In response to Ms [redacted]'s complaint, we did not fail Ms [redacted] as a customer

On March 20, we replaced Ms [redacted]'s hot water heater with a Bradford White hot water heater. The hot water heater was installed according to code and operating normal. The hot water heater is a standard hot water heater and is installed in basements with sump pumps all the time. There are no special hot water heaters for basements with sump pumps.
We did not hear from Ms [redacted] again until May 2, 2014. At this time, Ms [redacted] contacted our office and informed us that her hot water heater was not working and that there were electrical wires coming from the hot water heater onto her basement floor. When installing the hot water heater, there are only three connections; connection to the gas line, connection to the hot water, and connection to the cold water. There are no electrical wires that touch the floor.
We promptly arrived to her home the same day to check the unit. We found the unit to have malfunctioned due to water damageThe previous day, we experienced severe rain in our area. As a result, Ms [redacted] accumulated water in her basement, which caused the hot water heater to flood. The malfunction of the hot water heater was not a result of the wrong hot water heater being installed nor a result of the hot water heater not being installed properly The hot water heater malfunctioned because of the the water that accumulated in her basement due to the rain storm. The manufacturer warrantee does not cover damage due to rain damage. This is a matter the customer would have to pursue through her home owner's insurance.
We have been in business over years and we pride ourselves on customer service. Our trained professionals perform quality work. If for some reason a system malfunctions as a result of our work, we have no problem resolving the issue. However in this case, we were not at fault

I am rejecting this response because:
Mann’s definitely failed me as a customer. I chose them based on their 40 years of service and presumed professionalism. With this experience they should know how to properly install a Water Heater in an unfinished basement with Sump Pump.
My previous Water Heater lasted me for 15 years with occasional water in the basement when there was excessive rain.  None of my equipment in the basement has ever been damaged by water.  If Mann’s had just elevated the Water Heater based on the fact that they knew (and utilized) the Sump Pump in the basement we would not be having this issue.  They knew there was a potential risk based on the presence of a Sump Pump and they installed a Water Heater with slots and wires at floor level when they had more than enough clearance to elevate it.
The water damage is solely due to the fact that the water heater was not elevated off the ground since the slots and wires were at the bottom of the unit. As mentioned before, I have had water in basement on other occasions and on no occasion my water heater ever got damaged. 
 
When I spoke to [redacted]  the morning prior to the installation, I specially told him about the current water heater that I have.  As a Professional their Technicians should have evaluated the situation prior to installing. They needed to ensure that they have all the right tools to do a proper installation due to the fact that the basement is unfinished with a Sump Pump.
The only reason Mann refused to remediate the situation is because the manufacturer refused to honor the warranty. This could be based on the fact that they did not complete the installation properly.
My property is not located in a flood zone and do not require flood insurance.  I cannot make a claim against my Homeowner’s Insurance as Mann’s suggested.  This issue is based on a job that was poorly done and to make an insurance claim would be fraudulent.
I am hoping that Mann’s will do the right thing and admit that they did not do all they could to protect the Water Heater.

We understand that the customer is disappointed that her newly installed hot water heater malfunctioned due to water damage.  However Mann's Heating & Air Conditioning is not at fault. 
As stated previously, there are no special hot water heaters for basements with sump pumps.  The appearance of a sump pump does not warrant a hot water heater to be elevated. The only way we know to elevate a hot water heater is if the existing hot water heater is elevated or if the customer requests it.  The existing hot water heater was not elevated and the customer did not request the water heater be elevated.  As a result, we performed a direct replacement as requested by the customer.
We did use the sump pump to empty the water from the old water heater, which is normal practice.  The sump pump was fully functional while we were there.
Mann's Heating & Air Conditioning refused to refund the customer their monies because outside weather conditions caused the basement to flood which ultimately caused the hot water heater to breakdown.  The hot water heater we installed was fully operational.

I am rejecting this response because:
If I had done the job myself, then I would take full responsibility for the poor installation. Since I am not a plumber by trade, I hired professionals with many years of experience in the business.  Based on their experience, these guys should have the ability to evaluate the job and complete a solid installation.
Let me kindly point out the differences between the Water Heater that was replaced and the one that was installed.
Original Water Heater (Replaced):
1.       The Water Heater was solid from top to bottom thus, no protection needed (such as elevation from ground)
2.       The Water Heater lasted for at about 15 years.  This is the original Water Heater that was in the home when I purchased it.
Mann’s Water Heater (Installed):
1.       Water Heater had slots at the bottom and wires hanging to the floor thus; it should have been lifted off the floor for protection.
2.       The Water Heater lasted less than 2  months
As professionals in the business for over 40 years, they should have evaluated and analyzed the job prior to showing up with a Water Heater in the back of their truck.  Proper evaluation could ensure that the installation was proper and solid.  The fact still remains true that the job was not done properly.
Again, I am asking that Mann’s take responsibility, move on and use this as a teaching moment for their Technicians.  They should never show up for a job without doing a thorough evaluation and having the proper tools.

Review: On March 20, 2014, I contacted Mann's Heating & Air Conditioning to install a water heater in my home. The water heater was incorrectly installed. This is a basement with a Sump Pump and the potential for flooding when there is excessive rain. Mann’s was aware of the Sump Pump because their Technician utilized it to pump the 40 gallons of water that was in the old water heater. This act unknowingly burned out my Sump Pump. As a professional they should have used their own tool to get rid of the water. The heater they installed had wires almost touching the floor and was never elevated which should have been done for a basement that has the ability to flood.

I spoke to the manager [redacted], the morning prior to the installation and told him that I wanted a water heater similar to the one that I was replacing (which lasted 14 years plus). He said they don't make those anymore. They apparently changed the way Water Heaters were made 15 years ago. Based on this fact, they should have elevated it since it’s different from my old water heater which had no openings or wires at the bottom. I had concerns but I thought they knew what they were doing since they have been in the business for more than 35 year. In my opinion they were negligent in installing the Water Heater. There was more than enough clearance for the Water Heater to be elevated at least 8 inches off the floor.

On May 1, 2014, we had lots of rain in my area which brought some water in my basement (about 3- 4 inches). The water heater stopped working and Mann's refused to remedy the situation. The Manager [redacted] referred me to my Homeowners insurance and adamantly told me that he will not stand the loss. I had to reach out to another plumber who properly installed a brand new Water Heater and elevated it from the floor the way it should have been done by Mann's Heating & Air Conditioning.Desired Settlement: Since I had to get the job redone since Mann's did not try to remedy the situation, I need to get reimbursed fully - $945

The hot water heater was not poorly installed. As previously stated, the unit was installed according to code and fully functional. There were no wires on the hot water heater that hit the floor ( please see previous response as to location of wires). We performed a thorough evaluation and concluded that the hot water heater needed to be replaced. Not until the customer's basement flooded did the hot water heater stop working. The customer did state that her basement flooded due to rain storm in the area. We cannot be held responsible for outside weather conditions.
