I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowI am rejecting this offer because I no longer wish to do business with Magic Seal after my outrageous experience yesterday, and after reading Magic Seal's response to my complaintLet me start by saying that I am absolutely CERTAIN that [redacted] is under an enormous amount of stress due to this huge advertising error At my daughter's soccer practice last night many of the parents were discussing the outrageously expensive estimates they had received in the mail from Magic Seal One family's neighborhood association had sent an email out yesterday to residents alerting them to this concerning issue, and cautioning them [redacted] might be surprised to hear that I explained the error to these Pittsford residents, and assured them that if they called Magic Seal they would be quoted a lower price It would appear that many Pittsford residents received extremely high estimates and many received low ones If this is a small company, I'm certain that this error is very concerning and creating a great deal of stress for the owners Perhaps this stress may help to explain the extremely heated, and at times personal and very inappropriate exchange that occurred between [redacted] and myself yesterday Unfortunately, understanding that [redacted] may be under some stress and this response from her will not change my mind about doing business with them, or recommending them to others in the future [redacted] claims that [redacted] "insisted I only charge $33" This is untrue, and my complaint that I filed yesterday explains that I would accept a $price, and even told the woman I initially spoke to on the phone that, but she claimed that she was unable to offer me that price I was to pay $plus tax - which is the highest price I have ever had to pay Magic Seal for their service In my complaint I said that I feel that offering "a price less than $and closer to $plus $off" is more appropriate given our longstanding history with the company and the fact that the error that was made I was absolutely willing to meet in the middle Yes, [redacted] did explain that Magic Seal is a small family business that needs to support many adults and children She also told me that she realized that I had been a customer since and as a customer with that kind of history "I should have known the quote we received was an error" I can say - with all honesty - that the driveway sealing business isn't something I know anything about I can honestly say that my husband and I thought that perhaps this quote was some sort of "early bird special" and the company wanted to give an entire neighborhood a great price to get their season started Never was it our intention to rip them off, yet [redacted] kept insisting that we "had to know this price was an error" - which was offensive Her combative approach turned me off I would have preferred if she had said "You've been a customer since and we are sorry for our error Is there a way that we can compromise because we value your business?" I told her that I offered to pay $for the service She said "FINE! We'll do it for $50, but we won't make any money We'll send out guys to do the job and we won't make a dime!" I said that at this point I really didn't want to do business with them She explained that she was a Christian woman and all of her children went to Christian schools and she worshipped one God When I asked her if she was questioning my morality she said "Yes! You have really really bad morals." At that point I hung up the phone and was in complete disbeliefWithin seconds [redacted] called me back Was it to apologize? NO! It was to continue to argue with me!!! She said "If you got a post card that said it was going to cost $to seal your driveway you wouldn't pay that, so why would you expect us to let you pay $33!" I think that comparing a $and $dollar error is much different than comparing a $(what I believe we paid Magic Seal for our last service) and a $error Then she told me she hoped that I "never make a mistake" I told her I make mistakes all the time, but then asked her very firmly to lose my number and lose my address I don't wish to have any more interaction with [redacted] from Magic Seal.This exchange was definitely heated [redacted] did not seem to be able to handle dissatisfied customers in a calm and reasonable way, and she got very personal when she attacked my morality My experience with Magic Seal this year was unpleasant - to say the least - from start to finish I have received another postcard from another driveway sealing company today, with a quote that was more than $but less than $and I think it is time for a change

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.We paid the invoice because we did not want a collection account Rob refused to deal with me since the incident Just because he spoke with my husband doesn't mean a thing He is not the homeowner and it is not material property The company offered me to fix the issue So if there was not a problem then why did they offer this I believe because Rob made the statement that he has never had a complaint he is covering his tracks After speaking with Rob and the office before the work was started we all were under the agreement with how close the repair was to the door that it would be opened They were given instructions on how to do this and I made sure someone was at home at the time of the repair No one knocked on the door There is damage as I had Felluca come and look at the door I have photos and will be going to court on this issue since it took them a month in a half to respond to this complaint The door is messing up my track and is falling apart They can either pay the repair cost of the or I can proceed with court Regards, [redacted]

Hello, I am so sorry this happenedMy guys should have left when it started raining the first time and they will be reprimanded for thisI do not tolerate bad service and feel just so awfulI only wish I could of talked to you and straightened this out right awayWe do not seal in the rainWe would like to waive the fee for this of course and offer you a free driveway seal if you would be so kind to give us a second chanceIf so you can ask for Martin and he will take care of youThank you Tina B [redacted] President

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowI have spoken with Tina multiple times in regards to the damage, the power wash company that came out did more damage to my house, they stripped the paint off the down spout of the gutter and the trim, and they took out mortar in between the stone I spoke with Tina and she said that she would have her contractor come out to assess the damage, nobody ever showed up I than asked for my contractor to come out and give me an estimate that I forwarded to Tina, and also never received anything back from herAs mentioned in my original complaint I would like for my house to be restored to the way it was before Magic Seal came outPlease see attached Thank you, [redacted]

Magic Seal came back out and topcoated half of the driveway at no cost to the customer and resolved the problem, extended the warranty and spoke to the husband who was very happyIf we discounted the driveway to $we need to see the revised contract since we are not aware of this discount and Cody has no revised contract or emails saying he would only charge the customer $The remaining $is still due to Magic Seal Thank you Tina B [redacted]

Magic Seal is willing to seal the driveway in 2018 for free and offer $200.00 toward repairs, since we are not legally responsible and have no control over rain we feel this is a fair offer. We have also paid for the power washer to come out and try and clean it as much as possible. This is our final offer Thank you Tina B [redacted]

Hello First of all, the day we sealed the driveway there was a zero chance of rainThere was a pop up shower later that day or evening and a small portion of the drive was not dry and it splashedWe don't tape off garages or siding or fences because its too time consuming and we would have to apply that cost to our customersNot one company in Rochester does thatWe couldn't predict a pop up shower anymore than she could or she wouldn't of let us seal it and we wouldn't of wanted to seal itWe always redo drives for free if they wash from rain and it costs us money to go out twice so we avoid thatWe send a power washer out to clean the area if it splashes at our expenses as wellThis is not something we are required to doOur insurance doesn't cover it because they have a stipulation in our policy that if it rains after we leave the job it is considered an Act of GodI spoke with my lawyer and she said we are not required to reseal the driveway for free or clean the house if it rains after we leaveWe do this as a courtesy to our customersWe have already offered her to reseal the driveway for free which would be with tax and spent on the power washerI would like to add that we rescheduled her twice before her actual sealing date due to rain weather, or the chance of rain and the day she was sealed she agreed to and they were not calling for rain The bottom line is we are offering to reseal the driveway in the spring for free next year, we paid the power washer to try to clean the property, and we are still willing to offer $additionally for the the damages to the sidingWe believe we have gone above and beyond at this point in time Thank you Tina [redacted]

I have called and talked to him several times back in August and he assured me each time that he will contact the cleaning company to clean the tar off my siding and call me backNever called me back!!!! He also totally ignored that his men broke the corner of the shingleBy the way, I took pictures of the broken shingle and splashed tar on the sidingIn the meantime I was forced to hire a company to clean the tar off the siding and also fix the shingle So, now they are offering me a free driveway sealing and an apologyWhere were they in August when I contacted Martin every week and was waiting to get the mess taken care of? Again, there was no chance of rain on the date of your sealer job. We had no control over what happened. We offered to split the cost, and even reseal the driveway for free. That was not enough for you. Our insurance does not cover rain splatter on houses

We did this driveway in We were called back a year later with concerns they had about the driveway We have been out there several times and have deemed that these concerns have nothing to do with the way the driveway was paved It is a separate issue that needs to be
addressed It as a complete new issue above and beyond paving the driveway We explain in detail what needed to be done if they wanted this issue to be resolved We have never heard back from anyone Now in December we received this complaint on the Revdex.com We immediately went out to take another look and contact both the husband and wife to try and correct the issue We have made several calls through the season and are still waiting for a response on how we can solve this situation so everyone comes out happy When we do not hear back from a customer, it makes it hard for us to able to correct the issue at hand

Per my conversation with Mr *** regarding his driveway and puddle that he is concerned about we have reached a verbal agreement that I will revisit the job and make adjustments as follows: 1. Mill a key way into existing asphalt to ensure smooth transition2. Add 1.5-inches of 7f from east side to the key way to attempt to shed water down to the municipal road3. Compact with power roller and barricadeI never guaranteed a puddle free surface as the existing elevations are pre-set that I had to match up with. I will attempt to shed the water with the process above but can not guarantee that It will work. The unintended consequences of this solution could make for an awkward step down to the driveway from the back entry steps and water to puddle in another area. Also, there is a basement window near this area which is low and could be a issue with heavy rain or snow melt. I will do this service for free as a courtesy and not a warranty, as it's not covered under our policy. I will do this to keep the customer happy and satisfied in hopes of a positive experience with Magic SealI would hope to have it completed by May 31st. Other Notes: I did visit in and spoke with Ms *** at length. After speaking with Mr *** for the first time since this issue we quickly and easily resolved this problem and this email corresponds appropriately with our conversation. Thank You Magic Seal

We did respond to your complaint to let you know the following: Our company has always, and still does, use horse hair brooms to apply our sealer. We do not spray it on, everything is done by hand. This I can guarantee 100% . As far as treatment of the oil stains, as we had
informed you, our crew applies a solvent to the stains before we seal to help dull the stain out and attempt to clean it up. Oil stains are notorious for embedding into asphalt and eating away at the pavement. Our treatment helps to harden the asphalt under the stain and protect the driveway from deterioration or crumbling. Unfortunately some times the oil does bleed back through and may take a few applications to completely cover. Any time if you are unhappy with your service we would be more than happy to come out and take a look to see how we can remedy the situation

Hello, I am Tina *** and own the companyWe do use brooms to apply the sealer and I can show you our monthly bill from the company we buy them fromWe do not however clean up oil stains it states on our card you receive in the mail the we "treat oil spots" that is a treatment that is in the sealer and we also use a poly oil seal that hardens the blacktop so the oil doesn't absorb in the asphalt and create a holeMost of the time customers will tell us they have bad oil at the time of the scheduling of their appointment and we advise them to use some dish soap, water and a brush to clean it up and then through some kitty liter on it until we get there to seal the driveThat will dry the oil up so we can treat it and seal the drive and the fresh oil will not be as noticeableWe don't put the oil there we just treat it the best we canThe best we can do at this point is come back out and retreat it and reseal that areaBut again the area should be cleaned with dish soap, water, and a brush before we come to dry the fresh oil spotsWe have no problem at all coming out to retreat the spots, other than that what can we do Thank you Tina

of another customer. If the husband was satisfied with the work, the
full payment would have been made. My only spoke to *** on the phone
in which no agreement was ever madeThat is a completely

After we completed the work on this job, we were called out in response to a complaint that the garage door was damagedWe always tell our patching and paving customers to leave the garage open when we are coming out and that our guys do not open or close doors since we are do not like to touch any
property that is not our propertyIts up to the customer to leave the door open and since your door was left shut we could not of broken the opener or springsUpon inspection our workers and your husband came to the conclusion that the door had gotten dirty from the work and at that time we made sure everything was cleaned upThe payment was then made to usYou had then called back to let us know you were not happy with the outcome and you wanted the owner to come out and take a look himself When the owner came out, you were unavailable and again he spoke with your husband, who insured us that there appeared to be no damages and all was fineYou called the office again and you spoke with Liz who let you know that we would once again bring this to the attention of our owner, however since he had already been out, there wasn't much else we could do at this time Being unsatisfied with this solution, you again contacted us wanting to come to an agreement At this time we offered you a $reimbursement on the work that was done even though we had explained that we truly feel that there were no damages from our work You declined our offer and explained you would rather take us to courtI feel we have gone over and above trying to resolve this matter and that there no damage to the garage at the time of service or upon inspection with your husbandI also feel you would not of paid if the garage was damagedThank you Tina ***

On the day we came to seal your house, there was zero % chance of rain. We had an unexpected pop up shower than had splashed the sealer on to your houseAt this point we hired a power washer, at our cost to come out and clean the sealer off the house. We also offered to re seal the
driveway at no cost to youWe feel we went over and above what we are liable to have to do for you

I spoke to Mr *** yesterday and he agreed to meet with me after the holidays and discuss the issues he feels are at hand and we both discussed coming to an agreement to make both sides happyI explained to him customer service is a high priority to us and we will do what we can to make him happy
