My Mother, ***, was a resident at The Magnolia Court (TMC). She passed away 8/15/20. My contract with TMC states that agreement terminates upon death and removal of personal possessions are removed. I contacted location managing director, Donna ***, on 8/15/20 via ATT txt msg requesting to arrange for pickup of personal possessions. Her response was to decline my request suggesting a pick up the following week and she would be in touch with me. She did not contact me the following week so I texted her on 8/24/20 again requesting pick up of personal property. She had my Mother's personal property set outside TMC building the next day and I picked it up.
I have requested a refund of unused portion of the monthly resident cost of $4056 and have not received the refund or confirmation that the refund was issued. TMC Business Director, Tamecia *** texted me on 10/17/20 informing me that they agree I should receive a $2093.42 refund. 10/25/20 I followed up via txt to Tamecia looking for update. She wrote back that she will, once again, follow up this morning (10/26/20). I have not heard back from her despite my follow up at noon today.
In response to the compliant. Mrs. *** passed away on 8/15/2020. The first move out date on 8/20/2020 the family disputed. The policy states in the rental renewal notice that ". Unless otherwise
prohibited by state law, i.e. ***, Your estate or Your Guarantor will
continue to be responsible for all outstanding fees due at the time of Your
death and for fees occurring until the later of (i) fourteen (14) days after
Your death or (ii) Your personal possessions are removed from Your Unit as
described herein." The family contacted the OMBUDSMAN for the community and it was decided to honor the sons wishes and proceed with the move out date of 8/15/2020. All paperwork was submitted to corporate on 10/9/2020 with a move out date of 8/15/2020. On 10/16/2020 was the last communication that I had with the home office that the payment was in pending status meaning that the payment is processing. It may take up to 30 days. I have spoken with her son and informed him that we will do everything we can to help expedite this matter. It was an honor to take care of Mrs. *** from the beginning with her stay at Magnolia Court we have accommodated the financial burden to allow Mrs. *** to reside until her passing.

It is good to have a firm time period for action defined. Good communication flow is key to situations such as this one.
