The customer burned out their element by not following proper instructions The customer did not have the water heater service by the manufactured of unit All appliances are warranty by the manufactured Customer was properly directed to resolve issue

Regardless we remain steadfast in our position It is the customer responsibility to prepare their own property Anything over and above the delivery and sis the customer financial responsibility stated in their contract

I am rejecting this response because: in order for the element to be damaged you must have electricityIn our case the water was hooked up approximately two weeks prior to the electricityMHC has canned answers for everything without actually confirming what they say The owner actually told me over the phone, and his oprations manager heard him say this, that the circuit breaker #was damaged yet he did nothing to correct this neither did he inform me of this when we purchased the home or after it was deliveredThe breaker is for the master bedroom/bathtroom closet so we have been without light in the closet or main entryI don't expect MHC to do anything to make things right hence we've chosen the Revdex.com ROUTE WE HAVE YET TO COMPLETE THE FINAL WALK-THROUGH! Had I done a background check on the Revdex.com site prior to buying this home I would not have even stepped on their property.Regards,*** ***

Contractual documents do in fact confirm that *** purchased the home that was shown and delivered to him. The time frame between the time of purchase and the time of delivery must have skewed ***'s perception and or memory of the details of home that he purchased.*** ***

I am rejecting this response because: On March 7th, at closing we described the pad in detail to *** and ***At no time did *** or *** state that the “unconventionalpit set pad” was outside the guidelinesI’m guessing this would have been a good time to communicate the pad requirements to us. The week of March 9th, once the pad was complete, an inspector, ***, *** and *** came to the property and inspected the pad*** stated there should be no issues but would need to bring another inspector*** called and stated to schedule another inspector would cost $1,- $3,He wanted us to pay the feeWe decided to set up a meeting with *** to discuss our optionsAt this point we were ready to terminate the contract and escalate the issue. On March 13, we met with *** and *** to discuss the pad and next steps*** insisted we could find a solution and he was willing to pay $1,for an engineer to inspect and provide the necessary documents needed to proceed. *** wanted us to pay the fee and we did refuse because we were very clear regarding the pad details and MHC did not share the pad requirements as stated in their manual on page The responsibility and error belonged to MHC. Weather is not a factor for completing the internal trim of a house. Heavy rains did cause a major water leak in the master bathroom resulting in roof/ceiling damageThis could have been prevented if the house had been put together timely and accuratelyThe tech that performed the walk with me on May 11, agreed the roof did not look right.May 16, the house is still not completeIt is absolutely ridiculous, the master toilet was cleaned, but the other toilet was used with no waterIt stinks and is stainedHowever, we need to continue with the move due to an expired lease on June 1st

We purchased a home from MHC March 2, 2015. The home was delivered with the following issues: 1. missing bathtub spout 2. edge molding on counter is not flushed with the rest of the counter 3. grout in master bathroom needs replacement - cracked during move 4. drape clips missing 5. valance curtain and curtain holder missing from living room window 6. collar on rail broken along with scratches 7. main door entry needs paint job - scratched 8. sliding screen doors missing locks and do not shut properly 9. furnace cover does not close 10. window sill has a gap (window between sliding glass doors leading to master bedroom) 11. wall above mirror in master bathroom has a crack line 12. several drawers in the kitchen do not shut properly or at all 13. hallway window does not open properly 14. cabinet molding is not flushed 15. light switch in master closet wired incorrectly; not functional 16. water heater - we moved in on 5/28 discovered water heater did not work. Notified business staff, handyman was sent out. He reported wiring issue. 6/1 SE Tech came out and replaced a cap 6/5 water heater stopped working - contacted business and vendor 6/6 sent an email to manufacturer company 6/8 we had to hire a private contractor to come and troubleshoot the water heater issue - contractor discovered element was bad and would need to replace part 6/9 private contractor came back to replace element and in the process of draining the water discovered the existing element was not the correct size for the unit; in addition the water heater had calcium build up. Per the contractor, the water heater had been tampered with and did not appear to be new. Complete tasks 1 - 15 immediately (convenient to customer's schedule - we both work and have had to take too much time off to address several issues with delivery) Refund for water heater repairs: $205.00 to include trip charge and parts/labor.

All dealer and manufacturer warranty service has been scheduled.  The operations team just walked the home on Thursday, December 12, 2015 to ascertain any and all remaining service issues.  There are no major service warranty issues to address, just minor cosmetic service issues. ...

Customer is being overly demanding and unreasonable is her expectations.  Factory and dealer need time to gather parts and scheduled remaining service.

Any and all factory service items will be addressed by factory and or the dealer once a formal service request is received in writing.  Some of the delays in the set-up were caused by  weather but most were caused by the customer's insistence to have the home unconventionally 'pit...

set.'  Because the customer refused to have the home set according to manufacturer's and or state specifications our company was forced to pay an additional $1000 for an engineer to approve their design.  The customer was unwilling to pay the fee that they created and incurred.  Anything above normal delivery and set-up is the customer's responsibility.  No additional concessions will be granted by our company.[redacted]?

Contrary to the customer’s statements this customer rescinded her contract and refused to take delivery of her new special order home after her home was ordered and built. As per the Texas Department of Housing and Community Affairs Manufactured Housing Division, a dealer is entitled to retain 5% of...

the sales price for special order homes built but refused by the customer, as was the case with Mrs. [redacted]. This customer also filed a complaint with TDHCA Manufactured Housing Division and after a thorough investigation her claim was denied and her filed was closed.  Her complaint is without merit! Her description of how the events transpired is completely fabricated and is a last ditch effort to try to receive a refund that the state has already determined that she is not entitled to receive. [redacted]
