I bought a car from them on August 20th, and on the 23rd the car broke down due to transmission problems. I purchased a car from Magic Fuel in Leominster, MA on [redacted] The car according to the salesman was in perfect condition. Apparently not, because the car broke down on [redacted] a day after I registered, insured, and prepared the car for the road. The owner at first did not want to do anything with the car, because according to the law, I was not covered.Desired SettlementI am seeking loss of wages, a refund, and fees paid to the state including registration and taxes. I would also like my deposit paid for insurance. Business Response The customer called on the weekend after hours and demanded we do something for his vehicle. The sales rep told him to call on Monday during business hours and that we would take care of his vehicle. The following week we replaced the customers transmission with one of equal or greater value as required by law and did not charge the customer anything. As a motor vehicle dealer we deal with used cars and the car was fine when it was purchased and the customer went for a test drive as did we numerous times before listing it for sale. But it is a used car and problems can happen at anytime as anybody will tell you, but we did take care of the vehicle in a timely manner and hopefully with that service and the quick response time we can be cleared of any wrong doing and keep our untarnished reputation. Please get back to me in any way to make sure this matter is settled and closed thank you.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I appreciate the response, but a car should not break down three days after purchase. I needed the car to go to work, which I could not do. As a result, I lost several days worth of wages. I also requested a refund for the car since state laws states that if the car does not pass inspection within 7 days of purchase, you are entitled to a full refund. I did not want the car to be fix, and they simply gave me no other choice. Now I'm stuck with a car with an old transmission that may soon break.

I did not receive a promised refund of [redacted] after a re-test at a state inspection site. This business charged me twice, then did not issue a refund.I went to this business to have my car state re tested. I was within my 30 day window and had been there a couple weeks before. When I was at this business a couple weeks before, they gave me a rejection sticker and billed me [redacted] dollars. They said that if I returned within 30 days that I would not have to pay ** dollars again. So I came back to this same business 30 days later and they said that my re-test would be another ** dollars, but that they would refund me my money after the car passes inspection. So I gave them my credit card thinking it was just for a hold. No, they charged me a second ** dollars. When they were finished inspecting my car for the re-test, they gave me my pass sticker along with my vehicle inspection report which stated on there that the re-test should have been $0.00. I confronted them and both males refused to give me back my refund then I was told to go complain about it somewhere else. They are obligated my law to give me my refund back, but they denied me of my refund so now I am here making this complaint in hopes of getting my second [redacted] payment back.Desired SettlementI would like my refund of [redacted] back that Magic Fuel Inc was supposed to give me. I have my receipts along with the vehicle inspection report which states that my re-test should have been $0.00.Business Response The customer got a rejection sticker and came back about a month later for a free retest which is what the customer stated. Massachusetts law regarding retest is that the customer must have the first inspection receipt in order to get a free retest. The rules of the registry are that we have to charge the customer again if they do not have the initial inspection report. This is what my inspector is taught during training so they are just following the rules and regulations of the registry. Also to confirm this rule the inspector gave the customer a brochure with the registry hotline phone number and told her to call and inquire about this rule. She called while she was at the station and the person at the registry hotline told her that the inspector was correct and that she had to pay if she didnt have the original inspection report. The inspector was just following the rules and regulations that he was trained to follow and he doesnt work on commission wether she paid or not doesnt affect him one bit he was again just following the rules. And fair or not in order to protect himself from being suspended or punished by not following registry regulations he had to charge her.Consumer Response Some of the statements made by Magic Fuel Inc. were not entirely correct. One of the statements by MF that I read in the email sent to me was, "The rules of the registry are that we have to charge the customer again if they do not have the initial inspection report. . .Also to confirm this rule the inspector gave the customer a brochure with the registry hotline phone number and told her to call and inquire about this rule. She called while she was at the station and the person at the registry hotline told her that the inspector was correct and that she had to pay if she didnt have the original inspection report. " (Magic Fuel Inc). This statement is not entirely correct; Yes, I called the registry hotline to inquire about the rule and was told that the re-test fee of $35 had to be charged to me again. But what was also told to me over the phone from the registry hotline is that after they were finished inspecting my car, they were required to refund me a fee of $35 if the fee on the inspection report printed $0. After my car had passed inspection, Magic Fuel gave me my inspection report which stated the fee of $0. I went to the them and said that I would like to have my $35 refunded since it was initially suppose to be $0. They refused and told me to go make a complaint about it. I left the premises and continued to call the registry hotline to make the complaint. They looked through their database and found Magic Fuel to be at fault. They proceeded to have a complaint form mailed to my address which I received in two days. I filled it out in detail with MF's information and my statement which was the same one I made out to [redacted] On [redacted] I received a voice mail call from the registry of motor vehicles and spoke with [redacted] who was in charge of investigations and complaints. He let me know that I was entitled to a $35 refund and proceeded to Magic Fuel Inc. in Leominster, MA in person to have the business write out a $35 check addressed to me. He received the check from them and mailed it to me promptly which I have since deposited. So as you can see, the complaint that I have originally filed against Magic Fuel has been resolved, but in a very unprofessional way on behalf of Magic Fuel Inc. Thank you for your time and I still have the check, voicemails and original receipts/inspection report if you would like any copies I can certainly do that for you.[redacted]
