I responded directly to they tenant since I got her complaint. We give her couple of options:
1. We order a carpet vendor to re-shampoo her unit. I even went to her unit and did not smell any cigarette odor.
2. We can move or transfer her...
in a different unit ASAP with no transfer fee and same rent but she don't want to move or transfer. She claimed that is does not matter, she claimed that she could not lived in a smoking building.
3. She can give us 60 days Notice to Vacate. We even give her they forms but she never comply.
We disclosed to her since they day one that our building is not a non-smoking.

They haven't clean the carpet like they promised, and it has been a month. One of the manager came to the apartment and he did smell some cigarette, the cleaning personnel that cleans the hallways came into my apartment and they did smell it too. I decline to transfer to another unit because I know now the building is a not- no smoking building; which I was not aware of that when I rented it, neither was not inform like the claimed they did tell me about it. They did give me a letter to vacate on September 30th, which I already sign and return to them. But the manager told me that I will have to pay until they can rent that unit otherwise I will go to collection if I decide not to pay for the apartment once I not there anymore. I cannot afford to pay two places, and rigth now I am paying for that apartment that I don't live there anymore, I have been staying at my family's house or friends, and I need to rent somewhere else. but the manager told me he will not make an exception and still yet not fix the problem meanwhile.

This case had been resolved. We decided to have her voluntary move out and break her lease. She move out on (voluntarily mutual agreement) August 31, 2015.
She and her ex-husband had and issue or open case with City of Plymouth Police Department and our property for breaking windows and damaging their apartment prior to her move out.
