Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: This letter is in response to the e-mail received I understand the signed contract states tovisually inspect the equipment The equipment was and still is in great condition to a visual inspection The problem here is due to a manufacturer defector poor worksmanship, the unit never functioned correctly from day one Under paragraph of the contract, it states “our limited liability, except where Manatuck Heatingand Air fails to perform its obligations under this agreement in a skillful andcompetent manner” As a payingcustomer, hiring a professional to provide a fully functioning air conditioningsystem Manatuck Heating and Air Conditioning has failed! [redacted] has neglected to include some very important details withthis case From the day of installationthere have been issues, the unit was never pressure tested to insure there aren’tany leaks from defects or workmanshipThe fact that the unit was never filled and balanced due to the coldweather on the day of installation In the first year, [redacted] returned to my home several times tofill and sometimes over-fill my unitThe second year, he was back again, several times, due to the unitleaking and not functioning correctlyAt this point, he never investigated or performed any leak test, whichwould have found the trouble No, againhe filled the unit and gave me a story The third year, [redacted] filled the unit again,which the unit leaked out yet again and towards the end of that year he filledthe system and pumped a sealant into it, which again never fixed theproblem During all these service calls, there was never any talk oflabor charges as [redacted] has known from the very beginning that the system hasbeen leaking Only when I contactedother experts in the field to discuss my on-going issues with the system, andwas advised by several experts to have the installer pressure test the systemhas [redacted] informed me of service charges [redacted] has had multiple opportunities to perform the test, but NEVER has! 'sans-serif'; color: #333333;">I have always stayed in contact with the complainant. If there was ever a time where I did not respond immediately, it was with reason and not intentional. I told the complainant via text message that I do not have a problem doing the labor, however, I would have to charge for it because the labor warranty has expired. I also explained that the warranty on the parts of the unit are still effective. The only charge is for the actual labor, nothing else. I understand that $6,500 was paid initially, but that does not void the fact that the labor warranty has expired. I am only responsible for installing the equipment, I am not responsible for faulty equipment. The contract signed for specifically states that the customer must inspect the equipment immediately upon delivery and prior to installation. I do not have a problem doing the labor, I do have a problem with the complainant's refusal to pay me for it. Again, the parts are stil l under warranty, so that is nothing that has to be paid for, only the labor. The contract specifically states that the compressor has a lifetime warranty, the air handler has a 10 year warranty, and the labor has a 1 year warranty. The parts warranty, coming from myself, was only for 1 year. If they needed parts from the manufacturer, they are still under warranty. So, again, I would like to make clear that the labor warranty is expired, but their parts are still under warranty. There was clearly a break in communication, and I want nothing more than to solve this problem, however, I refuse to perform work at no cost after the labor warranty has been expired for 3 years.

Review: In February 2010, I had a central air system installed in my home. The unit has never worked properly, the installer has been to my home more times than I can remember to keep filling the unit with refrigerant and sealant. I had the same problem again this year, There is obviously a small leak somewhere and the installer is not putting the effort in to find the root of the problem. I have contacted a couple of professionals in the field who have recommended that I have the installer pressure test the unit to figure out where the problem is. At first, the installer agreed that that was the course of action he needed to take and would be in contact with us about his availability. We never heard back from him after numerous messages, text messages...we have had to resort to calling from a different phone number to get him to take our calls. Again he agreed that he would be in contact to come over to pressure test the system. A few more days passed and still nothing. Finally, he texts us back and tells us that he wants to charge us to come to preform the test. We have already paid this man $6,500.00 and we do NOT have a working air conditioner. Keep in mind the unit has never worked properly. He fully agrees there is a problem but wants to charge more money for a unit he installed and he is fully aware that it has never worked properly.Desired Settlement: We would like the installer to come here to pressure test the unit at his time and expense and fix the leak once and for all or we could hire a professional to fix the unit that he is not capable at fixing, at his expense.
