Mexican Restaurant in Madera gave a 30-day notice to vacate the storage facility and were told if we vacated by March 10 th that we would be able to have our rent prorated for that month. We paid the full rent at the first of the month and they deposited the check. We proceeded to vacate the premises on Monday, March 9th and advised the manager ***. She verified that we had indeed vacated. I called twice on Tuesday the 10th to try to get the prorated issue resolved. The last message I left at 2:10 pm I also left my personal cell phone as I work 6:30-3:30. *** called the Corporate Office at 5:41 pm and stated I had until 6:00 pm to call her back or they would not prorate the rent. I called on the 11th and spoke to *** and her "Supervisor" *** and they refuse to refund the balance of 65.16 due for the month of March. I realize it is not a lot of money but now it is the principle of the matter.

The Customer called back in Feb to inquire on the move out procedures, but never submitted the Intent to vacate form (Required from Tenants that are moving out). The Tenant never provided us any notice of the intent to vacate the unit. On March 9th we never received any notification from the Tenant that they had vacated the unit (by phone or in person at the office). If the Tenant had come into the office on the 9th we would have walked out to the unit to verify the unit was empty, broom swept clean & lock removed from it. Once that process had been completed we would have proceeded to process the move out on the 9th & if the Rent had not been paid we could have pro-rated the rent for the Tenant & collected the final payment at that time, we could have even taken the payment over the phone (final pro-rated rent). But they never came into the office or called us on the 9th. On the 10th of March we collected the mail & processed all payment that were received, this Tenant was included in those transactions, later that morning during a facility walk it was identified that the unit was empty & it appeared that the Tenant had vacated the unit. Our property manager attempted to call the Tenant & left a message to return our call regarding the unit. Later in the day our property manager called again & left a second message for the Tenant to return our call prior to close at 6pm. On the 11th of March the Tenant returned our call & we informed them that we had not received any vacate notice from them & when there check came in the mail it was processed as a normal payment, if we had been able to reach them the day prior (Same day the check was processed) we could have reversed the check & taken a payment over the phone for the pro-rated amount & completed the move out process, (We only offer a pro-rated rent up to the 10th & only if the rent had not been paid for the entire month), we do not offer refunds on rents paid (exception is if a Tenant paid rent in advance & had fully pre-paid an entire month’s rent & moved out prior to that month). We contacted *** today March 17th & offered to have her complete a refund request for the balance of the rent paid $101.00 (Pro-rated) making an exception for the Tenant, but due to the Tenant putting a stop payment on the check we would not be able to move forward until we have verification that the check had cleared the bank. *** was admit that she be refunded for the $101.00 paid & all returned check fees be waived. Until we have verification that the payment has posted & the payment cleared the Tenants bank we would not be able to submit a request for a refund based on a pro-rated rent on the 9th. We value our relationships with our Tenants & strive to make the storage process as simple as possible for our Tenant when moving in & during their stay & when they make the choice to vacate.

I am rejecting this response because:Their account of the events is not true.On 2/7/2020 I did submit a 30 day notice in writing via email to ***@gmail.com and verified with *** the next day via telephone that it had been received.On Friday 3/6/2020 I called and spoke with *** about pro rating the rent and she stated we had until the 10th to vacate to prorate the current months rent.On Monday the 9th of March the premises were vacated, two of the Managers *** and *** went in and advised *** that they were out.I called and spoke with *** 3/9/2020 as well and *** confirmed two men from *** had stopped by the office and told her the space was empty. *** called me at 12:40 and I was on sit of one of our restaurants, I called back and received their answering machine at 1:10 and 2:40. At 2:40 I left a message stating we closed our office at 3:30 to please call me on my personal cell ***. I did not receive a call but when I got in the next morning there was a message from *** left at 5:41pm stating that if she did not hear back from me by 6:00pm that we would forfeit our right to pro rate March's rent.I called *** 3/10/2020 at 9:20 regarding prorating the rent. She said she had received the full amount of rent in the mail and there was nothing she could do, could not even refund the remaining amount. I asked to speak with her supervisor *** and *** stated it won't do you any good, he is going to tell you the same thing I am. I spoke with *** and he did tell me the same thing, no refund on the full month paid and processed. I told him that was unacceptable, and he said there was nothing he could do. I then said I was going to lodge a complaint with the Madera Revdex.com, *** stated "Go Ahead." and hung up on me.I stopped payment on the rental check of $101.00 since it had not cleared our bank yet, I called *** and advised her of that fact. I also told *** as soon as I received confirmation of the stop payment from our bank I would send a prorated check amount of $32.58. She then stated that a stop payment would result in a bank fee on her end, I then said something I m not proud of. I advised her that I had given them plenty of chances to work with me, maybe they should have worked with me then. I am not proud of what I said but at that point I was beyond frustrated.

Thank you for the response, as indicated in the prior response we are prepared to issue a refund request for this Tenant. In order for us to process the refund request we need to verify the payment that was processed $101.00 (Tenant placed stop payment) on 3-10-20 has cleared, then we will be able to submit the refund request for the pro rated rent up to the 9th of March.

I am rejecting this response because:
We have already stopped payment on the rent, and proceeded to cut another check for the prorated amount.As far as I am concerned I had to resolve it on my end and we will not pay for stop payment fees on their end.
