I am glad to see that Mr. M[redacted] is
willing to work to resolve this issue, which is all I ever wanted all along,
but just to clarify:
 
The issue with the kitchen sink only
came to light AFTER they finally completed the half bath (which was after the
punch list was created).  They installed a faucet similar to the one in
the kitchen (with a single lever off to the right side of the faucet) in the
half bath but the hot and cold water was reverse from how it was installed in
the kitchen.  The plumber who installed the faucet in the half bath said
that the one in the kitchen was installed wrong. That is why the kitchen faucet
became a punch list item when it did.
 
As far as the fireplace, Mr. M[redacted]
is correct that it was not on the original punch list but I believe that
MWC has an obligation to correct the issue since I paid them to install a
working fireplace and final sign off of the project has not occured.  In addition, I was never told that it was a
manufacturer issue vs. an installation issue.  I’m not even sure how MWC knows
that its manufacturer issue vs. an installation issue since nobody has looked
at it (except for Matt Galassi and Drew M[redacted] who clearly are not fireplace
experts). And the only reason that I
purchased the fireplace directly from [redacted] is because that is
what MWC had suggested I do, almost as if they knew something like this might
happen.  For Mr. M[redacted] to say that “MW
should have declined to help Brad resolve his fireplace issue and should have
told him to handle that issue directly with [redacted]” is just unprofessional.
 
I would be happy to meet with Mr.
M[redacted] in order to bring this issue to closure.

Date: Wed, Aug 10, 2016 at 4:57 PMSubject: [redacted] Response - MW Construction Services, LLCTo: "[redacted]@myRevdex.com.org" <[redacted]@myRevdex.com.org>[redacted], Hope you're doing well.  We were of the understanding that this complaint was closed but are glad to provide the response below.  We're more than willing to work to resolve this issue with [redacted], as long as we're all working with factual information about the correct timeline and contractual inclusions. Our crew finalized the items on the signed Change Order by the 3/9/16 completion date.  Note, I've attached an email from [redacted] which shows that he extended the completion date by 1 week.  Please see the attached Change Order.  Nowhere on the CO does it mention an issue with the kitchen faucet or the living room fireplace.  The kitchen faucet issue was not even communicated until an email on 2/25/16.  Drew M[redacted] asked [redacted] about accessibility to the house and [redacted] left Saturdays or Sundays as the days the house would be available.  We sent our crew out to take care of these items, even though they were not on our contractual scope of work.[redacted] paid for the fireplace directly through [redacted].  Our project management team, crew, and Drew M[redacted] all investigated the issue and determined that it is a manufacturer issue, not an installation issue.  This was communicated to [redacted].  Drew M[redacted] with MW Construction told him I would have to call [redacted] to schedule some sort of warranty call.  Drew M[redacted] was unsuccessful in scheduling with [redacted] and was not getting clear answers.  Drew M[redacted] asked [redacted] for his receipt to see if that would help.  Drew then called [redacted] again without avail but did not communicate the progress or lack thereof to Brad.  This was clearly an error on our part, but still it was not a contractual issue for MW Construction. At the end of the day, neither item were on our signed and agreed upon completion list.  MW was trying to go above and beyond for [redacted] on an item we did not purchase and that was installed properly.  MW should have declined to help Brad resolve his fireplace issue and should have told him to handle that issue directly with [redacted].  No good deed goes unpunished, but we always want to go that extra mile for our clients.  Per the timeline above and Final Change Order, liquidated damages were not incurred. I'd be glad to meet with [redacted] so we can put closure on this issue.  Please let me know. Thank you, Greg M
