Review: I called and spoke to someone in the office on 1/*/16 at 4:25 PM, and explained the situation. I was given assurances that there would be no problems with getting 3-4 service attempts by the end of January.

In my initial email, I stated "It needs to be served to the end of January [redacted]. Please let me know if you'll be able to get 3-4 attempts in by then." and they responded responded "Ok received and will have someone go early". According to Majestic, there was ONE attempt made before January [redacted] and it was to the wrong address. It should not have been difficult for the Process Service to look at the paperwork and verify the address.

When I asked for the time/date of the attempted service before January [redacted], they replied "[redacted]" With email and texting, it should not have been too hard to let me know that there was a problem. Why I was not immediately informed of the issue?

They claim they attempted to do the service 5 times, but previously they told me that prior to [redacted], they had only tried once. The affidavit has 2 more attempts on [redacted]. It was pointless to try after [redacted], as that was the due date. I did not authorize any attempts after [redacted].

Then they claimed they "charge by address, if you paid them for the server going to the residence that's where he went." But I have previously used them and they charged the same amount ($50) for attempts at 2 addresses.Desired Settlement: A full refund.

Response:

The customer provided the wrong address to be served. The process server is not responsible nor is the company to search and read the paperwork provided with personal information inside. By law we are supposed to hand deliver the papers to the address provided. If the address provided is not correct the paperwork is returned and the customer is contacted. The customer was contacted via email and we were told it was the house next door. The server advised us that he went up and down the street numerous times the same day looking for the car. It was not located anywhere on the street at any address. We were asked by the customer to try it asap and we did. Because the address was wrong the further attempts that were made showed to be a waste of the servers time as he didn't know the address he was repeatedly going to was wrong. Therefore the server had to be paid to rush out there the next day in order to attempt asap and was paid by us 30$ for doing so. WE do not send our servers out to ride around with their gas and their vehicle to go out for free just because the customer supplied us with the wrong address. By his own admission in the complaint he supplied the wrong address and we are not at fault for him calling us back with the right address days later when we were out of time. The server is an independent contractor of majestic and did the job and as stated above was paid 30$ for the job. Therefore the customer can receive a 20$ refund that majestic was to receive and if that does not settle the case for the customer he may sue the server [redacted] who has since he has left employment with majestic since that month. We are willing to forgo the 20$ that we would have made off the service but that is all the company is responsible for. Furthermore enclosing we have two offices and the other attempts required were mistakenly emailed to the North Carolina office so the New York office would only have known of the one service when he called. There were. Multiple attempts before the deadline and customer was offered an affidavit of attempt. We are not licensed private investigators and have no way to search for the right address we have to use what is provided. We have been in business since 2007 with zero complaints. The customer was given ample time from the court to serve the papers he should have extended us the same.
