Maley-Yarbrough Funeral Home, Inc.

In making the arrangements with Yarbrough-Maley Funeral Home for my sister [redacted]'s funeral in late August 2014, we found that a burial plot had to be paid for right away, or my sister's ashes would have been shelved until the plot was paid for. My sister's friend,[redacted], with Power of Attorney and total control over my sister's Trust as well as her ex-husband's estate, which provided funds for her care as she suffered with Alzheimer's, was not approved of by me or my brother's as she was determined that my sister's only two next of kin (her two grandson's) would not receive any of their rightful inheritance (and they did not). Either my sister's trust or her ex's estate or both were to pay for all of the arrangements. I was assured by[redacted] of Yarbrough-Maley that my payment for the burial site would be included in the total bill that they would send to the Power of Attorney. They failed to fulfill this promise and never sent the bill for the burial site so they could reimburse me until I e-mailed and called more than once. Ultimately, I spoke with "[redacted]" who was very short and not nice to me at all. He said the cemetery was a separate entity. I told him that nothing was ever said to me about any separate entity. I picked out the plot and received the Deed from Maley-Yarbrough in their office during my one and only visit there. Yarbrough is the owner of the cemetery. [redacted], in a mean manner, asked me "exactly what do you want me to do, send a bill for the plot"?? Of course, this was the agreement from the start and Maley-Yarbrough failed to do what they assured my brother, my sister-in-law and me that they would do.[redacted] failed to do her job. I do not know if the Power of Attorney has yet to receive a bill. It is not my duty to contact her or the attorneys. Maley-Yarbrough owes me money that I paid to them and trusted them to follow up, and return my money to me. I live on Social Security and I need my money.Desired SettlementMaley-Yarbrough owes me for my sister's burial site. I want my money back as I was promised by [redacted]. They failed to do their job. I was forced to pay for the plot up front to Maley-Yarbrough in order that my sister's burial arrangements could be completed and I could return home to[redacted]. Mrs.[redacted] did not do what she assured me she would do. I have no connection at all to[redacted]. I can tell you that my brother[redacted] spoke with Ann [redacted] and she assured him she would take care of all the expenses for my sister's arrangements. I have had no business dealings or otherwise with[redacted]. We met very briefly at my father's funeral about ten years ago and I recognize her when I see her. She was at my sister's funeral, but she did not speak to anyone. She did go into the Maley-Yarbrough office prior to the funeral as the funeral services were at their facility. There is no matter between[redacted] and myself, as stated by[redacted]. Never was, and never has been.
