Review: I am writing on behalf of my mother [redacted], the Insured, to file a complaint against Magna Carta Companies for failure to pay insurance claims "immediately upon receipt of due written proof of loss." As the date of this letter, Magna Carta has been in receipt of two claims since December*, 2014 and the insured has not received any status or payment in regards to these claims.

Initially on November [redacted] and[redacted], I submitted claims to Magna Carta on behalf of my mother via [redacted]. On December [redacted] while following up on the status of the claims with [redacted], I was notified that they were not in receipt of the claims due to mailing issues. As such, I sent via e-mail both claims (consisting of 10 e-mail parts) to Magna Carta. I then followed up every day by calling and leaving a message on Magna Carta's main phone line, ###-###-####. On December**, 2014, I received an e-mail from [redacted] stating that she was in receipt of both claims and the review process would commence.

Starting December[redacted], I started to call the main line and left numerous voicemails for [redacted]. Each message was an inquiry on the status of the claims that were confirmed on December[redacted] and also additional claims that I sent out after December[redacted]. None of my calls were returned nor did I receive any e-mail or letter correspondence from Magna Carta or [redacted].

On January**, 2015, I started to call [redacted]'s direct line, ###-###-####. I left numerous voicemails inquiring on the status of the claims, since they were in possession of a verifiable claim since December*, 2014. As the date of this letter, I have not received a claim status call back or in receipt of any payments or correspondences about the claims.

In reviewing the policy that [redacted] sent me on October**, 2014, the policy states that the insured will need to file a claim and proofs of loss within a reasonable time period and in no event, except in the event of mental incapacity, no later than a year from the date of service. Upon submitting claim and proof, the policy states "Indemnities payable under this coverage will be paid immediately upon receipt of due written proof of loss." I am attaching the letter dated October**, 2014 along with attached policy.

As such Magna Carta is in breach of their contract with the Insured. I have submitted all claims with all proofs of loss in a timely manner. In addition, I have followed up and have tried to follow up on the status to pending claims and have not received a single call back or correspondence from any representative at Magna Carta since December**, 2014.Desired Settlement: My goal is to obtain an answer to my claims in a timely fashion and to receive any form of correspondence keeping me reprised on the status and payments of the claims.
