in the track and the customer called me a liar and began to state that was bt. I did explain to Mr. I did not want to continue our conversation, but I did not hang up on him. The reason for me ending the conversation with Mr. was him threatening my technician with physical violence if he touched his machine or showed up to work on the machine. I felt at that time I needed to end our conversation and push it to Upper Management to Chris *** which I did.

Per the customers desired resolution, we agreed to do everything he asked, most of which is covered under warranty; otherwise we the dealer would cover at no cost to him. Per the manufacturers policy, we the dealer must perform the warranty work on the unit in question and send back all defective parts for inspection. The reason none of this has happened yet is the fact the customer will not let us have the machine to work on.

Below is a snapshot of the location of the unit per the installed GPS, the unit was not moved out of state as the customer was claiming was the only reason, he could not let us have it to work on. Customer is currently running the machine in the Naples area.
