wall’s extension that they constructed is encroaching on our neighbor’s propertyAlthough Manu Mafi Contractors agreed to correct this problem they have not done so until now.As previously mentioned, we received a Notice of Violation from the [redacted] stating that we will be fined if corrections are not made to wall immediately, and further brought to the Prosecuting Attorney.In light of this situation our attorneys have instructed us not to make any further payments to Manu Mafi Contractors until these violations have been corrected to the satisfaction of the ***It is not reasonable to expect my husband and I to reward Manu Mafi Contractors for the liable damages that they have caused to my property and the criminal behavior that they have conducted towards me without them showing good faith by correcting these violations in order to avoid further escalation of this problem.My husband and I have never failed to pay Manu Mafi Contractors in advance for work that they have done, nevertheless we have been rewarded with disrespect, work that was left unfinished and the substandard results that have led to building code violationsPresently my husband and I are being held liable by the state of Hawaii and the [redacted] because of Manu Mafi Contractors’ failure to hold up their end of the contract and therefore constant breach of contract.We have no intention of neglecting our contractual obligation, providing that the work is completed in a timely manner and within the legal standardMy husband and I have proof of every statement that we have made to include the letter of violation listing Manu Mafi Contractors as the reason for the violation.Upon receiving the violation, my husband contacted Mr [redacted] (the assessor who conducted the inspection of the work done on our property) to get an understanding as to why there was a violation and he explained to him that he had informed Manu Mafi Contractors in August that they needed to make corrections on the retaining wall and was told by Manu Mafi Contractors that they will correct the problem by having the architect create a new drawingHowever, when Mr [redacted] re-inspected the property several months later, no corrections were madeMr [redacted] stated that he then attempted to reach out to Manu Mafi Contractors but they did not reply back to Mr [redacted] .Mr [redacted] insisted that he wanted to avoid citing us, the homeowners, for the building code violations caused by Manu Mafi Contractors which is why he contacted the architect who informed Mr [redacted] that he never heard from Manu Mafi Contractors in regards to a request for a new Architectural drawing which would have corrected the problemI would like to point out that Manu Mafi Contractors were the ones who requested the original Architectural drawings for the retaining walls for which were paid notwithstanding# Our house was recently built, so my husband and I are the original owners and we do not have children or any kind of petsMy husband is in the military and is stationed at [redacted] Other than my husband and me, conducting the occasional random property inspection, no one else has been on our property other than Manu Mafi Contractors Manu Mafi Contractors conducted excavations in the yard right next to the Air Conditioner (AC) compressor in order to build the retaining walls and while doing so they hit the unit with the [redacted] tractor during the excavation.Originally, Sii Mafi agreed to replace the AC compressor unit then retracted his promise after his father, Manu Mafi, instructed him to refuse to pay for the damageThe AC Compressor unit was damaged because Manu Mafi Contractors hired a worker who was not trained on how to operate a [redacted] earth moving equipmentDuring a visit home in July 2016, my husband noticed the worker while he was struggling trying to operate the [redacted] to excavating the dirt near the AC Compressor unit The next day, the [redacted] operator did not return to work due to the damages that he caused to the AC Compressor unitAnyone can see that the damages were made by heavy equipment # Damages to the vinyl siding was caused during operating the [redacted] around the house, the laying of cement foundation for the driveway and the concrete pavement around the house We are requesting that the damaged siding be replaced with new sidings, and therefore restored to the initial status, and not just to be patched or repaired.# It is imperative that the downspouts be replaced as soon as possible, to prevent further damage to the wood frame beneath the vinyl siding caused by rain water seeping under the vinyl siding.# These are concrete splashes that were placed beneath the downspouts to conduct rain water away from the house; the original splashes that were there when we purchased the house were destroyed by the [redacted] during the excavating of the property My husband had discussed this with Sii Mafi during his visit in back in July 2016.# This is a retaining wall that was built to hold the dirt in place which is [redacted] in front of the house on the right side where the present driveway is [redacted] facing the window in front of the houseThe situation was pointed out several times by me to Sii Mafi who stated that they will repair it but never did.# Manu Mafi Contractors stated they have done many favor for us, however, two contractors came to inspect and provide estimates for corrections to the work done by Manu Mafi Contractors and they both stated that substandard cement was used to pave the driveway and the areas around the house and they pointed out the superior quality of the cement that was used by [redacted] versus the poor quality of the cement used by Manu MafiWe expect the repairs to be completed according to standard and not crack again three days after they leave the premises.# MrManu Mafi was present when I approached his worker and told him not to throw unused cement at the root of the tree which is [redacted] on community property in front of my house and for which I am responsibleI also explained to MrMafi and his workers that there is a $5,fine set by the [redacted] to the property owner for any destruction to community propertyHowever, this was not the first time that I had to warn Manu Mafi and Sii Mafi not to conduct such actions because of community rulesMrMafi also laughed in my face and turned his back to me when I asked him to tell his workers not to throw the cement all over the grass where the tree is plantedOn a previous occasion during which Manu Mafi Contractors were working on the retaining walls on the [redacted] street side of the property, one of Manu Mafi worker’s threw discarded cement on the grass near the side walk and I informed them not to do so because I could be held liableAnyone can see the cement thrown at both the treesAs to the claim for $10,for work not yet completed, I will repeat what I stated in section #above, per the advice of my attorney, no further payment is to be made until all discrepancies are corrected and completed according to the standard provided by the architect and the *** We have already paid a total of $87,to Sii Mafi to have all retaining walls complete and the fence which have not yet been completed to standard or at all, along with the replacements and repairs to all damages done to the propertyUpon completion of the replacements and repairs, my husband and I will request to have [redacted] conduct an inspection of the property in order to confirm that the work was done according to standards and so that our warranties will not be cancelled by [redacted] It is difficult to understand why Manu Mafi continues to request $10, while I am being fined on a daily basis because of a building code violation which they have caused and have neglected to correct.There are numerous unfinished businesses that need to be resolved before we can discuss any additional paymentHowever, Manu Mafi continues to deceive us by making promises that they have not kept in regard to completing the construction of our projectBecause I have made all payments way advance of any work being done, Manu Mafi took this as a sign of stupidity, treated me with disrespect while emphasizing that I was not born in the United StatesAdding insult to injury, he proceeded to belittle me because I am a womanPer the email attached by Sii Mafi:aWe, at no time, fired Manu Mafi Contractors, this allegation is a lieAs stated in the email attached, there were many instances when we thought of doing soHowever, the situation had begun to seem like blackmailThe contract was written so as to have us pay in advance, only to be told that the work had to be placed on holdThe claim of being fired was a strategy employed by Manu Mafi Contractors to get out of the contract once they had received the $15,for the fence in front of the houseNot only was the fence never built, but the strategy employed by Manu Mafi Contractors would allow them to get out of replacing and repairing all damages caused to our house.bFurthermore, Manu Mafi stated that they were forbidden by us (the homeowners) from entering the property but this statement is also falseWe are fully aware that had we told them not to enter the property, it would have prevented them from building the fence for which they were already paidTherefore, this is another strategy being used by Manu Mafi Contractors to breach the contract under the guise of not being able to enter the property when it should be obvious to anyone observing this case that this would have been an economically unwise decision after paying $15,to Manu Mafi Contractors for the completion of the job.cAt this point, we feel forced to hire another contractor to build the fence after continuous back-and-forth email traffic for weeks and months, requesting that Manu Mafi Contractors finish the fence, only to have them state that we never agreed to a specific date in the contract for the completion of the fenceI am fully aware of that, however, this does not imply that the completion of the fence is an open ended matter to be left totally at their discretionIn this case, all costs incurred for the completion of the fence will be covered by Manu Mafi ContractorsWe are attempting to give Manu Mafi Contractors the opportunity to correct these problems before we are forced to take other measures

Yes Contractor is still willing to cover cost of repair work (This is for repair that was a result of my men damaging stuff during work period) I will not work until we receive $10,which is due for completion of hollow tile wall There where no deadlines for completion of metal fence Homeowner breached contract when they refused to pay balance of $10,000.00# Regarding the new air condition? I am rejecting this response because:
My husband and I paid Manu Mafi Contractors $87,to
complete several retaining walls around our property, which included building a
fence and gates in front of the house, however, after the payment was made,
MrMafi came up with excuses as to why the job was delayed, claiming that he
had another jobs to work also that his company was unable to receive the
construction material necessary to start the work
In MrMafi’s response, he claimed that there were only
“a few minor repairs that need to be completed”, however, these are major
repairsManu Mafi Contractors failed to mention that they have caused major
damages to our home for example; our brand new air condition compressor was
severely damaged during construction on the CMU walls to replace this unit, it will
cost us $5,550. Additionally the vinyl
siding on our house was damaged along with one down spouts which was
completely ripped off the side of the house during construction work done by Manu
Mafi ContractorsThere were also splashes which were bro*** by the heavy
earth moving equipment use by Manu Mafi Contractors during construction; it
will cost us an additional $6, to replace these itemsManu Mafi Contractors also caused damages to a
retaining wall built by D.H *** in front of our houseManu
Mafi Contractors were also paid to pave a driveway and walkway around the house
for which they uses cheap cement that started cracking two days after it was
pouredFurthermore, Manu Mafi
Contractors instructed his workers to throw unused cement at the root of a tree
that was planted in front of our house by the developer despite desperate pleas
by me not to do so
The action taken by Manu Mafi Contractors caused the tree
to whiter and die for which, the community *** has informed my husband and
I that we will be receiving a fine of $fi we do not replace and landscape the
tree. The cost to repair the preexisting
retaining wall will also cost us $1,500.
Manu Mafi Contractors was also paid $15,to complete an
aluminum fence and gates in front of the house which they still have not begun
to work onIn order to have another contractor complete this job, it will cost
us 16,due to the sloppy CMU concrete work that Manu Mafi Contractors
installed in front of the house

Mafi Contractors stated that I forbid them from entering my property to
complete the work but I never gave any such instructions. In addition they took the liberty of showing
up at my home after 10:30pm while I was alone and asleep to pick up their
equipment with the full knowledge that my husband was away on military duty,
with the intent of terrorizing meManu Mafi
Contractors came on my property without prior notice, started up a *** tractor
turned on all of the bright lights and directed them into my bedroom
French-doors
On
several other occasions MrManu Mafi took it upon himself to disrespect me by
telling me that I am not an American and that I don’t know anything and should
shut up (I am a Federal employee, therefore, I am a proud American).
Mr
Manu Mafi continually told me that he knew better about how the job should be
done, however, he was never able to address my concerns about the way the work
was being conducted although I was the one paying him

Mafi contractors stated they built planter boxes when I specifically asked
them not to do so. Manu Mafi contractors
were paid to cement the area but took it upon themselves to disregard my
instructionsThey added the planter boxes because it was cheaper than the
cement pavement which we agreed on in the contract. After they added the boxes, they stated that
if I wanted a cement pavement, I would have to pay more money to make the
change

Manu Mafi Contractors took it upon themselves to add the planter boxes, they
requested that I pay an additional fee to change the order back to the original
plan. Manu Mafi Contractors also stated
that I had terminated their contract but this statement is false, at no time
did I or my husband ever stated that they were fired because we had already
paid them to complete the jobThis is a
tactic used by Manu Mafi Contractors to justify their lack of productivity and
refusal to complete the job to standard and in a timely manner

indeed mentioned in an email addressed to Sii Mafi that due to their
unprofessional attitude and poor work performance, I had considered firing them
but that I felt trapped in the contract since I had already paid them to
complete the job
My husband and I have sent several emails to Sii Mafi
requesting that the work be completed so that we could conclude the contract
However, Manu Mafi Contractors constantly gave us excuses as to why they could
not complete the job in a timely manner.
They certainly could not use a lack of money as an excuse since they
were paid in advance to complete the job
On November 17, 2016, my husband and I received a Notice of
Violation from the Department of Planning and Permitting directing us to take
down the wall on Mr***’s (one of our neighbors) side of our property
because it was not built according to the building code and plans submitted by
Manu Mafi Contractors to (***). The
outer wall is suppose to be feet apart from the inner wall, however, these
walls are less that feet apart
We were told by the Department of Property and Planning to
correct this violation by December 15, or risk receiving a fine and the matter referred to the Prosecuting Attorney. In light of all these discrepancies on the
part of Manu Mafi Contractors, how can they claim that they only have “minor
repairs to make” or that we owe them money?
My husband and I
would like to have these discrepancies corrected immediately in order to avoid
