I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I have discussed the matter with my husband and we are willing to agree to the following resolution:We receive a full refund of $842.50. In exchange we will notarize a letter that neither we, nor our family and friends will post further reviews regarding our experiences in regards to our 10/12/2015 contract, provided that we receive our full refund, $842.50, from Magnifico Photography within THREE WEEKS of the notarized letter being delivered to the Magnifico business office. Magnifico Photography will also provide us with a tracking number for the packet containing the refund, and he will email the tracking number to [redacted] the SAME DAY as the refund packet is sent. All remaining reviews will be updated AFTER receipt of the refund, and will either be given a 3,4, or 5 Star Review, or will be taken down completely, as we, [redacted] and [redacted], see fit, which will be directly related to the promptness of the business. All of the above conditions will be detailed in the notarized letter that [redacted] and [redacted] will draft and send via mail with a tracking number, so as to ensure delivery. If the business does not provide the refund, and tracking number for the refund packet as stipulated above, the notarized letter will be considered void, and have no legal value.Thank you,[redacted]
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me, with certain caveats.1. We will accept any refund of $400 or more; the owner is free to do what he chooses with the remainder. We only ever wanted the $400 refund we were promised in early DEC 15, and we only began posting negative reviews of the business after the owner failed to provide the money for several months. If he really didn't care about the money and planned to donate it all back, as he claims, then he could have easily mailed us a check at any point in the last FIVE MONTHS. Doing so would have resolved the issue immediately.2. We will agree to change all of our reviews to contain "neutral language with no opinions," and will agree to neither post additional reviews nor interact with the owner in any way. However, we won't provide a notarized letter with such an excess of superfluous personal information--especially given that the owner has already violated our privacy rights by posting our full names and address for public viewing as part of his responses to our reviews. We would also expect the owner to revise the language of his responses to our reviews to also contain solely neutral language with no opinions or personal details.3. We won't increase the star rating of any reviews of the business or take any existing reviews down. The owner earned these ratings for himself in his dealings with us. We believe that the owner is currently holding our money hostage in order to coerce us into leaving dishonest reviews. Again, these reviews would never have existed if he had honored our written agreement for the $400 refund five months ago.If these terms are found unacceptable by the business we will assume the owner has no intention of refunding our money, and will continue to exercise our right to post fair reviews of his services online as we see fit.

Here is the timeline of events with Miss [redacted] & [redacted] I received the original email inquiry from [redacted] on March 27, 2015 asking about photographic services for a wedding date of Monday, October 12, 2015. After we had spoken by phone numerous times, Miss [redacted] told me she was living in [redacted] at the time. I replied to the email and sent her my wedding pricing and package information, and noted that I gave a military discount. Since the Wedding date was on a Monday, I gave a $400 discount for an “off day/weekday” wedding, as well as a 25% off Military discount. I also gave them a few extras like a Mini Engagement Session, Bridal Portrait if it could be arranged, lots of extra help in the planning process. We spoke numerous times by phone over the next few months and they negotiated a new package and a new amount, keeping the large discount and $$ taken off. Again, I was happy to offer a customized package and special rate, as this was for a Wedding taking place on a Monday. On July 31, 2015, I met [redacted] for the first time, as she passed through the area. We met at a Local Coffee shop to discuss the package details and sign the contract. In the standard photography services contract I utilize with all my clients, it clearly states:“Payment Policy & Expenses – A non-refundable retainer of half of the package amount is paid to reserve the Wedding Date. The remainder of the fee will be paid, by the client, two weeks prior to the Wedding Date. If the client cancels this contract, before the Wedding Date, No refunds will be given.”[redacted] understood the contract and signed and dated both copies at our meeting, and paid the non-refundable retainer of half of the package amount, at that time.That same weekend I had a Wedding at the same venue as the one she was using for her Wedding. Knowing that I was there and the Wedding was starting at said time, Miss [redacted] and her Mom showed up unannounced and out of the blue. They wanted to see a Wedding at the church. It was very uncomfortable as they were unannounced and not dressed for the occasion. However, I did my best to be accommodating to [redacted].On August 17, 2015 Miss [redacted] called me to let me know that her Fiance had failed a PT training test/course and he would need to do the course again. She went on to state that they would have to cancel their Wedding for October 12, 2015.The following day, August 18th, I received an emailed from [redacted] that read:“Hey Noah! Thanks for talking yesterday, it was very very helpful! I am officially taking October 12 off the books.”Upon my receipt of this email from [redacted], cancelling the wedding date of October 12, 2015, the wedding photography contract was considered cancelled and void.The non-refundable retainer clause in the contract states: If the client cancels this contract, before the Wedding Date, No refunds will be given.”A cancelled contract is just that - a cancelled contract.However, I love what I do and am happy to go the extra mile for all of my couples, so I was happy to attempt to work with [redacted] as she chose multiple new wedding dates over the next 4 months. During this time, Miss [redacted] talked about several different “new” wedding dates. She spoke of a November date, December 12, 2015(Saturday), December 28 (Monday), December , 31&1(holiday) and January 1&2, 2016(Fri-Sat - Holiday).I told her that I would not be available for the December 28TH, as I was already booked with another wedding. I told her that I was available for the New Year’s dates, but explained there would be an extra charge because of the Holiday.Over the next month, she flip/flopped wedding dates for one reason or another, promising this date with one venue and that date with another venue. I kept track of all of her notes and waited to get a confirmation of when (and what city) the wedding would in fact be taking place.She finally requested the Jan 1&2. The Wedding Ceremony and Reception was to be held at the same venue, in Fincastle, Va. I immediately added her wedding date to my schedule and considered it “booked.” As a result, I turned down a New Year’s event at a local University that I have photographed for the last 4 years in a row. On September 17, 2015, Miss [redacted] contacts me and tells me that the Wedding location has now moved from Fincastle, Virginia, to Savannah, Georgia, 900 miles, roundtrip. She goes on to tell me that she wants the same discounted “off day/weekday package” rate for originally negotiated for a local wedding being held on a Monday, and that she will not pay a single penny more! On the same day, I tell her 900 miles roundtrip drive, two nights in a hotel = $931 $200 for a weekend date, was $400Total = $1131 + the balance of her original package.Same day she writes back to let me know “I'm sorry, but there is no way that I would be able to afford”I tell her I will look over the numbers again.I cut out every bit of cost for labor and time, and reduced it down to only my costs for travel and lodging. $600 to cover gas and two nights in a hotel for their Savannah Wedding.More than a month later, On October 21, 2015 [redacted] sends me a response:“[redacted]’s Dad has passed away.”I was truly sorry to hear the news!At this point, she goes on to tell me that they cannot afford the extra $600, [redacted]’s Mom is paying for the photography, and I am a horrible person for attempting to charge them an extra $600 to drive 900 miles and stay in a hotel for two nights to photograph their Wedding!Even though her comments were hurtful AND untrue, I am always out to make every couple’s experience a positive one. With a death in the family before the wedding, my heart goes out to any couple experiencing a loss. So, I told her I would honor the discounted “off-day/weekday” wedding package price. I’ll also take money out of my own pocket to pay for the travel and hotel room, as long as new contract for the new wedding date is signed within a week.I mailed out the new contract right away, and sent the paperwork certified mail to ensure [redacted] would receive it. The Postman attempted delivery three times. It was held another week at the post office and [redacted] NEVER picked it up from the Post Office.A month and a half pass and I get no response. Default to original contract I email [redacted] with wedding photo ideas and locations. I research the Savannah area, I find out what events are going on that weekend, and send [redacted] that information.Still, no response!December 8, 2015 I am at the end of my rope, it is just WEEKS before New Year’s, less than a month from the wedding date she has given me, and I still don’t have a contract in place with the couple. I don’t make any other plans for the holidays with my family, nor do I book any other events for that weekend, because I’m still having troubles getting a final answer from Miss [redacted]. All I want to do is get a new contract in place and move forward.In an effort to reestablish communication and get the ball rolling, I email her an outline detailing 4 new options for her consideration.#1 – Keep the original package and pay $525 for Travel & Hotel#2 – Keep the original price and apply it to a 2016 package, pay no extra#3 - opt out – I will get an attorney to draft a letter, sign it, return it, and as a good faith extra, I give you $400 back, half of the NON REFUNDABLE RETAINER#4 – Do nothing –December 11, 2015 Miss [redacted] responds that she has chosen the option to “opt out.”The same date, December 11, 2015, I responded that I will draft up the document, have an attorney look it over, and send it certified mail to [redacted]. This process is slated to take a few months due to the holiday season, [redacted]’s Honeymoon plans, and the Attorney’s case workload.Jan 2016 – [redacted], the Groom, a person that I have never met or had communication with throughout this entire process, decides that he is not waiting for the “Opt Out” agreement that his wife selected, and proceeds to leave slanderous and half -truths feedback on every online review site he can find.This ends all communication. Default to original contract At this point, through honesty and hard work, I have gotten almost all of the reviews removed. A resolution to this - Have them remove the remaining reviews, if they cannot be removed, convert them to 5 star reviews. Review: Our experience with Noah was absolutely and utterly awful, and I can only say that he is not a good person. He is a narcissist, he discriminates against military, and when it comes to doing the right thing he is slimy. My husband is an army Ranger, and deploys every year and at a moments notice. When we had our date set for a Monday in October '15, I told this to Noah and he gave me a verbal agreement, before I signed the contract, that if my husband were deployed he would move the $842.50 deposit to the new date. Well, my husband was deployed. While I was trying to salvage our wedding, I approached Noah with two other dates that were good for the other vendors, Dec. 28, and Jan. 1, but he refused them. What's more, he would not tell me what would happen if I booked a date he was not available for, but pressured me to "make a decision." Because I was bending over backwards trying to fit Noah into our wedding, the entire wedding in [redacted] unraveled. So I informed Noah we would be having the wedding where my husband was stationed, [redacted] Then my husband's father died suddenly, a week before our original date. While the entire family was reeling, Noah was trying to pressure us into paying $600 more, and threatened that we would receive none of our $842.50 deposit back, despite having told me before that he had settled on a fair amount of money refunded with another bride. He stated "his lawyer advised him" not to give a refund, because he was technically available for our new date, despite having REFUSED the other dates that were more feasible! I told him that my in-laws were paying for the photography and my widowed mother-in-law couldn't afford that much on top of the funeral fees. Afterward he agreed to honor our original contract, but even this was a lie. I spent MONTHS and sent COUNTLESS emails, phone calls, and texts to Noah, trying to get him to send me the new contract. Noah spent that time sandbagging us, often not responding to my emails at all, and other times lying and saying the contract was sent, and BLAMING me for not receiving it! Three weeks from the wedding, Noah gave us three options: 1) pay $600 extra for our original package of unlimited photography, 2) pay our original price for only 5 hours of photography (NOT our original package), or 3) Opt out of the contract as soon as possible, sign a piece of paper, and receive a $400 "Donation" to our wedding. We were so sick of his greedy behavior that we agreed to the third option, leaving us to find a photographer 3 WEEKS before our wedding!
AGAIN, I sent email after email waiting for the "document" I needed to sign, and I was met with either no response, or "my office is on vacation for three weeks," "waiting for the Attorney's office," and "didn't want to send it while you were on honeymoon." Finally, my husband started emailing him, a month after our wedding, to which he responded "I'll check the office to see what's taking so long." Another email: no response. To this date, we have paid $842.50 and received nothing in return but headache.
I was obviously trying to do everything that I could to keep Noah as our photographer, and let him know that plans change in the military , though even I could not have foreseen us having to change not only our date but also our location. My desire to keep him as our photographer and attempt at accommodating was essentially giving him enough rope to hang me with. Our wedding ended up being beautiful, no thanks to Noah.Desired Settlement: We would like to be refunded our deposit of $842.50

Also, we've had another little hiccup, the priest can't do Jan 2, but he can do Dec 28. Another Monday ;) Are you free that day? Jan 2 isn't completely out of the question, but we would like this priest to be able to marry us, and it would be nice to maximize the discounts of a Monday wedding. Let me know! We feel that we
must again dispute Noah Magnifico's Revdex.com response, because we know that our Revdex.com
communication will be publicly viewable, and we need to highlight Noah's
apparent pathological lying and inability to be professionally humble or
apologetic for any of the ways he has mistreated us, accidentally or on
purpose. We feel that we must not only correct the 12 LIES that Noah wrote in
his Revdex.com response (if he’s lying this much in one email, imagine how many times
he’s lied to us over the past year), but that we cannot agree to his demands to
take down the remaining reviews or replace them with 5 star reviews, and
notarize a letter to this effect, as this is 1) insulting, and 2) not in line
with our experience of Noah. We cannot give a 5 star review because that would
be a lie about our experience with Noah, and we believe the public has a right
to know the lack of professionalism and manipulation of which Noah is
capable. We would, however, be willing to update our reviews to reflect
how Noah has resolved this complaint, which will be helpful for him
if he does so in a courteous and professional manner.

information with the Subject Line, Date, and Time in this Revdex.com complaint to
settle these lies once and for all.
LIE #1: “Upon my receipt of this email

"Could you please give me your address so I can send you 50 percent deposit.
What is your policy for cancelation? I'm just wondering, because I never can be

Inquiry - 5/22/15, 10:49 AM] – Noah wrote "If you cancel, the balance gets
transferred to your new Wedding date." Noah also gave me verbal
confirmation of this just before I signed the contract.
LIE #2: “On July 31, 2015, I met [redacted]

TRUTH:

Points – 6/1/15, 5:45PM] – I wrote "You should receive
the deposit in a few days!" confirming that I sent Noah the deposit
of $842.50, NOT on 7/31/15 as he claims, but on 6/1/15, 61 DAYS BEFORE I RECEIVED A CONTRACT, which
I only received because I MADE A POINT of passing through [redacted] at
the time. This supports our claim that Noah was apparently incapable
of sending ANYTHING, even "the standard photography services
contract [he] utilizes with all [his] clients" in the mail. 6/1-6/29: Noah
did not respond for 29
DAYS, until I sent a follow-up email [Discussion Points – 6/29/15 ,11:55AM]
asking if he got the check, at which point, [Discussion Points – 6/29/15, 12:01PM],
he confirmed receipt of the deposit "Yes, it's here on my desk." This further
supports our claim that, though at times he could respond in minutes, Noah
often went MULTIPLE WEEKS without responding.
LIE #3: “That same weekend I had a Wedding
at the same venue as the one she was using for her Wedding. Knowing that I was there and the
Wedding was starting at said time, Miss [redacted] and her Mom showed up
unannounced and out of the blue. They wanted to see a Wedding at the church. It was very uncomfortable as
they were unannounced and not dressed for the occasion. However, I did

TRUTH:
This is perhaps
the most interesting lie in Noah's Revdex.com response as it is not only a completely
irrelevant and useless anecdote, but is also completely FALSE. Noah EXPRESSLY
told me about that wedding during the contract meeting because I was nervous
and wanted to see him in action. He INVITED my mother and I to the wedding, hence why he told us the date
and time, saying that he would introduce us to the wedding planner,
[redacted], and telling me that we should come early, sit in the back and come

This is one of
the most hurtful lies. He demeans my
husband for having "failed" a "PT training test/course."
This shows how little understanding he has of the military. In actuality, my husband
was detained in RANGER
SCHOOL, the most grueling school in the ARMY. For many, RANGER SCHOOL is
WORSE than deployment: you have NO outside contact, you're under extreme
mental/physical conditions, and you cannot leave.
LIE #6: “During this time, Miss [redacted]
talked about several different “new” wedding dates. She spoke of a November
date, December 12, 2015(Saturday), December 28 (Monday), December
31&1(holiday) and January 1&2, 2016(Fri-Sat - Holiday).
I told her that I would not be available for the December 28TH, as I was
already booked with another wedding. I told her that I was available for the
New Year’s dates, but explained there would be an extra charge because of the
Holiday.
Over the next month, she flip/flopped wedding dates for one reason or another, promising this date with one
venue and that date with another venue.”
TRUTH: I NEVER promised or officially
booked any wedding date other than 10/12/15 for a Virginia location. From 8/18-9/17
I tried tirelessly to pick up the shambles of my previous wedding preparations,
and coordinate the schedules and pricing of the Church, Noah, 3 reception venues, AND our out-of-town
priest, and family, hence why I asked about different dates. Noah flat
out rejected Dec 28, the
only day that EVERYONE ELSE could do, due to a wedding he had on Dec 27 [Wedding
Photography – 8/18/15, 1:13PM], and stated that a Jan 1 wedding would cost
us $800 extra.
LIE #7: “She finally requested the Jan 1&2. The Wedding
Ceremony and Reception was to be held at the same venue, in Fincastle, Va. I
immediately added her wedding date to my schedule and considered it “booked.”
As a result, I turned down
a New Year’s event at a local University that I have photographed for
the last 4 years in a row.”
TRUTH: I NEVER officially booked any
other wedding date for a Virginia location.

can you please keep Jan 1 and Jan 2 tentatively reserved for a few days until I hear back from venues?”
I specifically chose NOT to do the wedding on Jan 1, because in a phone call,
Noah told me he had an event the night before, though he suggested that he could skip my rehearsal
pictures on 12/31 to photograph the university event, and just come for the
wedding on 1/1. Even after, with the wedding in Savannah on 1/2/15, I gave him NO REASON to cancel his
engagement with the university.
LIE #8: On September 17, 2015…She
goes on to tell me that she wants the same discounted “off day/weekday package”
rate for originally negotiated for a local wedding being held on a Monday, and
that she will not pay a
single penny more!
TRUTH:

3:48 PM] – I wrote, “As promised, I'm informing
you of our final decision. We will be having our wedding in Savannah, Georgia,
on January 2, 2016…Please let
me know how this will affect things on your end, so we can decide how to
proceed.” This was the ONLY time I gave Noah an official second date.
[Update – 9/17/15,
9:35 PM] – Noah writes that I will need to pay an
addition “1973.50”
on TOP of the 842.50
already paid.

10:57 PM] – I'm sorry, but there is no way that I
would be able to afford over $2800 for the photographer. I know that you have
put time into my wedding, but even at the top of my budget I couldn't do more than $2000.
LIE #9: I’ll also take money out of my own
pocket to pay for the travel and hotel room, as long as new contract for the new wedding date is
signed within a week.
I mailed out the new
contract right away, and sent the paperwork certified mail to ensure [redacted]
would receive it. The
Postman attempted delivery three times. It was held another week at the
post office and [redacted] NEVER picked it up from the Post Office.

10:57 PM] – Noah wrote, “I'll honor the original
price for your Wedding Photography with the original package, travel is on me.” There
is NO MENTION of signing the new contract within a week.

touch with you multiple times over the past couple weeks. I've called, I've
left voicemails, and I sent you texts, and you have not responded. You told me
you were sending me a contract over three weeks ago, and I have still not received it.”

2:29 PM] – I wrote, “Six weeks and I have still not received a
contract.”

attempted to deliver it and had left you three messages. When all three

I responded that I will draft up the document, have an attorney look it over,
and send it certified mail to [redacted]. This process is slated to take a few months due to the holiday

NOWHERE did Noah

We will accept any refund of $400 or more; the owner is free to do what he chooses with the remainder. We only ever wanted the $400 refund we were promised in early DEC 15, and we only began posting negative reviews of the business after the owner failed to provide the money for several months. If he really didn't care about the money and planned to donate it all back, as he claims, then he could have easily mailed us a check at any point in the last FIVE MONTHS. Doing so would have resolved the issue immediately.2. We will agree to change all of our reviews to contain "neutral language with no opinions," and will agree to neither post additional reviews nor interact with the owner in any way. However, we won't provide a notarized letter with such an excess of superfluous personal information--especially given that the owner has already violated our privacy rights by posting our full names and address for public viewing as part of his responses to our reviews. Review: Our experience with Noah was absolutely and utterly awful, and I can only say that he is not a good person. He is a narcissist, he discriminates against military, and when it comes to doing the right thing he is slimy. My husband is an army Ranger, and deploys every year and at a moments notice. When we had our date set for a Monday in October '15, I told this to Noah and he gave me a verbal agreement, before I signed the contract, that if my husband were deployed he would move the $842.50 deposit to the new date. Well, my husband was deployed. While I was trying to salvage our wedding, I approached Noah with two other dates that were good for the other vendors, Dec. 28, and Jan. 1, but he refused them. What's more, he would not tell me what would happen if I booked a date he was not available for, but pressured me to "make a decision." Because I was bending over backwards trying to fit Noah into our wedding, the entire wedding in [redacted] unraveled. So I informed Noah we would be having the wedding where my husband was stationed, [redacted] Then my husband's father died suddenly, a week before our original date. While the entire family was reeling, Noah was trying to pressure us into paying $600 more, and threatened that we would receive none of our $842.50 deposit back, despite having told me before that he had settled on a fair amount of money refunded with another bride. He stated "his lawyer advised him" not to give a refund, because he was technically available for our new date, despite having REFUSED the other dates that were more feasible! I told him that my in-laws were paying for the photography and my widowed mother-in-law couldn't afford that much on top of the funeral fees. Afterward he agreed to honor our original contract, but even this was a lie. I spent MONTHS and sent COUNTLESS emails, phone calls, and texts to Noah, trying to get him to send me the new contract. Noah spent that time sandbagging us, often not responding to my emails at all, and other times lying and saying the contract was sent, and BLAMING me for not receiving it! Three weeks from the wedding, Noah gave us three options: 1) pay $600 extra for our original package of unlimited photography, 2) pay our original price for only 5 hours of photography (NOT our original package), or 3) Opt out of the contract as soon as possible, sign a piece of paper, and receive a $400 "Donation" to our wedding. We were so sick of his greedy behavior that we agreed to the third option, leaving us to find a photographer 3 WEEKS before our wedding!
AGAIN, I sent email after email waiting for the "document" I needed to sign, and I was met with either no response, or "my office is on vacation for three weeks," "waiting for the Attorney's office," and "didn't want to send it while you were on honeymoon." Finally, my husband started emailing him, a month after our wedding, to which he responded "I'll check the office to see what's taking so long." Another email: no response. To this date, we have paid $842.50 and received nothing in return but headache.
I was obviously trying to do everything that I could to keep Noah as our photographer, and let him know that plans change in the military , though even I could not have foreseen us having to change not only our date but also our location. My desire to keep him as our photographer and attempt at accommodating was essentially giving him enough rope to hang me with. I replied to the email and sent her my wedding pricing and package information, and noted that I gave a military discount. Since the Wedding date was on a Monday, I gave a $400 discount for an “off day/weekday” wedding, as well as a 25% off Military discount. I also gave them a few extras like a Mini Engagement Session, Bridal Portrait if it could be arranged, lots of extra help in the planning process. We spoke numerous times by phone over the next few months and they negotiated a new package and a new amount, keeping the large discount and $$ taken off. Again, I was happy to offer a customized package and special rate, as this was for a Wedding taking place on a Monday. On July 31, 2015, I met [redacted] for the first time, as she passed through the area. We met at a Local Coffee shop to discuss the package details and sign the contract. In the standard photography services contract I utilize with all my clients, it clearly states:“Payment Policy & Expenses – A non-refundable retainer of half of the package amount is paid to reserve the Wedding Date. The remainder of the fee will be paid, by the client, two weeks prior to the Wedding Date. he’s lied to us over the past year), but that we cannot agree to his demands to
take down the remaining reviews or replace them with 5 star reviews, and
notarize a letter to this effect, as this is 1) insulting, and 2) not in line
with our experience of Noah. We cannot give a 5 star review because that would
be a lie about our experience with Noah, and we believe the public has a right
to know the lack of professionalism and manipulation of which Noah is
capable. We would, however, be willing to update our reviews to reflect
how Noah has resolved this complaint, which will be helpful for him
if he does so in a courteous and professional manner.
I have attached
all of our email communication, and will be highlighting the salient
information with the Subject Line, Date, and Time in this Revdex.com complaint to
settle these lies once and for all.
LIE #1: “Upon my receipt of this email
from [redacted], [8/18/15] cancelling the wedding date of October 12, 2015, the
wedding photography contract was considered cancelled and void… A cancelled
contract is just that - a cancelled contract.”
TRUTH:

"Could you please give me your address so I can send you 50 percent deposit.
What is your policy for cancelation? I'm just wondering, because I never can be

transferred to your new Wedding date." Noah also gave me verbal
confirmation of this just before I signed the contract.
LIE #2: “On July 31, 2015, I met [redacted]
for the first time, as
she passed through the area…[redacted] understood the contract and signed and dated
both copies at our meeting, and paid the non-refundable retainer of half of the
package amount, at that
time.”
TRUTH:
[Discussion
Points – 6/1/15, 5:45PM] – I wrote "You should receive
the deposit in a few days!" confirming that I sent Noah the deposit
of $842.50, NOT on 7/31/15 as he claims, but on 6/1/15, 61 DAYS BEFORE I RECEIVED A CONTRACT, which
I only received because I MADE A POINT of passing through [redacted] at
the time. This supports our claim that Noah was apparently incapable
of sending ANYTHING, even "the standard photography services
contract [he] utilizes with all [his] clients" in the mail. 6/1-6/29: Noah
did not respond for 29
DAYS, until I sent a follow-up email [Discussion Points – 6/29/15 ,11:55AM]
asking if he got the check, at which point, [Discussion Points – 6/29/15, 12:01PM],
he confirmed receipt of the deposit "Yes, it's here on my desk." This further
supports our claim that, though at times he could respond in minutes, Noah
often went MULTIPLE WEEKS without responding.
LIE #3: “That same weekend I had a Wedding
at the same venue as the one she was using for her Wedding. Knowing that I was there and the
Wedding was starting at said time, Miss [redacted] and her Mom showed up
unannounced and out of the blue. They wanted to see a Wedding at the church. It was very uncomfortable as
they were unannounced and not dressed for the occasion. However, I did
my best to be accommodating to [redacted].”
TRUTH:
This is perhaps
the most interesting lie in Noah's Revdex.com response as it is not only a completely
irrelevant and useless anecdote, but is also completely FALSE. Noah EXPRESSLY
told me about that wedding during the contract meeting because I was nervous
and wanted to see him in action. He INVITED my mother and I to the wedding, hence why he told us the date
and time, saying that he would introduce us to the wedding planner,
[redacted], and telling me that we should come early, sit in the back and come
dressed for the occasion, all of which we did, I was wearing a dress. Why would
a person bother lying about a completely useless piece of information unless he
lies regularly in his communication?
LIE #4: “Since the Wedding date was on a
Monday, I gave a $400
discount for an “off day/weekday” wedding, as well as a 25% off Military discount.”
TRUTH:

& I had fun hearing about Your Story…$85 Travel…$1685 total.”
[Wedding
Photography – 8/17/15, 8:16AM] – When we were
looking into a Saturday date Noah wrote, “You will keep the 10% off for the Military
discount“
LIE #5: “On August 17, 2015 Miss [redacted]
called me to let me know that her Fiance had failed a PT training test/course and he would need to do
the course again.”
TRUTH:
This is one of
the most hurtful lies. He demeans my
husband for having "failed" a "PT training test/course."
This shows how little understanding he has of the military. In actuality, my husband
was detained in RANGER
SCHOOL, the most grueling school in the ARMY. For many, RANGER SCHOOL is
WORSE than deployment: you have NO outside contact, you're under extreme
mental/physical conditions, and you cannot leave.
LIE #6: “During this time, Miss [redacted]
talked about several different “new” wedding dates. She spoke of a November
date, December 12, 2015(Saturday), December 28 (Monday), December
31&1(holiday) and January 1&2, 2016(Fri-Sat - Holiday).
I told her that I would not be available for the December 28TH, as I was
already booked with another wedding. I told her that I was available for the
New Year’s dates, but explained there would be an extra charge because of the
Holiday.
Over the next month, she flip/flopped wedding dates for one reason or another, promising this date with one
venue and that date with another venue.”
TRUTH: I NEVER promised or officially
booked any wedding date other than 10/12/15 for a Virginia location. From 8/18-9/17
I tried tirelessly to pick up the shambles of my previous wedding preparations,
and coordinate the schedules and pricing of the Church, Noah, 3 reception venues, AND our out-of-town
priest, and family, hence why I asked about different dates. Noah flat
out rejected Dec 28, the
only day that EVERYONE ELSE could do, due to a wedding he had on Dec 27 [Wedding
Photography – 8/18/15, 1:13PM], and stated that a Jan 1 wedding would cost
us $800 extra.
LIE #7: “She finally requested the Jan 1&2. The Wedding
Ceremony and Reception was to be held at the same venue, in Fincastle, Va. I
immediately added her wedding date to my schedule and considered it “booked.”
As a result, I turned down
a New Year’s event at a local University that I have photographed for
the last 4 years in a row.”
TRUTH: I NEVER officially booked any
other wedding date for a Virginia location.
[Wedding
Photography – 8/18/15, 3:14PM], I asked, “Ok,
can you please keep Jan 1 and Jan 2 tentatively reserved for a few days until I hear back from venues?”
I specifically chose NOT to do the wedding on Jan 1, because in a phone call,
Noah told me he had an event the night before, though he suggested that he could skip my rehearsal
pictures on 12/31 to photograph the university event, and just come for the
wedding on 1/1. Even after, with the wedding in Savannah on 1/2/15, I gave him NO REASON to cancel his
engagement with the university.
LIE #8: On September 17, 2015…She
goes on to tell me that she wants the same discounted “off day/weekday package”
rate for originally negotiated for a local wedding being held on a Monday, and
that she will not pay a
single penny more!
TRUTH:
[Update – 9/17/15,
3:48 PM] – I wrote, “As promised, I'm informing
you of our final decision. We will be having our wedding in Savannah, Georgia,
on January 2, 2016…Please let
me know how this will affect things on your end, so we can decide how to
proceed.” This was the ONLY time I gave Noah an official second date.
[Update – 9/17/15,
9:35 PM] – Noah writes that I will need to pay an
addition “1973.50”
on TOP of the 842.50
already paid.
[Update – 9/17/15,
10:57 PM] – I'm sorry, but there is no way that I
would be able to afford over $2800 for the photographer. I know that you have
put time into my wedding, but even at the top of my budget I couldn't do more than $2000.
LIE #9: I’ll also take money out of my own
pocket to pay for the travel and hotel room, as long as new contract for the new wedding date is
signed within a week.
I mailed out the new
contract right away, and sent the paperwork certified mail to ensure [redacted]
would receive it. The
Postman attempted delivery three times. It was held another week at the
post office and [redacted] NEVER picked it up from the Post Office.
TRUTH:
[Update – 10/21/15,
10:57 PM] – Noah wrote, “I'll honor the original
price for your Wedding Photography with the original package, travel is on me.” There
is NO MENTION of signing the new contract within a week.
[Contract – 11/13/15,
1:31 PM] – I wrote, “I have attempted to get in
touch with you multiple times over the past couple weeks. I've called, I've
left voicemails, and I sent you texts, and you have not responded. You told me
you were sending me a contract over three weeks ago, and I have still not received it.”
[Contract – 11/29/15,
2:29 PM] – I wrote, “Six weeks and I have still not received a
contract.”
[Contract – 11/29/15,
7:02 PM] – Noah wrote, “The post office had
attempted to deliver it and had left you three messages. When all three
messages were ignored the post office returned it to me. I got it back about a week ago…I
sent New contracts to you twice. The first mysteriously vanished and the second was not picked up.“

7:59 PM] I ask, “Maybe you could send a picture of the letter?”
I have never had a problem getting mail other than with Noah. We have asked for
pictures and tracking
numbers (ALL certified mail has a tracking number) and Noah ignored us,
probably because it was NEVER SENT.
LIE #10: “A month and a half pass and I get no response.
Default to original contract. I email [redacted] with wedding photo ideas and locations…Still, no response!”
TRUTH:
He actually
emailed me ideas and locations (See Wedding Details – 10/7, Found A Neat
Spot – 10/7, and
Update – 10/7)
days after a badgering phone call in which he threatened to not give us ANY of
our deposit back if we canceled, during the funeral preparations for [redacted]’s
father, BEFORE he agreed to honor the original contract (10/21/15).
Refer to the 10 EMAILS I SENT from 10/22-12/8
(Update – 10/22, 10/23, Contract – 11/13 (x4), 11/21, 11/29 (x3))
asking for the contract, and even suggested SCANNING and EMAILING the contract to us, which we
could print out and mail back! I was actively trying to get the contract for 48 DAYS!
LIE #11: “The same date, December 11, 2015,
I responded that I will draft up the document, have an attorney look it over,
and send it certified mail to [redacted]. This process is slated to take a few months due to the holiday
season, [redacted]’s Honeymoon
plans, and the Attorney’s case workload.”
TRUTH:
NOWHERE did Noah
tell me the process was slated to take a few months. Refer to 6 EMAILS I SENT from
12/11-1/15 asking for the “document to sign,” which Noah NEVER EXPLAINED WHAT
IT WAS [Contract – 12/8/15, 12:24PM]. I never discussed my honeymoon
plans with Noah, nor should that have affected the pace at which we received “the
document,” and on 1/15
Noah stated “I saw no reason to send the paperwork while on your Honeymoon…I will send out the paperwork
next week.” [Contract – 1/15/16, 6:13PM]
LIE #12: “Jan 2016 – [redacted], the
Groom, a person that I
have never met or had
communication with throughout this entire process, decides that he is
not waiting for the “Opt Out” agreement that his wife selected, and proceeds to leave slanderous and
half -truths feedback on every online review site he can find.”
TRUTH:

1/27/16, 12:24PM] – [redacted] wrote, “I have a very low tolerance for drama, so I
want to diffuse this situation ASAP. As such, I won't hurl blame, insults, or threats, but will
only make one simple request of you...honor your word and get us our $400 back.
Do that and this whole thing goes away…we still
have not received the document you want us to sign--what I can only imagine is
some sort of release-of-liability agreement--despite the fact that you stated
it would go out last week. The onus is on you, not us, to deliver in a timely
manner.”

1/27/16, 5:19PM] – Noah wrote “I have put a phone call into my attorney's
office home is the one who is sending you the paperwork…As soon as I receive a phone call back from
them, which I suspect would be tomorrow sometime I will let you know the progress. “ After this
COMMUNICATION, and NO
RESPONSE for 24 DAYS, and 71 DAYS from when we chose to “Opt Out,” [redacted] posted first
review ALL of which was TRUE, on February 20. When we STILL heard NOTHING BACK for 41 DAYS, and 88 DAYS from when we
chose to “Opt Out,” we began posting the
SAME REVIEW on other sites on 3/8/15, as well as my
review ([redacted]).

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me, with certain caveats.1. We will accept any refund of $400 or more; the owner is free to do what he chooses with the remainder. We only ever wanted the $400 refund we were promised in early DEC 15, and we only began posting negative reviews of the business after the owner failed to provide the money for several months. If he really didn't care about the money and planned to donate it all back, as he claims, then he could have easily mailed us a check at any point in the last FIVE MONTHS. Doing so would have resolved the issue immediately.2. We will agree to change all of our reviews to contain "neutral language with no opinions," and will agree to neither post additional reviews nor interact with the owner in any way. However, we won't provide a notarized letter with such an excess of superfluous personal information--especially given that the owner has already violated our privacy rights by posting our full names and address for public viewing as part of his responses to our reviews. We would also expect the owner to revise the language of his responses to our reviews to also contain solely neutral language with no opinions or personal details.3. We won't increase the star rating of any reviews of the business or take any existing reviews down. The owner earned these ratings for himself in his dealings with us. We believe that the owner is currently holding our money hostage in order to coerce us into leaving dishonest reviews.
