Janet N, owner of Manor House, refuses to refund deposits for weddings/receptions cancelled due to government shutdown. She tells brides and grooms to reschedule their event after they pay a $1500 change fee or she keeps their deposits. This is not a good way to run a business and expect to survive the current situation. I'm sure that their deposits have all been spent and Janet has no way to refund their deposits - what about the government assistance Manor House received? To tell a couple to reschedule their event is totally unacceptable. Not everyone is able to do that. In her testimony to the Governor's restaurant/bar advisory committee, she mentioned that 15 couples did "cancel" their events. So that is telling me that Janet has kept 15 deposits. If we average a deposit to be $5000, she has kept $75,000. That's a hefty amount. These couples are just starting out and she selfishly tells them "no......reschedule". My favorite quote in a *** review I read is.. "How do you sleep at night Janet N?" This is bad business.

The *** wedding/reception was scheduled for 5/17/20. We offered everyone affected by the COVID shutdown to reschedule with a $1500 reschedule fee, this was due to the fact that we offered to reschedule to 2020 or 2021, thus giving up a new date and a new booking. This fee also covers our staff for making the changes to a new date, and putting in more hours due to the change. We are not trying to take advantage of any of our brides & grooms, we are simply trying to stay in business. No, we have not gained $75,000 in cancellation fees, we have an income loss of over 700,000. Our business is events and we are trying to stay in business and do all that we can to reschedule anyone who wants to move the date to later in 2020, or 2021. As of today we have moved over 15 weddings and receptions and all have been gracious and understanding and paid the fee. I am sorry that the ***'s feel that we have taken advantage of them, but please remember that COVID was not the fault of Manor House, we did not shut ourselves down, this was mandated by the state of Ohio.
To resolve this matter I would be happy to allow the ***'s to reschedule up to March 31, 2021 with no fee. After April 1, 2021 there would be the $1500. The $4000 that they paid would be applied to the new date.

We paid $3000 as deposit in January 2020 toward our wedding scheduled in the summer. COVID related international travel issues limit our immediate family from participating in the wedding at this time, so we were forced to reschedule our special day.

We informed the business that we could not provide a specific date until the various restrictions were lifted but that we generally planned to reschedule for some day in 2021. On May 20, 2020, a sales manager representing the business informed us of change fees and offered to hold on to our deposit until we could provide a specific date. We agreed to this and told them that we would hopefully get back to them in fall/winter 2020. The sales manager acknowledged our response.

A week later, the sales manager reached out and asked us to pay $6500. A couple of days later the owner reached out and asked us to pay $13,500 by 6/21/2020 or expect to lose $3000. This number - $13500 - was explained to us as the sum of installments that are due 6 months and 3 months before the wedding date ($6000 each) along with a change fee to postpone the wedding to 2021 ($1500).

We understand that typically, Manor House Event Center requires a deposit payment is due at the time of requesting a date to book the venue. This is followed by installments six months prior to the wedding date and then 3 months prior to the wedding date. Since no weddings were taking place during COVID related closures, no installments were paid. The wedding date has changed due circumstances neither party is responsible for.

As a result of written electronic communication from Manor House, we believed that they had agreed to hold on to our deposit with no additional charges until we were ready to pick a date. However, they now assert that without an additional payment of $13500 by 6/21/20, we would no longer be able to use our $3000 deposit toward any future dates.

The abrupt change in their written offer to us and risk of being unable to use our deposit toward a future date if we are unable to suddenly pay a large sum of money within a very short span of time, unfortunately leaves us no choice but to request for a full refund ($3000).

In response to complaint #***.I have emailed *** several times. I have tried to explain that they can use their deposit of $3000 toward a new date in 2021. If they chose a date in 2021, and then need to change that date due to travel bands we will allow this as well. I have offered to add an addendum to the contract stating this. As for payments due, the attached contract shows that we entered into a contract on 1/21/20 for an original scheduled date of 8/22/20. The signed contract states that progress payments must be made and were due on 2/22/20-$6000(before covid started) and 5/22/20-$6000. No progress payments have been received. Our guidelines for rescheduling any event due to Covid19, state that you must be current on all payments in order to reschedule. This protects us and the client by enforcing the contract that was signed. We are also very consistent in treating all reschedules the same and we do not make exceptions. Again this is to protect us and the client per the contract.Resolution:Choose a new date in 2021, pay your progress payments that are past due. Pay the $1500 postponement fee. All money paid, the $3000 deposit, plus all progress payments will be applied to the new date. For your reference, details of the offer I reviewed appear below.After they changed the terms of their own offer, we requested a refund our deposit and the business offered to resolve it by asking us to pay more than twice that amount within one week!Specifically, we requested a $3000 refund and their counter-offer is to ask for $7500 by June 21, 2020, or we lose the deposit altogether. We respectfully disagree with this resolution. According to their contract, installments are payments made 6 months and 3 months before the date of the event. A non-refundable payment of $7500 for an event that will not happen for more than a year, if at all, is unreasonable. I have outlined the various assertions made by Manor House and responded individually to each of them below: 1. Issue of payment of $6000: Manor House asserts that they are entitled to the installment due 6 months before an event that is now cancelled because it was "before COVID." According to the CDC website: "Community transmission of COVID-19 was first detected in the United States in February 2020." At the time, large gatherings were known to increase the risk of contracting COVID-19. Furthermore, it was also known that

contracting this contagious illness could result in death.

Given this, we opted to hold off on any further steps involving an event that could potentially gravely compromise public and personal safety. While we hope to get married next year, COVID-19 may affect our plans again. Now that we are aware that Manor House does not refund money even when their service has to be cancelled because it poses serious risk to public health, it would be imprudent to give them any more money until rescheduling a large gathering is clearly safe for our family and friends. 2.

Issue of payment of $1500: Manor House asserts that they are entitled to a change fee within the next week. They justify this by offering flexibility to reschedule the date in the future.It has only been 13 days since the State of Ohio has reopened. The health impact of reopening and gathering in large numbers remains unknown. A second wave of COVID-19 would suggest that cancellation rather than rescheduling would be in the best interest of public health. So if we were to pay the fee, would Manor House agree to refund 100% of the money paid to them in the event of future cancellation due to COVID-19? Expecting immediate payment of a non-refundable change fee during a period of such extreme uncertainty transfers all future risk of monetary loss to us. Just as we are not asking your business to assume the risk of something that no one in the world can predict yet, we are requesting that you lend us the same courtesy. 3.

Issue of payment due by 6/21/2020: On 5/20/2020, a sales manager representing Manor House made us an open-ended offer to decide on a future wedding date without asking for any additional payments. We truly appreciated this. Subsequently, the owner rescinded this offer. They have now imposed an arbitrary deadline to make a decision that is still entirely out of our control. For example: How can one predict when an international travel ban might end or when it might restart? Manor House has given us a week to figure it out. This leads to 3 future outcomes. In 2 out of 3 of those scenarios, Manor House gets paid without ever needing to provide a service, as follows: 1. We don't pay: They keep $3000 and never provide a service.2. We pay $7500 but a second wave of COVID necessitates cancellation: They keep $10500 and never provide a service. 3. We pay and things progress as planned: They still get paid, but this time for providing a service. Thus, their offer resolves the issue in a manner that is only fair to them. Given the changed terms of their own offer, we continue to request a refund of our $3000 deposit. Regards

In response to ***-

1. It is very important that we be consistent with all our wedding/receptions booked at Manor House. I am offering you the same as everyone else by going by the original contract signed by you. Per our contract we do not have to offer a reschedule date since we are able to have your wedding scheduled for 8/22/20. This is stated in your signed contract. We are trying to work with all brides/grooms.

2. A $1500 change fee is very reasonable. We will be out the wedding income for 2020 and giving up a new date in 2021 that we could have booked a new wedding. Some venues are charging over $5000 to reschedule or not allow this at all.

3. An open ended offer was never made by our sales manager-we offered to allow them to move to any date in 2020 for free, I will also allow them to move up to March 31, 2021 for free. If they move to a date after April 1, 2021 then they will owe the $1500 fee. On May 21, 2020 Madison B emailed the client to let them know that they owed the February Installment payment on $6000 per the contract. Our guidelines state that all payments must be up to date per the original contract in order to move. Again, we are being consistent in our policies with all brides/grooms. Then on 5/22/20 they had another progress payment due in the amount of $6000. Again, this is per the original contract. Once all payments are made they will able to reschedule for any date they choose. All money paid will apply to the new date.

Resolution:

We would be in agreement to do the following:

Make your February payment now in the amount of $6000. you do not have to choose a new date now for 2021. Once you choose the new date then you will be required to pay the 3rd installment payment of $6000 plus the $1500 change fee. 2 weeks prior to the wedding you will owe any balance due as your final payment. We will not refund the $3000 as we have held the original date for your wedding since 1/31/20.

I hope that this resolves this issue and that we can come to an agreement. We value your business and want to be able to host your wedding here at Manor House.

Due to this global coronavirus pandemic we feel our wedding that was set for June 20,2020 not only is not safe to have but this is not what we paid for not to mention they refuse to work with us and want to offer only2 Saturday dates on November 28 and December 5, 2020 that won’t work for me due to my busy season @ work . Then they tell me if I want to postpone to next year there would be a $1500 additional fee . Now they are telling me through email sent by owner Janet Nelson that we missed a payment on 3/20/2020 and I’ve been in contact with Madition over the last few months and she never mentioned owing any money or did I receive email about owing money and a phone call when last payment was due in December 2019 , plus everything was shut down at this time due to the stay at home order by Governor DeWine.

In response to the complaint #***. Per the attached contract you will see that all deposits are non-refundable. This is stated in section 2 A-E of our contract. The payment schedule is also attached showing that a payment was missed on 3/20/20. Our contract states that we must receive written notification of cancellation 3 days prior to the payment due date. No email correspondence was received until 5/22/20 asking that we cancel the wedding. The 3/20/20 payment of $3500 is due. In no way is COVID19 the fault of Manor House. We have held the wedding date for the *** wedding/reception since 11/15/18, making it impossible for Manor House to book another wedding for the contracted date of 6/20/20. As of 5/21/20 our local Health Department gave us the go ahead to open for business. We can hold any wedding and or reception with a total of 300 people. We are open for business and can host the wedding scheduled for June 20,2020. Manor House is meeting our requirements per the contract. We have also generously offered to reschedule the wedding for any date in 2020 at no additional cost, or move to a date in 2021 for a small postponement fee of $1500. We would apply any money paid to this new date.Our solution:Have your wedding/reception per the contracted date of June 20, 2020 or move to a different date that is available in 2020 at no additional cost. Please understand that our business has been devastated by COVID19, and in no way is this the fault of Manor House. We have held your wedding date since the signing of your contract on 11/15/18, thus making it impossible for us to book another wedding on that date. This is why we have a contract and why the money paid is non refundable. This is why you are still responsible for the $3500 due. We have also offered to move your date to any other day in 2020 for no additional cost and any date in 2021 for an additional $1500. We have tried to work with you on coming up with a solution that works for all of us. My Fiance and I have had our wedding planned for May 17th and we booked the reception at the Manor House. The COVID-19 pandemic has caused the governor of Ohio to shut down businesses such as the Manor House, which has made it impossible to have the wedding reception there. We are forced to have a private wedding with a much smaller reception at our house.

The Manor House has refused to refund the $4000 deposit even though it is impossible to receive the service we paid for. They offered to use the $4000 as a credit towards another party of our choosing as long as we throw the party within year 2020. We do not live lavishly and cannot just put together another random party the same size and price as a wedding. We were willing to pay the $4000 for the wedding reception, but it's no longer possible due to this force majeure type of situation. It was nice of them to offer to let us use the $4000 for a different event later this year, but we are not people who can just throw $4000 parties for random celebrations on a whim.

This in no way voids his contract, this was his choice to not move his date and apply the money paid. Manor House feels that per our contract we have met our obligations and have every right to keep the $4000 paid with no refund to Mr.. In two phone conversations I have explained this to Mr. and offered our solutions. We have been very consistent with our guidelines for any changes that have had to take place due to COVID19 and have given all of our clients these same options.

Solution:

We propose that Mr. choose an alternate date for his wedding and reception. If he does not want to hold a wedding/reception here at Manor House he could use that money anytime in 2020 for a party or for catering of his small reception at his home.

We propose that Mr. choose an alternate date for his wedding and reception. If he does not want to hold a wedding/reception here at Manor House he could use that money anytime in 2020 for a party or for catering of his small reception at his home.

In December Of 2018 my wife and I put a deposit Off 500.00 down for venue for my son to get married at
Then my wife mom died on Christmas day at out home and February the 4th her Father passed, so needless to say we where really shaken to the core so we tried to get the deposit back immediately, our sons wedding wasn't till july so we thought that should be no problem, so 5 months away. So we called to see if there was any way to get the money returned, so we could try to save some money
But they wouldn't even consider this issue, the worst part about it is that we no the owner, But Money is more important than any bodies life and what it costs to perpare two funerals, My wife sets up appointments for a hair solan and this woman comes in there ,still my wife calls the owner to remind her of her hair appointment so she doesn't miss it. The contract doesn't say any thing about not returning the deposit if needed. I don't know how some people can look in the mirror.

They booked our carriage house for July 3rd, signed a contract, and paid a $500 deposit, which is attached. Their sales manager was Christine C an employee of Manor House.Mid January Christine C our sales manager, received a call from the son *** saying that he and his fiancé decided to not do the rehearsal dinner at Manor House. Christine told him that the contract was with the Mom, *** and she would have to call in and cancel. *** called in and gave the same reason, the son and fiancé decided to do the rehearsal dinner at another place. Christine explained that the deposit of $500 was non refundable. She said she understood. NO other discussion took place concerning the deposit.Since that time I have seen *** multiple times at my hairdresser, yes she does call to remind me of my appointments because that is her job. I did find out that both her parents had passed away and I sent a sympathy card to her house. In the past year since all this happened *** and I have talked numerous times at the hair salon and have had no issues with each other. There was also no mention of the deposit or that she felt this was unfair. I have seen Mr. *** one time at the same salon, and again no mention of the deposit and he was very friendly to me. Per our contract section 2a states that the deposit is non-refundable. This contract was signed by ***. My solution to this unfortunate situation is that if they book an event between now and the end of 2020 I would be willing to apply this deposit of $500 to another event held at Manor House. Yes, My wife *** wouldn't beg for the Deposit to be refunded , she was emotionally wiped out losing both of her parents at the same time,

I spoke with another Venue concerning the issue, and they couldn't believe that they wouldn't even consider returning the deposit being that it was still very early

in the season to replace that date. Some people will take any situations to make money. So Janet you keep that little money. There is always an exception to the rule but not in everyones eyes. Hope all is good with you your family,Janet and your Business.
