subcontractors: During the building process the buyer went directly to the flooring supplier and upgraded the flooring to BambooThis is an extreme upgrade the builder would never recommend and certainly would not recommend its installation on a concrete slab foundationThe builder has addressed this issue with the buyer and again suggests the buyer contact the flooring supplier directly for this correctionThe buyer made this upgrade thru the flooring supplier not the builder The concrete spot in questions is minorIt has been addressed by the builder, is well within the concrete specifications and is a minor cosmetic issue at bestThe buyer has been informed the builder does not intend to further address this minor issue further The two door handles have been addressed by the builderThey are a minor adjustment and will be addressed again by the builder in the near future The swing of the laundry room doors both into the hall and into the garage from the laundry room were discussed with the buyer by two builder representatives when they were installed and at the final walkthroughThe builder questions the safety of the door opening into the garageThe buyer agreed to accept the doors as they were installed, which are the standard installation for this builderIf the buyer wants the doors reversed the builder will preform the change but at the buyers expense The lot drainage has been discussed numerous times with the buyerThe swale at the North edge of the house holds some water after a hard rain or severe snow melt for a short timeThe lot to the North is vacantThe buyers lot is a low spot in the subdivision and has been graded by the builder to provide the best water run off on all sides of the lotThe developer is also making some adjustments We'll have this walk through within a couple days of July 27th, which is one year from the closing date, to find issues throughout the house. After we summarize all the work that needs to be done, Foster and Park Homes will notify our service department of the work that needs done. A schedule will be made to address issues throughout the home that are covered by the warranty we offer.
We again apologize for inconveniences our home buyer has experienced. Our customers are the core of our business, and we intend to comply to their requests within reasonable endeavors.

The builder respectfully disputes the filing of this complaint buy [redacted] (Buyer) against Foster and Park Homes LLC...

(Builder). All of the listed items have been or are being addressed by the builder or the builder subcontractors:
1. During the building process the buyer went directly to the flooring supplier and upgraded the flooring to Bamboo. This is an extreme upgrade the builder would never recommend and certainly would not recommend its installation on a concrete slab foundation. The builder has addressed this issue with the buyer and again suggests the buyer contact the flooring supplier directly for this correction. The buyer made this upgrade thru the flooring supplier not the builder.
2. The concrete spot in questions is minor. It has been addressed by the builder, is well within the concrete specifications and is a minor cosmetic issue at best. The buyer has been informed the builder does not intend to further address this minor issue further.
3. The two door handles have been addressed by the builder. They are a minor adjustment and will be addressed again by the builder in the near future.
4. The swing of the laundry room doors both into the hall and into the garage from the laundry room were discussed with the buyer by two builder representatives when they were installed and at the final walkthrough. The builder questions the safety of the door opening into the garage. The buyer agreed to accept the doors as they were installed, which are the standard installation for this builder. If the buyer wants the doors reversed the builder will preform the change but at the buyers expense.
5. The lot drainage has been discussed numerous times with the buyer. The swale at the North edge of the house holds some water after a hard rain or severe snow melt for a short time. The lot to the North is vacant. The buyers lot is a low spot in the subdivision and has been graded by the builder to provide the best water run off on all sides of the lot. The developer is also making some adjustments addressing water run off. The builder is not the developer. The builder advised the buyer against this lot for this very reason as well as against being the first lot to build in this new section of the subdivision. Again the buyer chose to disregard the builders input. The builder has advised the buyer numerous times there will be no further adjustments to the lot.
It is important that the Revdex.com as well as the buyer be aware that the one year warranty period has not expired and will not expire until July of 2016. The builder will continue to service the buyer within reason during that warranty period. The buyer has been excessively persistent and at times unreasonable in her expectations on what items and how issues were to be addressed by the builder.

I am replying to the email you sent me. I had received a call from Foster and Park representative Jack McCombs on January 8, 2016.
He had said he realized there were a list of things they have not completed and asked me to go over what was yet to be done.
He asked me to text him every Monday letting he know what work had been completed. I have sent him texts January 11, 18 and 25th telling
him I had heard from anyone to work on the house and nothing has been done. I have not received any replies or heard from Mr. McCombs since
his initial call on January 8, 2016. So that is where things stand since I filed my complaint with the Revdex.com.

We are sorry that [redacted] (Buyer) is not pleased with our response. We are also not surprised. We feel the buyer has not been reasonable about a number of issues during the construction process. We are answering the very same issues we addressed originally. We will again answer each item separately.

1. FLOORING. The upgrade in color had nor has anything to do with the color preference of the buyer, it is the material. The buyer went to the flooring representative and upgraded her laminate flooring to a bamboo material. We have been told by the flooring contractor this flooring is very difficult to work with, takes special treatment to prevent it from drying out and then cracking and in some applications is not the material that should be used. The builder is aware that bamboo flooring is prone to performance issues. The buyer went to the flooring contractor without our knowledge, picked the flooring, signed the agreements and we were then told by the flooring contractor we needed a change order in excess of $10,000.00. IT WAS NOT A CHOICE MADE THRU THE BUILDER. IT IS NOT A MATERIAL THE BUILDER WOULD HAVE RECOMMENDED. THE BUYER OFTEN MADE CHOICES THRU INPUT FROM OTHER SOURCES. The flooring contractor is in the process of setting an appointment with a representative from the flooring supplier to access the issue. THIS IS NOT A MATERIAL WE RECOMMEND. WHEN THE BUYER MADE THIS CHOICE SHE TOOK RESPONSIBILITY FOR THIS MATERIAL CHOICE AND THE ISSUE IS NOW BETWEEN HER AND THE FLOORING CONTRACTOR AND SUPPLIER. We feel we are being unfairly accused of something we knew nothing about and would not recommend to the buyer. We will not assume responsibility for this flooring choice.

2. CONCRETE. The issue is minor and falls within the minimum standards set forth in the "Indiana Quality Assurance Builder Standards for Home Building & Remodeling". The spot she is claiming as a patch to locate a waterline is really a spot where the water shut off is located. This was located there prior to construction of the home and the driveway by the city. The cap of the shut off is slightly below the surface of the drive and the concrete had to be chipped around the cap to provide access to the water shut off. The shut off could not and cannot be moved and the scaling the buyer is referring to is minor and within the minimum standards in the builders opinion.

3. DOOR HANDLES. Although the builder in more than one effort has not been able to make the door handles not function correctly, the builder has agreed to replace the bedroom door handle and ADJUST the front door handle. In the opinion of the builder neither need to be replaced but agrees to replace the bedroom handle and mechanism.

4. TWO LAUNDRY ROOM DOORS. The doors are installed per the floor plan the buyer agreed to at the time she signed the construction contract. There has been conversations with the buyer and builder representatives regarding the swing of the doors. There has never been a change order to change the door swing and each time it was discussed the buyer agreed to leave them as they were. The doors are installed correctly. They are installed per the floor plan drawings initialed by both the buyer and the builder. The doors both function correctly and have been installed correctly. The only issue now is the buyer has decided she would rather have one or both swing in a different direction. This is neither a malfunction of the door nor negligence on the part of the builder. The buyer is mistaken regarding the January 8th conversation. The builder representative stated the doors could be changed, BUT NOT AT THE BUILDERS EXPENSE. IF EITHER OR BOTH OF THE DOORS ARE TO BE REVERSED THIS IS A BUYER PREFERENCE, NOTHING MORE, AND WOULD BE ACCOMPLISHED AT HER EXPENSE. The builder has built this base floor plan many times and the doors have always been installed opening into the room not out into the garage.

5. LOT DRAINAGE. When the lot was installed the water drained from the lot thru a swale as intended. Since the builder installed the lawn and fine graded the lot the buyer has had another contractor install a large patio off her covered rear porch. The pile of dirt shown in the picture was not left there when the builder was finished with the lawn installation. The lot drainage has been altered since that installation by a contractor not involved with the builder. Additionally the lot to the North of the buyers property has not been built on, has not been graded to control water drainage and will not be until a house is constructed and completed on that lot. The buyers lot is at the bottom of a long gradual slope at least one block long and is affected by drainage at the rear that both the builder and buyer have been told the developer will address in the future. We have no control over that drainage issue, the disturbance caused by the patio installation, nor the undeveloped lot to the North of the buyers lot. The water issues the buyer has are 1. minor, 2. will be corrected when the lot to the North has a home constructed on it, and 3. not caused by negligence of the builder.

Again, we have addressed each of the buyer's issues. Except for one, the door handle adjustments, the complaints are not issues that are or should be damaging to the builder. This the first complaint this company has ever had to the Revdex.com. The builder takes pride in his work and does everything within reason to make his clients satisfied. Regrettably we feel this is not going to end well for the builder and will put an unfair blemish on the builders record. There is only so much that can be done to satisfy all of our clients' desires.

I still stand behind my last response. As for the patio it did not alter the lot drainage. There was an issue of the lot drainage while the house was being built and address at closing. The only place the dirt was removed is where the patio now is. I have sent pictures of water sitting on my lot before the patio was installed and sent them to builders representative before any work was done with the patio.
