In response to your letter to Manigault Construction Inc. (MCI) for the referenced complaint per [redacted], [redacted] Maryland [redacted]; it is unfortunate that [redacted] has resorted to filing a complaint against our company because the assertions he is making in his letter against our company are patently unfair. 
 
MCI has persistently worked to complete this project in a timely manner; however at this point we have had no other choice except for to stop work at the site for non-payment.  MCI has completed a majority of the work and prorated time and materials at the expense of our company and filed the necessary invoices/documentation with [redacted] Insurance for the services performed.  Nevertheless, the protocol is that [redacted] would be issued the check from [redacted] and he then was required to send the check to his mortgage company ([redacted]) to sign off on the check, and next [redacted] would release the funds to MCI.  [redacted] refuses to release the check(s) of approximately $20,000.00 and again these are funds that have already been prorated by MCI prior to our invoicing Allstate.  Currently, [redacted] has breached the contract.  We made every attempt to complete this job as effectively and efficiently as possible, we have had numerous face-to-face meetings with [redacted], email exchanges, and telephone discussions with him in an attempt to resolve his concerns to no avail.  Working with [redacted], is extremely challenging due to the fact that we cannot achieve his cooperation in order to make several of the final selections on materials and he is constantly creating an enormous amount of chaos and complaints that is unsubstantiated pertaining to the project.  In addition, [redacted] created a hostile work environment by harassing the workers on “how” to perform the work, then he “suddenly” would no longer allow them to use the bathroom in the house, so they had to travel to the nearest public restroom; accused the workers of “sabotaging” his house (contractors want to be paid not sabotage work); then he refused them access to the house unless he was present and on several occasions we dispatched a team of subcontractors to the site and [redacted] didn’t show up as scheduled. (Needless to say MCI had to still pay the subcontractors for their time.)  Then [redacted] began All previous payments from [redacted] resulted only after we had to keep meeting with him to request the money, he wouldclaim that he wasn’t paying because of work he wanted done by us that was not part of the insurance company’s scope of work.  Furthermore, we did perform a few additional items (i.e., installed recessed lighting at no charge to him) only to realize that [redacted] was attempting to manipulate MCI to obtain gratuities before he would give us money that was rightfully owed to us.
 
It is our belief that [redacted] has no intentions of paying MCI for the services rendered to date; and that he is attempting to intimidate us into completing the project in its entirety by us prorating the services to him.  If we continue this project at this time and under these circumstances we will be out of pocket even more money.  MCI is a small, disadvantaged business and can no longer afford to lose money or time on the project.  We have strived diligently to resolve this  situation with [redacted] and have had numerous contacts with [redacted], Claim Representative for [redacted] Insurance,[insert telephone number].    
 
MCI is willing to participate with Revdex.com and [redacted] in an arbitration to resolve all matters where permissible pertaining to the project.
