We had driven the car for several days as we do with all of our cars and there was no problem found. When... Oscar told her it was a decent car, he was speaking from the experience we had with it. He did not make any statements about the car except that it was a good car. We had an inventory reduction sale and that car was reduced from $2250 to $1750. Although there were other cars on the lot in that price range, the customer chose that one and insisted it was the one she wanted. There was no "bait and switch". The customer stated that she only had $1550 and we agreed to sell her the car, but on an "as-is" basis because we couldn't afford to warranty it with no profit margin in it and the deal met the criteria of an "as-is" sale. The customer was advised of this before the sale was made and there are posters behind the deal desk in plain sight and large print that say this. We are in compliance with 55-2-316 NMSA 1978 (2006 Modification) "Exclusion or modification of warranties". We always encourage our customers who are going to buy a vehicle as-is to take it to a mechanic and/or inspection service and allow them ample time to do so under the test drive agreement. The customer apparently chose not to do that. You will note on the "as-is" agreement, she signed off that she had satisfied herself with regard to the condition of the vehicle.The customer signed the form that I have attached an example of, and the form was explained in detail during the signing process. This matter has come before the Court in another case and the Judge stated that we are fully compliant with the law. The odometer was noted as "not actual" on the paperwork, which the customer signed twice, once on the purchase contract and again on the title. When attempting to talk the problem out with the customer and her mother, they both chose to just argueat Fred and Oscar, didn't allow them to get a word in, would not listen and a lot of the arguing was threats. We do not respond to people when they are acting like this as no good comes of it. They were not told to "go away"or leave the lot in any manner-they left on their own when they couldn't get their way. We were threatened with a lawyer, which we told her would be fine, but all those threats suddenly stopped and the threats started about turning us in to you. We assumed she had contacted a lawyer and learned that she had no grounds, legal or otherwise, to stand on. We told her to go ahead and turn us in to you, as we have stayed within the guidelines of the UCC and NMSA. We have no idea what she is talking about on the VIN number, as we have double checked all the paperwork and everything matches. When we do an inventory reduction sale, we generally cannot offer warranties, because the vehicles we sell are close to or at cost to free up space for new inventory. Therefore, the cars are sold "as-is" and we do not offer repairs or refunds. Usually, we would have had our mechanic check it out for the customer at their expense (rate reduced), but, we just fired our mechanic and have not found a replacement at this time. It is odd that a car would die, not start and then start as the customer stated. It sounds like there was a simple loose wire. I don't know what mechanic she took it to, but probably, in her shoes, I would have gotten a second opinion due to the common practice of mechanics overstating problems in order to get more work/money. In summary, the customer was advised of everything before she purchased the car and she chose to take the discount and waive the warranty. All of which, I have proof.
