Review: In December 2012 an [redacted] Sheriff came to my place of business with paperwork demanding payment in cash or property in the sum of $1469.81 on behalf of [redacted]. I was told that there is a judgment against my business and my husband for the above sum granted by the Munroe County Court. I called Malen & Associates several times to let them know they have the wrong people but they did not believe me, I was advise to get an Attorney which I did. He got it straightened out however, I am left with a bill of $234.00 which I am asking Malen & Associates to take care of. MY HUSBAND AND I have NEVER done any business with [redacted].

I talked with [redacted] of Malen and Associated several times and their information clearly shows that we are not the people on file. The people they are looking for are in Rochester, NY, Munroe County and we are in Buffalo, NY, [redacted]. I did not want this on my credit.

PLEASE help me in what ever way you can. Thanking you in advance for you assistance.Desired Settlement: For Malen & Associates, P.C. to pay my Attorney fees of $234 and clear our name of anything negative they have against us. Thank you.

Malen & Associates obtained a judgment against a [redacted] and [redacted]. on October **, 2012. The judgment was for a default on a credit card with [redacted].The judgment debtor was located in [redacted], NY and the [redacted] Sheriff attempted to execute on that judgment in November 2011. No funds were collected and no property was garnished by the Sheriff. No further collection efforts were made on the business.An attorney claiming to represent the business and [redacted] contacted our office to confirm whether his client's were the judgment debtors. [redacted]'s driver's license was forwarded to our office. We were able to confirm that [redacted] was not the judgment debtor but it appears that someone opened the [redacted] account using his nickname "[redacted]" and the name of his business. There were no further collection attempts made against either [redacted] or [redacted]. There is only one corporation using that name in New York State, as such, after speaking with [redacted], we have reported this as a fraud situation to our client. I have forwarded [redacted] an affidavit of fraud for her to fill out on behalf of her business.Currently, we are awaiting the result of our client's fraud investigation and the return of the affidavit of fraud. This account is on hold in our office and no collection attempts are being made. The [redacted] Sheriff operated according to a valid New York State judgment after it was ascertained that the business was located in [redacted]. There was no wrong doing on the part of Malen & Associates or the Sheriffi's office that would result in the awarding of attorneys fees. This may in fact be a case of fraud. Furthermore, Malen & Associates does not credit report.
