I am rejecting this response because: as stated in prior rebuttals, Bruce & I signed the contract in Jan I terminate contract in NOV due to default on both production & delivery. Be aware please: that was months after signing!!Bruce chose to go to Bali in Nov because of his involvement with the local election. That was his personal choice. My projection was put on the bottom of his priority list because of the choices & priorities he chose! I'm truly sorry Bruce feels "bullied" & "threatened". My intention is to take every known action to prevent a lawsuit! I do not want to spend my time, energy, additional resources on the legal system in court! I do want Bruce to make me "whole" by repaying me in 2017.Bruce states that the "*** drawings were all prepared & waiting for *** to come home...to submit to County. Instead she chose to cancel upon her return." Please be advised, I returned to island in June 2016, to prepare to receive the completed product, shipped from Bali, as per our contract I terminated said contract, in NOV - MONTHS later - for default reasons stated above Please recall the contract states: "shipping: Summer 2016."My truth is this: it's now months later, Bruce has my $41,AND a partially constructed prototyped *** roof. To my knowledge, there is no completed greenhouse structure because construction never began! I have nothing, except the proverbial "short end of the stick!"As previously requested, I want to be made "whole" by Bruce refunding my entire deposit due to his defaulting on both production & delivery.As suggested by Revdex.com, I have filed a complaint with DCCA. I have been assigned a case worker & be will following up on Sep.

Dear Revdex.com Hawaii,The customer chose to cancel the order just weeks before I was scheduled to go to Bali to solve some engineering challenges to move the project forward The most time consuming and technical aspects of the project was already complete, that is the world's first wooden, curved beam *** ** *** *** roof Photos are attached We made model prototypes first to perfect the design The technical difficulty was putting the completed *** up on a ring beam with pillars and an eave deck roof I could have moved the project forward with an inferior design on this aspect In the interest of quality I felt it best if I was personally there to engineer this difficult aspect The customer was well aware that I could not go to Bali until November of Once this engineering feature was solved, the project could be completed within weeksThe materials were all in place.I offer *** this *** ** *** *** cottage basically at my cost price This is a gift I gave her as a friend, as a member of the community, and for her to receive something truly special at a budget price Every other import kit house builder offers their customers only 50% refund for canceled ordersI am generous and offer 75% when the project is sold to a new customer*** is basically trying to bully me into giving her a 100% refund by blaming her cancelation decision on the time delay that she was well aware of and understood the reasons for A 75% refund is more than generous considering all the time and effort and costs I have put into her project, and is the terms of this contract No amount of threats of legal action will get her the 100% refund she wants to get Love and kindness and cooperation in finding a new buyer might get her the 100%, but not threats and bullying.As for the permit, my contract is to assist her in the application process I cannot legally apply for a permit on her behalf The *** drawings were all prepared and waiting *** to come home from her extensive world travels to submit to the County Instead she chose to cancel upon her return.I am working on several front to find a new customer for this project, some of which are highly creative solutions I have outlined these to *** and have updated her as to the progress At the end of this month will will be presenting this design to a very special group who is highly interested in sacred geometry and who have the financial means to buy it If ***'s true goal is to get her 75% refund, then she should support this process rather than threaten to sabotage the company Finding a new buyer is the only way she will get her refund This requires a bit of magic and strokes of good luck If she chooses to focus her intentions on the positive happening, then it just may happen I will continue my efforts to find that buyer, and God willing, it will happen when it happens. mahalo, Bruce D***, president of Mandala Eco Homes, Inc

As you requested, regarding the document that states a 'guaranteed date of delivery", no such document exists.The contract has a 'requested date of delivery' of 'summer 2016', as you are aware When I became aware that by Nov 2016, months after signing the contract, the *** roof was still in process of being built AND construction on the building had not even begun, I terminated the contract, by reason of default in two areas: production & delivery.I was lead to believe, in various communications, from Jan to Aug 2016, the structure would be delivered & assembled by the end of summer Clearly, that never happened.In Truth & Integrity,***

Aloha Revdex.com,   The customer ordered a very unique, one-of-a-kind, design, a [redacted] roof greenhouse with a curved laminated beam roof .  Our standard contract allows for a customer to cancel an order and receive a 75% refund of deposits once a new buyer for the project is found....

 Other import kit house builders do now allow for a refund for cancelations.  We understand that customer’s situations in life change and we want to extend flexibility to accommodate these life changes.    The uniqueness of this design required me to personally be in Bali to solve some design issues.  The factory built the [redacted] roof, but my engineering skills were needed to attach this [redacted] to the pillars to move the project forward.  The customer knew that I could not go to Bali until after the November election as I was involved in local election campaigns.  She canceled just before my scheduled trip to Bali.  She had a change in partners, a change in life situations, and a change of heart for the project.  Now the has to be patient as we search for a new buyer for her project.  If this was a standard project, that task of finding a new buyer would be easier.  This a very unique and very creative design that requires a customer interest in sacred geometry.  I found a festival in Australia that has a strong interest in purchasing it if we modify the design to suit their needs.  They are involved in co-sponsoring a large festival in Oregon that just ended.  They need to assess their financial situation before they can move forward with purchasing a [redacted].  We should be able to hear back in September from them. I am negotiating with [redacted] to build this [redacted] for their [redacted] program.  This would give it nation wide publicity.  [redacted] recently filmed us building a Tiny Temple Home on Wheels for their Tiny Paradise program.  I have put a proposal forward which has the blessings of the casting director.  It is now on the table of the [redacted] executives for consideration.   We have recently built a new website and will soon be adding a [redacted] page to the website, feature this partially built structure.  With proper SEO, this should draw some attention to this unique design.  Once it is on the website, I will send out letters to organization that are interested in sacred geometry for their consideration. I am meeting later this week with a San Diego customer who has interest in this design for a yoga studio. A new idea has come up to work with an [redacted] manufacturer to distribute these as a new product line.  This will take time to pursue. I wish we had the funds to just give her an immediate 75% refund.  We had some financial setbacks and just do not have the funds accommodate her change in life situation.  I am now back in USA until November, have just completed a big project with [redacted] and a new product launch that took all my attention.  I will now focus more attention on solving this customer’s cancelled order refund.  Let’s all focus our intentions on a new customer for this [redacted] project. Take 2....It is my sincere intention to be made 'whole' by Bruce D[redacted], owner of Mandala Eco Homes, by him doing the pono thing & refunding my monies!After reading Bruce's reply it feels as though he seems to believe the reason I cancelled my order was due to "life changes" & "partner changes".  That is simply NOT my experience!  I canceled my  Jan 2016 order, in Nov 2016 due to his nonperformance of both production of product & delivery!! Our contract states that shipping will be "summer 2016".   By Nov 2016, the Flower of  Life [redacted] roof was NOT completed, NO construction has been started on the greenhouse itself & NO permits had been filed.  This was 11 months after the contract was signed & I paid him $41,666.00, representing a 50% down.  Clearly, due to Bruce's political endeavors on Maui, his focus was NOT on me, the client, nor my project; only on his personal/political agenda.   It's now 20 months later.  Bruce has both the product & my monies.  I have nothing!  I am out of patience.When we met in Nov 2016 & I cancelled my order, Bruce stated that he had spend "about $15,000-$20,000" on the incomplete [redacted] roof.   I asked for the balance. He said he did not have it due to his personal financial situation.   Clearly, my money was NOT spent on its intended purpose: the greenhouse project!  Where was it spent?I request a full refund due to the above, through no fault of my own.  When he sells the only product he has built to date, the [redacted] roof, it will not be selling for what I have already paid him.  Where will the remaining funds come from?I also request a 'progress report' on all of the interested potential buyers Bruce mentioned . Again, my pure intention is to have Bruce do the right thing & refund my money he has been holding for 20 months!"
