RE:  Customer Complaint – Refund of $1000.00 Deposit

CUSTOMER:  [redacted]

Complaint ID:  [redacted]

Dear Ms....

[redacted],

This letter is in response to a letter we received from you on May 4, 2015 regarding the above mentioned customer and complaint ID.  The complaint submitted to you by [redacted] on 4/8/2015 has since been resolved.  We contacted [redacted] by phone and a refund check in the amount of $1000.00 was issued to her on 4/22/2015.
Please let us know if there is any further action required on our side.

Sincerely,

Harry K[redacted]

Complaint: [redacted]
I am rejecting this response because:
1) they tried to blame the transport company for the damage to the under bumper but the transport company receipt shows the car had the damage WHEN THEY PICKED IT UP. I can provide a copy of this and Vic's texts claiming the transport company would take care of it and then hedging after I sent a copy of the transport company receipt 2) the passenger seat safety belt sensor issue was corrected/fixed... so yes the car is now listed for sale by me with no issues now- I fixed it. This point is moot and has nothing to do with the issues noted when I received the car. Cars are repaired for resale everyday. 3) they never once asked for any receipts. They never asked for such when agreeing to refund monies.4) they are still holding the settlement amount hostage for feedback removal. I only agreed to feedback removal if I got paid---- I still haven't been paid. 5) new information about this dealer's unscrupulous ways--- when listing the car for sale the car fax came back with an accident noted on it that they never owned up to--- they claimed to me before I bought the car it had a CLEAN CARFAX but indeed it shows up with an issue.I stand by wanting the settlement as noted. They are again smoke screening this matter to try and ignore the real issues.
Sincerely,
[redacted]

This letter is in response to a complaint we received
regarding a 2006 BMW 650 we sold on eBay to Mr. [redacted] on March 15,
2017. Mr. [redacted] is complaining that he received the vehicle with some issues
that would cost $450.00 to repair, and that we were unresponsive and have since
been...

holding his refund "hostage" till he removes the negative
feedback he left for us on eBay.I spoke to Vik, the salesman who has been corresponding with Mr. [redacted],
and he has provided me with various text and email conversations he has had
with Mr. [redacted] since the purchase of the vehicle. It appears Mr. [redacted] had
been trying to threaten us with various negative online reviews if we didn't
agree to pay him $450.00 for repairing issues - that were not present when we sold
the vehicle to him. When the vehicle left our premises, there was no apparent
visual damage to the undercarriage of the vehicle, except for the minor
scratches which were mentioned in our eBay ad. There was no problem with the
seat occupancy sensor malfunctioning when the vehicle was in our possession at
the time of sale. Looks like the undercarriage scratches took place when the
vehicle was being delivered to Mr. [redacted] in Virginia. We told Mr. [redacted] to
talk to the shipping company about the undercarriage being scraped during
transportation. The vehicle was sold AS-IS with NO WARRANTY, and we always
encourage buyers to check out the car in person, or have it inspected, and even
though the scrapes/scratches on the undercarriage (which were probably caused
by the shipping company while loading and or unloading of the vehicle) and the
seat belt sensor were not an issue when the vehicle left our dealership, as a
courtesy we agreed to pay $450.00 to keep him happy. We have been in business
since 1984, and have always tried our best to accommodate our customers. We had made it very clear
that the $450.00 refund we were giving him was contingent on his removing the
negative feedback he had posted on eBay. According to eBay rules, he had ONE
WEEK from the day we sent a request through eBay for him to remove the negative
feedback. We spoke to him several times during that week to remove the negative
feedback so we could mail him the refund check. He refused to that. Again, the
only reason we were giving him the $450.00 was in exchange for removing the
negative feedback. He never provided us with any receipts or estimates from any
repair shop that he ever needed or had any work done, for any dollar amount.
But, had he removed the negative feedback, he would have received his money.
Now we see he is adding an additional $150.00 to that amount. Please let him
know that we are still waiting for him to remove the negative feedback on eBay.
Only then will we pay him the $450.00 that we promised to pay him.Interestingly enough, Mr. [redacted] has now listed the
same BMW back on eBay and mentions that "Everything works and performs
like it should", "Looks, runs and drives excellent", "You
can tell it was a well loved vehicle", "very clean low mile vehicle.
Nothing ouside of usual use. Normal use wear such as few minor nicks, dings
from road rock chips, less than what a used car ofsuch year may have", etc. etc.I have enclosed a print out of the eBay ad for your review, along with a
full page of his description of the condition of the vehicle, and a few emails
between Mr. [redacted] and our sales associate, Vik.Please feel free to contact me anytime at my office at ext [redacted], or on my
cell phone at 206-679-6456 if you have any questions.

after receiving the $1050.00 payment. Below is a copy of his email to us regarding this matter.
