Adrian and I came to a verbal agreement on how much it would cost to remodel my already enclosed front porch. After the verbal agreement, I asked for a contract which I was told that I did not need. Therefore, I wasn’t given one. I was given a timeframe of two days. I requested three days off of work just in case one extra day was needed. Before the job was even started Adrian asked me out for a drink, which I declined because he is a married man and I am not that type of woman. When he started the job on Wednesday, May 15th of 2019 he was not done by Thursday May 16th as he stated and said he would return the following week on Tuesday. Tuesday he returned once again with him team. I had to take another unexpected day off of work so this “two” day job can get completed. Tuesday he left and said that he will return alone on Thursday evening to to put a closet rod up and some knobs on two closet doors. He removed two windows from my front porch and took them, I informed him that he would have to pay me for the windows that he took, as they were brand new and cost over $100 each. He then stated to me that he thought I was donating them. I told them that I was not donating them and wanted the price to be deducted from what he originally quoted me and he agreed. The day that he was to return to put up the closet rod, he informed me that it would be later than 6:30pm which as a single female with a toddler at home I was not comfortable with. Again he mentioned to me about having a beer with me when he returned. He didn’t sand and paint the areas where the windows were removed and did not remove the garbage from my home, but simply placed in behind my garage in my backyard. Since, I denied his proposal for a drink I believe that he purposely left the job undone and the verbal agreement has now gone up by $700. He states that it’s for materials. However, I purchased $300 worth of materials as per our verbal agreement. I have paid him $1,300.00 in cash which he did not provide me with

Mala Construction Response • May 30, 2019

On April 22nd , 2019 *** contacted the office about her job, and asked if someone could come out and give her a free estimate. The office scheduled her for 3:00 pm on that very same day. My wife and I went over to her house. *** asked me to give her an estimate for two bedrooms and the front porch. The price would be for labor, paints, and materials. The contract that I sent her stated that. A few days later, *** contacted me and asked me if I could come over and just give her an estimate for just the front porch. I told her that I will come over when I’m finished working. I went to her house with one of my workers to see her job when I was finished working. I gave her a price just for labor, and I told her that it would be $1500.00. After that, she said that she would pay for all the materials. I told her that the front porch will take two days, so I scheduled her for May 15th , 2019 and May 16th , 2019. I even gave her the paints for the front porch and the front door for free. I didn’t know at that time that we will go over 2 days because when I got there it was more than I expected. So I told her that we will have to come back on Tuesday, May 21st ,2019 and she agreed to that. When I finished the job on May 21st she only payed me $1300.00 in cash and the project that I did for her was $1500.00. She didn’t have the rod and the door knob so she said that she will go to *** to pick it up so I asked her what day will be best for me to come back to put the rod and the door knob on and she said Thursday May 23rd 2019. I told her that when I was finished working on Thursday that I will come by her house to just put the rod and the door knob on. She said Okay. On Thursday I texted her and told her that I was going to be late and she said Okay. After she said okay, she texted me again and told me that she doesn’t have anyone to let me into the house to put the rod and door knob on. Not only did I not get to put the rod and door knob on but *** did not pay me the rest of the money that she owed me for the $1500.00 job. She still owes me $200.00 in labor. Also, I had spent $538.90 on materials and *** was supposed to pay me back for the money I spent on the materials for her job and I also charged her $150.00 to paint the baseboards, install quarter rounds and to paint the closet doors. In total, *** still owes me $888.90. To speak about what happened to the windows the second time I went to *** house to give her an estimate for the front porch, I asked her what she was going to do with the windows and she told me that she was either going to donate them or I could have them. I told her that I will let her know if I wanted them. The day I took out the windows was May 15th, 2019 and on May 16th 2019 I texted her and told her that I was going to take the windows and she said that she wanted a $100.00 discount on the windows. I told her that I thought she was going to donate them. My wife contacted *** on may 24th 2019 through messages and then they had a conversation on the phone to try and resolve the problems of the windows, bills and receipts, because *** wanted proof of the money that she owed me and she also wanted a receipt of the $1300.00 that she payed in cash. On May 25th, 2019 *** father called me and verbally abused me by cursing me out and telling me to go to his daughter *** house and finish the job I started. When I tried to explain to *** father that his daughter didn’t want me to go to her house to finish the job because she didn’t feel comfortable with me around he wasn’t listening to me and wouldn’t let me speak. He just kept cursing me out. On May 28th, 2019 my wife contacted *** for a date and time that she and one of the workers can go to her house to provide the information that she asked for and to also put on the closet rod and door knob. *** texted my wife back and said that she thought my wife was going to call her on Sunday and my wife never told *** that. I’m very sorry if I offended *** by asking her if she wanted to take a drink, but I was just joking around and that was very unprofessional of me and once again I’m sorry about that. I will provide some text messages and all the receipts down below. Thank You very much.

Customer Response • May 31, 2019

I’m writing to you in regards to my complaint, I am not working on a desktop as my work hours fluctuate and make it a little difficult to get to a computer. I’m working with my ***, so please bare with me. I’ve read was received from Mala Construction in regards to my complaint. What he is claiming is mostly fabricated and bogus. First off I asked for a contract for the PORCH that was being done and NOT the bedrooms that were previously quoted and I was denied a contract for my porch. Therefore, it is my belief that he was starting my project off with I’ll intent. He was also working on other projects at the same time and it is my firm belief that he is trying to pass those receipts off as ones that he utilized for my project. He clearly stated in his response that “I” was to purchase the materials for my project which I did and I have receipts to prove so. If he took it upon himself to purchase materials without my knowledge or me being present, that is solely on him. Furthermore, my porch is only 120 square feet and was already enclosed before he began his project, he only had to put sheet rock up where he removed my windows and for the closet. To say that he spent $538 and change on materials is absolutely ridiculous and absurd to say the least. Especially, when I had already spent roughly around $300 which I have receipts to prove that. I bought the flooring and the doors which are the most expensive, amongst other materials. Also, asking a SINGLE mom of a toddler who resides at home ALONE is absolutely unprofessional. What professional jokes in that manner with a client? Especially without even knowing them? The fact that he asked me TWICE about having a drink with him, is a clear indication that it was NOT a joke and I didn’t deem it to be as such! I honestly don’t feel like I owe him a penny more. As he clearly stated in his own response, the job took more than the two days the he quoted me. I took three paid days off from the 15th until the 17th and made it clear to him that I took three paid days off in case one additional day was needed. I also informed him that I had no more PAID days off. He made me wait five entire days before he resumed to complete the work. I additionally had to take one unexpected UNPAID day off of work, after my work schedule was already made at my job. He stated in his own response that he was waiting for me to purchase the closet rod and doorknobs so that he can return yet another day to put them on. He is clearly indicating on his own admission that I was purchasing the materials and that I had to wait yet another day for him to complete the job. The windows I never said that I would donate to ANYONE, I stated that I was unsure of what I was going to do with them. I stated that I would possibly sell them for $50 each. Adrian said”I’ll tell you if I’ll be taking them or not” the next day Adrian took the windows and informed via text message after the fact. I then requested for him to deduct what I was going to sell it for which at the time was $50 each because I didn’t research and educate myself on the value of the windows. The paint was not free, it was part of the $1,500.00 agreement. He left all of the garbage behind my garage and stated that if I want the garbage removed that he charges a fee. I’ve worked with numerous contractors in the recent years and have never heard of such a thing. He also stated that he’s charging me a delivery fee to deliver sheet rock that he purchased without my knowledge. He also stated that he’s charging me for nails. That is absolutely an insult to my intelligence! How else was he going to get the job done without nails and glue? I had my entire roof done and the contractor didn’t charge me for tarp and nails. Furthermore, that is out of the scope of the initial $1,500.00 that we both agreed upon. So is the bogus $150.00 that he is charging for painting two bifold closet doors and moulding. We did not discuss that initially. He didn’t level out my floors when I asked him to. Now you can feel air pockets in my flooring and hear them creaking when you’re walking on them. Also, because of this my baseboards are slanted and not even. He also didn’t sand or paint the shelves in the closet that he constructed. Which gave me splinters when I was trying to clean the dust off of them. He also didn’t sand or paint the exterior walls where the windows were removed from, on the opposite side of the porch. Those two rooms which include a bedroom and my living room are left with exposed sheet rock and compound. The paint on the door, is already peeling. He and his crew were constantly using my microwave to heat up their lunches. They were using my bathroom constantly. One worker was in the bathroom for half hour, that is my only bathroom and I had family from out of town at my home at the time. They were using my garbage bags and extension cords. They were completely unprepared and by far the absolute worst company that I have ever dealt with! This situation has caused me an extreme amount of stress and I just want it to be over with! I spoke to Adrian’s wife Mala over the phone and she had indicated that she would call me on a specific day and take care of things and asked me if I could remove my negative review from their *** page. I agreed and removed my review and after that I did not hear from her on the day that she specified. When I finally did hear from her, she retracted what she verbally told me when we spoke over the phone. At this point I do not trust either of them and do not feel that the company is competent enough to complete the job. Also, I feel I will incur additional expenses once again. Clearly it is an extra cost to complete the job, if Adrian was already trying to collect additional payment with the job left undone. I honestly feel like between me having to now contract someone else to repair the mess they left and pay for garbage removal and an unpaid day off, that I otherwise would have not incurred if it wasn’t for their incompetency, and the windows that were taken without my permission; that I am the one that is owed compensation. Not to mention the state of duress that this whole situation has left me under. They can keep the windows at this point. It’s a wash and I NEVER want to hear from them again! Attached are screenshots of text messages and pictures of the mess that was left for me to clean up. Thank you for your attention to this matter.
